ORDINANCE NO . 317 2
ORDINANCE OF THE COUNCIL OF THE CITY OF PALO ALTO
APPROVING AND ADOPtiNG A PLAN FOR THE CONSTRUCTION
OF FENCE IMPROVEMENTS IN BYXBEE PARK
WHEREAS, Article VIII of the Charter of the City of Palo Alto
and Section 22. 08. 005 of the Pe.lo Alto Municipal Code require that
before any substantial building, construction, reconstruction or
development ls commenced or approved upon. or with respect to any
land held by the City for park purposes~ the Council shall first
cause to be )repared and by ordinance approve P.nd adopt a plan
therefor; and
WHEREAS, the City Council did by Ordinance No. 2252, adopted
in 1965, place Byxbee Park on the list of lands used or intended
to be used for park purposes; and
WHEREAS~ the Council desires to allow certain safP.ty improve
ments to be accomplished by ~yxbee Park which are necessary to
prevent injury to persons at the lOth gr~eu; and
WHEREAS, the 30-f.oot hiP-;h black nylon net fence will prevent
golf balls frow. reaching th·a lOth b.c.'aen; and
WHEREAS, the project was unanimously approved under Section
1:.:.. 82 of the Palo Alto Municipal Code (Site and Design Review) by
the Planning Commission and the Architectural Review Board;
NOW, THEREFORE, the Council of the Cj.ty of Palo Alto doe.s
ORDAIN as follows:
SECTION l. The document attached hereto, marked EXHIBIT "A",
hereby is approved and adopted as additional park improvements
pursuant to Section 22.08.005 of the Pal~ Alto Municipal Code.
SECTION 2. The project was reviewed for environmental impact
prior to action on the said Site and Design Review, and no signifi
cant environmental impacts were found, and no further environmental
assessment is required.
SECTION 3. This ordinance shall become effective upon the
commencement of the thirty-first day after the day of its passage.
