The Council of the City of Palo Alto finds (a) The National Flood Insurance Act of 1968, as amended, and federal regulations promulgated thereunder, require the City to adopt certain flood hazard regulations in conformance with standards established by the Flood Insurance Administration; (b) The flood hazard areas of the City are subject to periodic inundation which may result in loss of life and property, impose health and safety hazards, disruption of commerce and governmental services, ext:caordinary publ:ic expenditures for flood protection a:o.d reU.ef, and impairment of the tax base, all of which adversely affect the public health, safety 1 and general welfare; and (c) These flood losses are often caused by the cumulative effect of obstructions in areas of special flood hazards which increase flood heights and velocities, and when inadequately anchored~ damage uses in other areas, Uses that are inadequately floodproofed, elevated or otherwise protected from flood cl.amag~) also contribute to the flood loss. 16.52.020 Purpose. This Chapter is adopted in order to nomply with the National Flood Insurance Act of 1968, as amended, and federal regulations adopted thereunder for the purpose of promoting the public health, safety, and general welfare, and to n1inimize public and private losses due to flood conditions in speci.fic areas by provisions designed: (a) To protect human life and health; (b) To minimize the need for costly flood control projects, and to supplement the effectiveness of such projects; (c) To minimize the need for rescue and relief efforts associ&~ed with flooding and generally undertaken at the expense of the general v '"Jl ic; (d) To minimize prolonged business interruptions; (e) To minimize damage to public facilities and utilities sucb as water and gas mains, electric 1 telephone and sewer lines, streets and bridges loc&ted in areas of special flood hazard; (f) To help maintain a stable ta~ base by providing for the second use and development of areas of special flood hazard so a~ to minimize future flood blight areas; (g) To insure that potential buyers are notified that property is in an area of special flood hazard. Section 16.52.030 Goals. In order to a.ccomplish its purposes, this chapter includes methods and provisions for: (a) Restricting or prohibiting uses which are dangerous to health, safety, and property due to water or erosion hazards, or which result in damaging increases in erosion or in flood heights or velocitie~:;; • (b) Requiring tbat uses vulnerable to floods, including facilities which seTve such uses, be protected against flood damage at the time of initial construction; (c) Controlling the alteration of natural flood plains~ stream channels, and natural protective barriers, which help accom modate or channel flood waters; (d) Controlling filling, gradingt dredging, and other development which may increase flood damage; and (e) Preventing or regulating the construction of flood barriers which ~ill unnaturally divert flood waters or which may in crease flood hazards in other areas. Section 16.52.040 Definitions. The definitions contained hereafter shall govern the interpretation of the terms defined for the purposes of this chapter, except where the context clearly requires otherwise. (b) Variances shall only be issued upon: (1) A showing of good apd sufficient cause; (2) A determination that failure to grant the variance would result in exceptional hardship to the applicant; and (3) A determination that the granting of a variance will not result in incteased flood heights$ additional threats to public safety, extraordinary public expense, nuisancest fraud on or victimization of the public, or conflict with existing local laws or ordinances. (c) In determining whether to grant a variance, the City Engin0er shall take the following items into consideration: (1) the danger that materials may be swept onto other la11ds to the injury of others; (2) the danger to life and property due to flooding or ero sion damage; (3) the susceptibility of the proposed facility and its con tents to flood damag~:.1 and the eff~;ct of such dRmage on the individual owner; (4) 1he importance of the services provided by the proposed .facility to the community; (5) the necessity to the facility of a waterfront location, where applicable; (6) the availability of alternative locations 1 for the pro posed use which are not subject to flooding or erosion damage; (7) the compatibility of the proposed use with e~.isting and an+,icipated development; (8) the relationship of tbe proposed use to the comprehensive plan and flood pla.in management program for that area; (9) the sifety of access to the property in times of flood for ordinary and emergency vehicles; (10) tbe expected heights~ velocity 1 duration~ rate of rise, and sediment transport of the flood waters and the effects of wave action, if applicable, expected at the site; and, (11) the costs of providing governmental services during and after flood conditions~ including maintenance and repair of public utilities and facilities such as sewer, gas, electrical, and water systems, and streets and bridges. (12) the size and location of the project - 7 - .. ' . . ' ' ' Generally, variances may ba issued for new construction and substantial improvements to be erected on a lot of one-half acre or less in size contiguous to and surrounded by lots with existing structures constructed below the base flood level, providing items (1-11) of this Section have been fully considered~ As the lot size increases beyond the one-half acre, the technical justifica.tion required for issning the variance increases. (d) Applications for variances shall be made with the City Engineer upon such forms as may bo prescribed by the City Engineer and shall be made at the time of application for the develop ment permit. Issuance of any variance may be made subject to such conditions as the City Engineer deems necessary to further the purposes of this chapter. The City Engineer shall maintaj.n the records of all appeal actions and report any variances to the Federal Insurance Administration upon request. Any applicant to whom a variance is granted sha11 be given written notice that the structure will be pArmitted to be built with a lowest floor elevation below the base flood elevation and the eost of .flood insurance wi 11 be corru"'lH~nsura te with the increased risk resulting from the reduced lowest floor elevation. Notice of the issuance of such variances shall be recorded in the office of the County Recorder of the County of Santa,Clara. (e) Notwithstanding the foregoing, the iss~Ance of varlancos shall be subject to the following: (l) Variances shall not be issued within any designated floodway if aQy increase in flood levels during the base flood discharge would result; (2) Variances shall only be issu~d upon the determination that the variance is the minimum necessary, considering the flood hazard, to afford relief; and (3) Variances may be issued for the reconstruction, rehabili tati.on or restoration of structures listed on the National Register of Historic Places or the State Inventory of Historic Places) without regard to the provisions of this subsection (b) or the provisions of subsection (d)t provided that in issuing such varianc.e factors numbered one through eleven of subsecti0n (c) shall be taken into consideration.
