This is an infonnatiooal repoct on • permit 10 be issued 10 MCllIl<'tro A TS, In<:. (MClmetro) for
the instalJatioo of approximately 13,500 feet of fiber optic cable ",thin conduit under certain
sidewalks and streets in south Palo Alto.
POUCV IMPUCATIONS
MClmetro •• wholly-owned subsidiary of MC! C<>mmunkations Corporatioo (MCl). is a
telephone <:«poratioo as defined in Public Uttlities Code Se<:tioo 234 and a public utility as
defuled in Public Utilities Code, Section 216, with the legal right 10 access Palo Alto's right-of
way. Although the law does nO! require MCImetro 10 obtain a ch'y franchlse, the City may
regulate the locatioo and manner of C03S1rUctioo. However, the City canoot restrict Q[ interfure
with MC!metro's right 10 coostrud Q[ maintaiD its te1ecommunication lines.
A pemUt would not preclude the City of Palo Alto from developing its own fiber optic
communication system.
EXECUTIVE SUMMARY
This past summer, Public Works issued a pennitlO MCI TeJecommunications,Inc. to install
fiber opIk conduit under cetIain sidewalks and streets in nOOh Palo Alto. Foo: clarifi<:atioo, boIh
MC!metro and MCI TeJer..ommunications are subsidiaries of the parent MCI Communications
Corpo<ation. The basic Iflfferen<:e between the two is tllat MCImetro provides local service,
while Mel Te1ecommunlcations provides Ioog distance service.
MCImetro bas app1H:d 10 the City for • permit 10 instalJ • reliable, funy redundant
te1ecommunicatioos network in south Palo Alto for the purpose of meeting voiee, data, and
other communication needs.
As with the previous MFS and MCI TeJecommunications permits, the City will require that
MCimetro install the cooduit under the sidewalk aod under the streei .t street crossings using

pedestrian Il!>d vehicular traffic. Also, based on previous recent project., staff will require
MCImetro 10 "pothole" ftequently 10 Mlentify \he \ocatioo. of exis'jr.g underground utiiities and
place the cooduit below the elevatioo of exbting utilities where prnctical. This will reduce !he
riskof conflict with, and su!>seqJent damage to, City-owned ulHities.
The route, mostly within commercial areas of !he City of Palo AM, would start at !he Joint
Powers Board Railroad Right-of·Way (CalTrain) at San Anlonlo Avenue. The route would
cross Alma Street and proceed north on San Antonio Avenue 10 Fabian Street It will then
proceed west 00 Fabian Street IL'1d then north on Fabian Way to West Bayshore Road. The
route would then cross under U.s. Highway 101 10 !he intersection of Elwell Court and East
Bayshore Road It W11J !hen proceed in a southeast d'IreCtioo 00 East Baysbore Road back to San
Antooio Avenue and the Palo Alto city limits. (See attached map).
Precautions will be taken 10 ensure that Ire<S and their roo( structures .. ill D<J( be impacted. An
application fur Architectural Review is being submitted 10 the City of Palo Alto PIMning
Department. Construction ... 111 be petfonned in acco<dance with City of PaJo Alto standards.
The permit is expected 10 be issued in late November IOlIowed by construction in December
1995.
Other permit conditions will include:
• NotitkalioJl: MClmctro ,.·ilI provMle • minimum of two written notices of the
constructioo schedule to those residents and businesses d'u-ectly impacted by the work.
In the event ~ is an outage or service break 10 !he City cf PaJo Aho UIllities,
MCtmetro will immediaiely notify !he City of PaJo Alto or responsible agency, so that
steps can be taken 10 notifY residents.
• Li. bility: MClrnetro will provMle comprebensive general and automotive liability
insurance.
• Indemaificatiou: MClrnetro will indemnify and hold harmless !he City against any
claims, demands, ~ damages, whe1her d"rrect or ind"m:ct. includ"mg liability resulting
from loss ofsenice 10 any third pa.'\y lOr any interruption to any telecommunication or
other utllily service.
• Bond: MClmetro will prov;Je a perli:Jrmance hood in the amount of $50,000 to
guarantee the faithful p"rformance of sidewalk and street restoration work within C;t.l'
of Palo Alto right-of-way.
