This report provides additional infoonation requested by the City Coui1CiI on the Transit
Shelter Advertising PlOgr.m, during discussion of this subject on October 10, and
transmits an ocdinance amending Chapler 16.20 (Sign Ordinance) of the Palo Alto
MUllicipal Code to allow for advertising on bus shelters, for Council's consideration, in
the event the CoIm<;i1 agrees 10 the Santa aara O:>unty Transit District Transit Shelter
Mvertising Program.
RECOMMENDATIONS
Staff recommends that CoIm<;il approve !he City's participation in the Transit Shell",
Advertising Program and:
I. Authocize the Mayor to .:xecute the attached Implem.:ntation Agreement
(Attachment 4) mth!he Santa Clara C.ounly Transit District, for the Transit Shelter
Advertising Program;
2. Adopt the attached Ordinance (Altac!uoeat 3) amending the Sign Ordinance of the
Palo Alto Murucipal Code, 10 provide for bus sheller advertising;
3. Approve the installation of eight advertising shellers under Phase I of the
agreem.:nt. to be clk.,,;en from among the eleven identified siles, as indicated on
Attachments I and 2;
4. Direct staff 10 establish an interim flat rate for unmetered electric 5erV1ce at bus
shelters and relurn 10 O:>uncil be app<ovaIlo add this type of sen1ce to the ele.ctric

EXECUTIVE SUMMARY
By its terms, the Implementation Agreement for lbe Transit Sbelter Advertising Program
must be executed by all participating parties no later than October 3 I, 1995. lfthe City
Council agrees 10 partic;pate in the program. an amendment to Chapter 16.20 of the
Municipal C.ode (Sign Ordinance) is required. For thi, reason, we have included as
Attachment 3 of this report an Ordinance amending the Sign Ordinance, which Council
should appro''e, alollg ""th the Imple:nentalioo Agreement, if Council agrees to the City's
participation in the District's prograll1,

year, the hourly employee operating in the graffiti rna.,agement program will redirect a
portion of current efforts to transit shelter maintenance and the service level Ccunei!

the weekly program is .45 FTE. a corresponding reduction in the graffiti program will

cleaning services for structures. Informal qu(){ations have ra.,ged from $30.00 -$50.00
per hour K>r maintenance and cleaning of shelters. Due 10 the short time period, and the
inability of the contractors 10 visit each sile, staff has not pursued a more formal written
quotation.

The Transit District and Patrick Media bave reevaluated the minimum number of ad
shelter locations that would be needed in Palo Mo, for Palo Alto to participate in !he
program. They have concluded lbat they can reduce their request from eleven to a to!al
of eight advertising shelters, in Ph3-": I of the program. They have submitted a revised
list ofeleven porentiallocatioos, nine along El Camino Real an<l two 00 Page Mill Road.
The Page MiD Road sites would require the joint approval of the City and County. (Refer
to Attachments 1 and 2). Also, upon re\1ewing their records, District staff bave
determined that two of the El Camino Real sites, at Calif<>rnia Avenue and at Hansen
Avenue, arc on prj''l!te property owned by St:mfocd Unive.sily, and intrOO\h,"tion. of
advertising would involve the coocwrence of the university. Four new alternative
locations along EI Camino Real have be,n included. These are locations that currently
do no! have shelters, but have relatively bigh use: two bus stops at Arastraderol
Charleston, one at Los Robles, and one at Curtner. Staff recommeoos that Council
approve the installation of eight ad shelters, from amoog t!>e eleven sites, and direct staff
to work with the District to determine the most appropriate and feasible sites. Until
Patrick Media and the District conduct detaw-.A site evaluations, staff "ill no! know if
1here are any 0Iher impediments c< constraints \0 any of these s;les. Transit District staff
will be present at the CouncIl meeting of October 16, 1995 to respond to questions and
provide furtbel' details on these proposals.
ENVIRONMENTAL ASSPISMENT
The City's parti<:ipation in Phase I of the Transit Shelter Advertising Program is exempt
from the provisions of the Calif<:>rnia Enviroomenta! Quality Act, pursuant to Sections
I SJO I (Existing FacJ1ities) and 15302 (Replacement or Reconstruction) of the CEQA

SECTION~. Section 16.2D.160 of the Palo Alto Municipal
Code is hereby amended to read as follows:

{a} Permit required. Signs for the special purposes set
forth in this SUbsection {a, shall be permitted as provided herein
upon ~aining design review and a permit as set forth in Section
16.20.020.
(1) Directory signs. In all districts where group
occupanci~s in office buildings are permitted, directo~ signs may
be eracted displaying the names of the occupants of a building who
are engaged in a particular profession~ business or the like~ Su~h
signs shall be situated at least two feet inside the property line
and sr~l not exceed eight feet in height~ Such signs may have an
area of four square feet, plus one and one-half square feet per
name, in no event to exceed seventy-five square feet.
(2) COOstruction project signs. Signs may be erected
in conjunction with coostru~tion projects and used for the pu~e
of publicizing the future occupan,ts of the building or t.he
architects~ engineers anU-constru~tion organiza~ions participating
in the project:... .In residential districts~ no su-ch sign shall
exceed twelve square feet in area and DO freestanding sign shall
exceed five feet in height. In other districts no sign shall
exceed the area for the applicable frontage set forth in Table l'
and no freesta.IlCl.l'C.g sign shall exceed eight feet in height. All
such signs shall be removed before a final release on tbe
constru~tion is given by the building Official.
(3) Directional signs. Directional signs may be
erected for the purpose of facilitating or cODtrolling the
efficient or safe movement of pedestrians or vehicles on private
property. Such signs shall DOe be used tor advertiaing purposes
and particularly shall not include the name of any person~ fir.m~
coa:paoy, organization or any prrou-ct or service except as approved
to de9ignate directions to different businesses on the same site.
Such signs shall be located on the property to which they pertain,
shall ~ exceed an area of six square feet nor a height of three
feet and shall be located at least twenty feet within the nearest
property line ... except that directional signs of not more than three
square feet in area may be located DOC less than ten feet within
~y front property line. Such signs shall not be permitted in R..-E,
~~l, or 2·2 districts ..
{4) Subdivision signs. Any person or firm offering
real estate fer sale in an approved subdivision may erect not more
than two signs indicating the location of the subdivision. No sucb
sign shall exce~ forty square feet in area. SU~h signs ~ay state
the name of the subdivider or subdivision or ~h. No such Sign
shall be erected on or situated within one hundred feet of any
occupied residential p,roperty. No su'ch sign shall be illuminated.
The permit for any su~h sign shall be issued for a period of six

mxlths. At the end of such period additional extensions of ninety
days each may be granted by the building official for Sood cause
ShOwn. upon expiration of the permit O~ any extension thereof the
sign shall be removed by the applicant.
(5) Off-site advertising by art organizations.
Nooprofit organizations having tax ex~t status vhich are located
within the city and which have been established solely for the
purpose of supporting the performing and cultural arts in the city
and other jurisdictions shall be permitted to utilize ~lle for
off-site ~ra1s ~hich may i~cotporate wording to name. desisnate~
or ide::ltify the organization and/or t.he arts. The application
shall be made jointly by t.he nonprofit organization and the

however ... nothing shall prevent an agree:nent that tbe nonprofit
organization shall pay for and remove the muraL

(H) MUrals which are erected on city property
or with city moneys s'ha11 be regulated solely by tbe provisions of
Section 16.20.100 and Chapter 2.26.

(C) Merchandise on display. which does not
constitute a sign (as defined: in Section 16.20.010). shall be
exempt from the window cove-rage limitation of this section.
SECTION 3... The application fee for an encroachment permit
issued pursuant to Section 16.20.160 {a) (6) of the Palo Alto
MUnicipal Code shall be $300.00. increased annually by the in~rease
in the consumer Price Index for the San Franeiecv-Oakland-San ~ose
Met.ropolitan area for all Urban Consumers. The MUnicipal Fee
SChedule is hereby amended to provide for such fee.

9. Revenue Pass-Through.
a. PUrsuanI: 10 t11e Advertising Agreemen~ Contractor ru.s agreed to
pay sccro eighteen percent (I 8%) of cum-.J!ative net revenues (as defined in the
Advertis:ng Agreement} produced by ad\;erusing shelters in tlte Program,. -s: .... l:je'\..."'! 1(1 a

10 hereinafter as the "Shared AdvettiS=LT1g Revenue .... ) The AdvertisIng Agreement
