EXECIITIVE SUMMARY
The applicant applied for • ConditiooBI Use Permit 00 May 9, 199, to allow a 4,400 square
foot bank "" It.e flat, 2Q,OOO+ square foot site at the corner of Arboretum and Quarry Roads.
The applicamt submitted. concurrent ARB ap;>licatioo.
Both the ARB and the Zoning Administrator's approval were appealed. The substantive
issues in the appeal relate 10 the ... n approval and are addressed in CMR:412 :95, which
was included in the SepIAmlber IB, 1995 City Council packet and is .nached 10 this report
as Attachment I(d). The City CmmciI continued action on the ARB appeal until October 16.
1995, so that both appeals could be ".osidered IDgeilier.
The appellant appealed the Use Permit approval, based 011 the fact thal the Use Permit was
001 conditiooaJly linked 10 the ARB approval and that he had no( been properly notifie<l of
the ARB dedsion. The Palo Aho Municipal Code (P AMC) does no! require Use Permit

The Planning Coounissioo beard the appeal of this item on September 27,1995. Meeting
minutes are included in the City Council packet of October 12, 1995, for Cky Council
inlllrmation. The appellant had requested. eoolinWlnC<: of the item because he had 10 be oot
ofloWn 00 September 27, 1995. The Plartning Commission decided 10 consider the item in
the appellant's absen<;e, because he had submitted a very detailed <ppeolletter that clearly
presented his conceros. In addition, the appellant ,,'ould have the opportunil)' 10 speak to the

project sire plan, !O aocommodatc future City Cooncil approved improvements along Quarry
Road.

BACKGROUND
The aWlicanl applied for a Coo<fttiooaJ Use Permi! (CUP) on May 9, 1995 10 aDow •
4,400 square foot bank on the fIal, 10,000 square foot !Ortner gas station site located at the
corner of Arboretum and Quarry Roads (see Attachmem I, Letter 0( App!lcation).
The aWlicanl submitted au Archite<:tural Review Board (ARB) application coocurreotly
with the CUP application. The ARB approval has also beeo appealed and was scheduled
for consideration by City Council co September 18, 1995.

ARB Approval:
The ARB recommended approval 0( !he site design and architecture of the project on
July 20, 1995 and the Director of Planning and Community Envlroomenl signed the ARB
approval on July 25, 1995.
Appeal of Zoning Administrator and ARB Approvals:
Both the Zoning Administrator approval and !he ARB approval were appealed 00
August 4, 1995 (see Attachment 3, appeal kller from Herb Borock, dated 814195). The
majorily 0( !he coocems rajsed in the appealletler rel.1e 10 design issues and the ARB
approval. The staff re8JlOIlSe 10 the ARB relaled issues is included in the attached City
Manager', R.eport (see Attachment <4, CMR:412:9S, daled 9iI8l9S}.
The appellant does not Fa ise roncerns about the proposed use 0( the site as a financial
institution. He does lake issoe with the fact wt the approval of !he Use Permit was not
~tiooaIly linked 10 !be ARB approval o(!he project and. Wt because .it was not linked,
be was required 10 pay two appeal fees. He also raises conrerns about bow he was notified
of project approval (see pages 8-100( Attachment 3). These concerns are discussed in
detail in the Issuesi Analysis section 0( this report-
Process for Appeal Hearings:
Chapter 16.48, ArchileCtllral Review, of the Palo Alto Municipal Code (fAMe) requires
ARB appeals 10 be wosidered by Ibe Cily Cooncil within 31 working days 0( !he appeal
date. Sections 18.92.040 and 060 Ibe PAMC require appeals 0( Zouing Administrator
decisions 10 be beard by !he Planning Commission within three mootbs 0( the date of the
appeal and by !he Cily Cooncil within 30 days 0( the dale <Jf!he Planning Commission
action.
The ARB appeal of this item is scheduled for the September 18, 1995 Cily Council
meeting. SI3ff has recommended continuance 0( !he ARB appeal until the Planning
Commission can review !he appeal of !he Zoning Administrator's decision and both
appeals can be beard simoJuneously by !he CiIy Council. k is possible, bowever, that !he
City Council will cboose 10 take action on the ARB appeal at the September 1B, 1995
meeting. The appeal o(!he Zoning Administrator'. decision is 1e000tlvely scheduled for the
October 16, 1995 Cily Council meeting.

The substantive issues the appeDant raises are in relation 10 the site design and public
improvements. Staff response 10 these issues is addressed in the attached CMR (see
Attachment 4, dated September 18, 1m).
The appellanl does stale that because the Use Permit approval was no< cooditionany !inl<ed
10 ARB approval, be was obliged 10 pay two appea1 fees and !hat the two fees are onerous
10 him. Section 18.90,060 of the Palo Alto Ml1nicipal Code {p AMe) authorizes the Zoning
AdJIlinistrator,1o approve Conditional Use Permits if specific flndings can be made. The
Code docs not require Use Permit approvals 10 be conditionally linked 10 ARB or any other
cIiscreIiooaIy opprovals. In this particuJar case, the Use Pennit findings reference the ARB
decision regarding landscaping and conditionally links the Use Permit approval 10 the
project plans dated May S, 1m, which are the plans approved by the ARB. The use of
this site for financial purposes was found 10 be appropriate, and was correctly linked 10
specific plans, If other discretionary aclions change the approved plans substantially. an
amendment 10 the Use Permit would be reqcued.
The appellanl also raises questions about the notification process for !be z"ning
Administrator and ARB dec isioos. The appeIlant requested and received a copy of the
Zoning Administrator's decision. There is no recool of his requesting a copy of the ARB
approval. ARB approvals are not automaticaIly maIled 10 speakers at ARB hearings. A
special request must be made 10 receive a copy of the decision. In !be absence of such •
request, notification of the ARB decision was DOl mailed 10 the appellant.

Managemenl Company has provided prefIminary copies of the revised strett improvemeIll
plan for Coone\! review in relation \() the subject .wlicatioa (see Atta<:hment f). The
revised plan shows five·feet of rigbt-of· .. 'ay that would be available immediately for use
as sidewall< along the Quarry Road frontage of this site. plus five feet of additional right
of·way 10 be made available at the time street improvements are implemented. Four and
one-balf feet of the new right-of-way would be used for Iree planting and one·half a i0oi
woold accommodate the new curb.
Until the Master Plan is approved and the street improvemenls are implemenled, staff
recommended. and \he ARB approved, an iI'.teri.m solution for providing tree canopy along
the site', Quarry Road frootage. Five feet of right-of·way that currently edsts will
become sidewalk; and frve oak trees, consistent ... ith «isting street tree> in the area, ",ill

will provide canopy over the sidewalk, until street trees are planted in what will become

spaces) results in some awkward maneuv.ring in and out of some parking stalls.
Specifically. the two eastern-lIKJSI stalls and the two western-lIKJSI stans are easy 10 enter,
but drivers would bav. 10 back out across a large portion 0( Ihe parking lot \0 exit the sile.
The two stans adjacent to the rigru side of the driv .... ay, when emoring the sit., ace

Transportation Division considers the circulation adequate and sare.
The preliminary praposaI for tllis project used the same builJing and s'te configuration,
but had a different parking layout which also had some difficult spaces to .ccess. After
preliminary review .. iLl, the ARB, the .pplicant revised the parking lot eesign .nd
relocated the vehicle enttance off Quarry Road, so tlJat it would be furlber away frO!Tl the
corner. The redesign improved the fuoctionality of the parking lot and decreased the
awkwardness of same of the movements, but aid DOl. completely eliminate al1 difficulties.
Siting the building at a diagonal and providing all required parking on-site will result in
unusual circulation ro matter which parldng lot design is usea.
When reviewing a deve!opmeOl proposal, iI: is important 10 consider an of the architectural
