SUBJECT: Ordinance Reaffirming E;jsting Posted Speed Limits
REOUEST
The purpose 0{ this report is to request Q)uucil 10 re affIrlll the current posted speed limit
on 17 street segments in Palo Ah(}. Based 00 the "engineering and traffie~ survey results,
00 increase in posted limits is required or requested. This report is unrela\e<llo the staff
recommendation 10 post radar enforceable speed limits OIl streets soch as M>ddlefield,
Embarcadero, and Cbarleston Roads, fOf a trial period 0{ three months. This issue is
tentatively scheduled for Omoci! discussion sometime in November 1995.
RECOMMENDATIONS
Staffrecommends that Counc~ adop( tI,e attached ordinance (Attachment)) establishing
speed limits on 17 street segments based upon "engineering and traffie~ survey reSlll!s.
whicb will allow the Police Department 10 continue using radar fOf speed euforcement on
those street segments_
PO!.lC¥ IMP!.ICAIIONS
The actions recommended in ibis report are consistent with Council's past actions
regarding reaflinning current posted speed limits, and Council's pas! explicit direction not
10 raise speed limits.
EXECIITIVE SUMMARY
The California Vehicle Code (evC) requires updal,rlg the "engineering and traffie~
surveys evel)' five years. in order 10 ro~valua!e whether or not the Police Department can
lise radar fer speed euforcement. Exempt from this requirement are the 25 mph school
zone speed limits, when children are present, for which the Police Department can use
radar without speed surveys and C<luncil action. The three elements 0{ "engineering and
tr.ffic~ surveys as defined in eve Section 627 are, (I) speed surveys, (2) road

conditions, and (3) accident records. The speed surve),s pro~ the basis foc de:enni.'ling
the 85th percen~ speed (critical speed); tJ-ois is 111. speed at or below which 85 percent
of the traffic is moving,
The speeds are noonalIy established al the first five mile per hour increment below the
85th percentile speed. This allows the majority of drivers to travel al a reasonable speed,
buI pro,ides a means fur enforcement officers to control the upper group of drivers woo
may be reckless or travel at excessive speeds.
However, in matching existing conditions with the traffic safety needs of community,
policies and procedures contained in the Caltrans traffic manual pennit consideration of
a further reduction in the speed limit of five miles per boor. The factocs justifying such'
a further reductioo include a high number of ae<:idents (based upon two years of rewrds)
2l1d roadway conditions such as inadequate stopping distance, C"'-"lIllercia! driveway
characteristics. super-elevation. shoulder c~tions, roadway design speed. and
pedestrians 00 roadways without sidewalks.
For 11 street segments (Attachment 2), the previous "engineering and traffic" surveys
~e conducted in September 1990 and expired on September 24,1995, New surveys
have been COIIIjJ!eted for those street segments, and the results are shown in Attachment
3, As summarized below and tabulated in L!,e SU/llIllaI)' of "Engineering and Traffic"
