Tne firs; reading of the Sewer Use Ordinance was completed on November 21, 1994.
Council deferred adoption of one provision (a rank/valve requirement for new laboratClries}
f\ll' a period of up 10 three months 10 a\low for further consideration. The ordinance has
been revised to delete the provision.
On November 29,1994, staff was advised that representatives of CLEAN South Bay may
speak at the Council Meeting on December 5, 1994, to state their concerns \\'ith the
Clrdina.'lce. Three letters from CLEAN are attached giving the details of their concerns. In
summary. they do not beheve thaI the Palo Allo Ordinance requirements for Metal Finishing
Faciiities are stringent enough, CLE.4J.'l representatives requested that their letters (attacbed)
be made a part of the Council packet.
SlafT is cO::1ducting negotiations; with CLEPu"J a5 !i.pecificd in the Palo Aho/CLEAN
Agreement signed in Februar}' 1993. Staff is exploring ways of addressing the CLEAN

bett~r results. It is reasonable because it saves industry money over time and
redu.ces the severity of ongoing toxies violations. HowE'ver, lack of fir-meal
assistance shall not be a reason for failure to achieve maxlmwn reductions
that pay back in 5 years, and will net eXCU5e ylolations.

themselves or by interaction with other substances may create fire
or explosion hazards, including wastestreams with a cloeed 'cup

shall be discharged. Flarrrnable substances including. but not
limited to, ac~tone, alcohols, benzene, gasoline, xylene, hexane

addition, lhe discharge of petroleum oil, nonbiodegxadable cutting
oil, or products of mineral origin in amoU.nts that cause interfer
ence or pass through, as defined by EPA regulations, shall be
prohibited.
(9) Haz.ardous, Noxious or Malodorous Substances. No
iudustrial waste shall be discharged which alone or in combination
~ith other wastes may crea~e a public nuisance, hazard, make human
~utry into the sewers unsafe, or which conscitutes a discharge of
ha2'.ardous substances as defined by Title 17 of this code; Title
22, part II of the California Code of Regulations; or statutes of
the United States government.
Permitted dischargers shall be required to certify at least
every six months, in their semiannual compliance report, that their
.... aste does not constitute a hazardous · .... aste, as defined by EPJt
rEgulations, and that during the previous six months no discharge
of ha2ardous substances or waste has occurred. Dischargers shall
be required (as a condition to permdssio~ to discharge) to file
