The Condition and Monitoring Report evaluates the YMCA's compliance with conditions
stipulated in !he C'<lnditional Use Permit 9O'UP-38 relating 10 traffic, parking and safety,
noiY., aesthetics and landscaping, construction, grading and drainage, and other issues
affecting Ihe cmrent remodel and expansion as wen as the oogoing operation of the existing
YMCA facility. The remodel and expansion oflhe existing YMCA facility was evaluated in
previous staffrepons (CMR;489:91, CMR:528:91 and CMR.:363:93).
}]SCAL IMPACT
The cost of preparing the annual Condition Monitoring Report is required 10 be paid fOC
entirely by !he project sponsor (YMCA) as I condition of the original project approval
(Condition 13). Subsequent reports are required 10 be prepared each year lOr at least three
consecutive years. The project spor,sor is required 10 fund each of these subsequent reports.
Therefore, the project creates no fiscal impact OIl the City.
ENVIRONMENTAL A5-<w!SMENT
A draft Enviroomental Impact Report (EJR) "'as prepared lOr the original remodel and
expansioo project in July of 1991 and a Final ErR in October of 1991 prior 10 certification
by the City Cooncil 00 November 25, 1991. The Condition Monitoring Report was I
condition of!he original project approval and is therefore ccvered uncler CEQA by the EIR
prepared in 1991.

The YMCA on Ross Road was constructed in 1956 and bas been in continual operation ,!!lee
!ben. With gro<ving attecdance and e!>anging re<:reationa1 need< of its members, the YMCA
embarked llpon an expansion of the existing, outdated facility by Cd ing an application fOr the
remodefmg project on October 30, 1990. The remodel and expa".sion project was reviewed by
the City from 1991 tlJrooglt i993 culminating in fInal ARB approval 00 May 6, 1993. Building
permits 0( tile construction projOCl were issued by the City on July 30, 1994. The current
constructioD project began in July of 1994. Co!lStruction was projected 10 be complete by April
of 1995. In fact, much of the interior construction related 10 the main buucfmg ;. largely
complete. HQ,,'ever, the unprecedented number of consecutive rainy days during the past wintel
season bas postponed completion of the project, espeei3J]y the parlting lot and outdoor
improvements, as weO as the natatorium (swimming pool building) ....... of stafj"'. inspection on
_t,pril 1, 1995, tlle parking lot was mostly completed but some additional wock remained.
Weatber permitting, the YMCA expects 10 eomplele the parlting lot. the exiting driveways.
landscaping and related outdoor improvements, as wen as the natatorium during the month of
May, 1995.

The attached Monitoring Report incfICates that an coooruons are being met 3CroI"ding 10 me
critelia establisbed in the Coodition and M"ltigation MOnito<ing Program For Use Permit 9O-UP-
53. as adopted by the City Council on November 25, 1991 (see Exhibit A, attacbed 10 the
Mooiulrlng Report).
OveraO, ,taff finds that the YMCA bas made a good faith effort 10 comply with each of the 54 .
renditions required by tile Cily. Staff bas received several complaints from a ,maO number 0(
residents in the area regarcfmg !be YMCA·, eompliaoc" with some 0( tlle CCIlditions. These
complaints focused on parking and landscaping. The number and type of complaints is no(
ncusual fOr a OOIIStruction project of this ,lz.e and duration in a residential neighborbood. Eac"
complaint was recorded by YMCA ,taff and is documented in the attacbed YMCA Log of
Neighborbood Communications (see Exbibit B attached 10 !be Monitoring Report). The YMCA',
efforts 10 meet !be 54 concfttions, respond 10 neigbbors· complaints, and report progress 10 tlle

inoperable. A> of .-\pcB 7, 1995, Ihe "" ... parking lot was paved and striped and was being used
by YMCA patrons for parking. Weather permitting, Ibe YMCA expects \0 oomplete the parking
Joe in May of 1995.
Prior \0 the paving and striping 0( Ibe DeW parking lot in early Ap<il, 1995, YMCA staff
documented lheir effuns \0 ret!uce YMCA parking on City streets. Mr _ Dan Logan, Ihe
Executive DireckJr (}{ the YMCA. bas conducted an extensive carnpaig~ k> reduce oc-stree[
parking by YMCA patroos incloomg personally Qlfecting in""ming trame, adding temporary
sisnage, cr...,.ibuting 600 fliers \0 patrons, and adalllg 25 temporary spaces oo-,!te. On Saturday,
Februa.~ 4, YMCA staff speD! an estimated 28 person hours arrected exclusively to reducing
the on-stree' parking problellL The fun exteD! 0( the YMCA's effuns is documented in the
_ttached memo from Dan Logan \0 Ricl! Cabrera (see Memo dated February S, 1995>-Now that
Ibe~. Jot is mostly coinplete and usable, Ibe interim parking issue has been resolved.

On Mal j, 22. 1994. YMCA and City .taff held a meeting with two of the oeighbors who have
COinpli jied about interim parking problem<. Based on this meetL"g, City staff agreed \0 have

0( Ibe parking lot. On Ap<il 7, 1995, Ibe City", Code Enfoo:ement <Y.ficer verifted that Ibe
drive .... y stop signs and Ibe "No Parking" signs have been ins!alled. The Deed for inst.tIling and
maIntainjng the red curbs. in additioll 10 the "'No Parking"' signs. is currently being evaluated
by City staff. Completion of these efforts will fulfill Condition 3.6 of Ibe Condition and
Mitigation Monltoring Progrsm which probibill; parking within 60 feet on eilber side of eacI!.

responded with the attached four letters to address !heir concerns.
ALTERNATIVES
The Planning Commission has !We alternafives to staff', recommendations. The Commission
may choose to 00( accept llIe Condition Monitoring Report and, instead, 10 request additiooal
information. Also. !he Commission may cboose to 00( refer sub<equeO! Monitoring Reports 10
the Zoning Administrator and, instead, to conduct >OO!her public bearing on the annual
Monitoring Report one year bence. Because ofllle YMCA', good faith effort at compflallC<',
slaff recommends that !be Commission reject bod! or Iheoe alternafiv ...
FISCAL IMPACT
The cost of preparing Ihe anrual Condition Monitoring Report is required 10 be pald fo< enfirely

In lIle meantime, YMCA staff has documented their efforts 10 reduce YMCA parking
on Cily streets. Mr. Dan Logan. the Executive Director <X the YMCA. has
conducted an extensive campaigll to reduce on-street parking by YMCA patrons
includIng penonally d"'ectiog in-coming b..tflC, adding temporary 'ignage,
,fIstributing 600 fliers 10 patrons, and adding 2S temporary spaces on-site. On

parking spaces on the east side 0( the site into Imlscape reserve so the two
trees in poteDIial jeop:Irdy would not be harmed. Since that time, Ricb Cabrera,
Code Enforcement Officer, bas visited the site many times 10 ensure that: 1) the
three parking spaces were put into landscape reserve; 2) the curbs foe the
parking areas were ~ly located; 3) the p!:<Jpe1" d"\Stance was maintained _
between the parking area and pr<Jpe1"ty line foe a landscape buffer; and 4) that

these issues on November 14, 1994, and during that conversation asked that the
portion 0( Ross Road fronting the YMCA he made a no parking zone, and thaI
the use pernllt he brought back 10 the Zoning Administrator for review and
possible revocation. In response to your inquiries about a no parking zone, I
bave initiated dis<:uSsion with the Transportation D,,·ision and the Department
0( Public Works 10 investigate Ihc possibilities ot such an action. It may he
difficult to prohibit parking on • limited section 0( • public street since the Joss
of on-street parking could negatively impact residents and !be public in general,
and nor ju..<t limit the YMCA', ability to park on !he streel I will research this
matter further.
Regard"tn,g revocation 0( the use permit. Palo Alto has long ~ated with !he
poticy that revocation 0( • use permit is the last possible resort in an
enforcement action. The only recent us" permit revocation that the City has
ondertaken required documentation ot significant threalS 10 life and safety. It
would he unusual to find that !he standard construction occurring at the YMCA
is • significant Ihreat to life and safety. City s!aff has pursued complaints
regarding the YMCA and has enforced the conditions 0( approval 10 !he Jrigbest
degree possible given our staffing !evels. I woold nor initiate a revocation
bearing unless presented with strong evidence by code enfO£cement personnel 0(
!he n.eed to do so. I have received no indication from these sources that the
si!lJat:ion has deteriorated to • !evel requiring such • hearing. We v.ilI continue

city staff have laken over the last month 10 respond 10 coocerns you have raioe<!

I me! with you, Peter F<lx of V>nee Brown and Sons, and members of the
Plahning Division staff on October B, 1994 10 discus. tree prO!eCtion during
coosttuction. It was <k<:idecI at that meeting 10 put three additional parl6ng
spaces on the east side ot the site into landscape reserve so the two trees in
· poten6aI jeopardy would !l()( be harmed. Since that time, Rkh Cabrera, Code
Enfoccement Officer, has visited the site many rimes to ensure that: I) the three
parking spaces were put into landscape reserve; 2} the curbs for the parking
areas were properly located; 3) the proper distance was maintainro between the
parking area and property line for • landscape buffer; and 4) that mounds of
excavated material were rovered. Rich has been. and will CODJinue 10 be,
· diligent in his enfoccement of conditions of project apprQV!il.
I have also coordinated with U Jon Hernandez ot the PO&e Department
reganling several issues )00r neighbor, Ms. Carol Thompson. bas raised.
I UIIderstand that this is a difficult situation for some of the neighbors of the
YMCA. City staff is wocking with the YMCA aM its contracton 10 the
greatest exlent possible 10 respond 10 complaints about the project.
