EXPCU1TVESUNUdARY The Regional Water Quality Control Plmt (RWQCP) has been required by the San Francisco Bay Regional Water Control Board (Regional Board) to prepare new requirements for industrial and commercial discharges to the R W QCP. The Cease and Desist Order (dated July 21, 199J) issued by the RegIOnal Board required adoption of th.,., requirements by September 30, 1994. The first reading of the proposed requirements oo::Ufred 00. August 4, 1994. CITY RESPONSE: Many of the OL"din!.l"lce requirements are very low cost items and should be cOJIIplied with if re.placinq the associated item. An example is a lip around a lab sink to prevent spills of full strenqth ch~mical into the sink. When replacing a counter top and sirJ::, a sink with a lip should be installed at thi!lt time. Overall project cost is not tbe key criteria, but rather the particular remodelling work being done. The Cease and Desist. Order was issued because the RW:;ooCP di scharge does not meet all of the limits imposed en it for discharge to San Francisco Bay. A february 1993 agreeroent between t.he-City and CLEAN South Bay was incorporated into the Ceas.e. and rre:Si5t. (I!'<i<er and also requires' the adoption cf new requirement~ for industrial and commercial discharges. The current Qrdinance broadly proh;bit~ concaminated storm water from emtering the storm drain system, but lacKs certain practical details necessary for clarity and enforceability. Another set of proposed reVlSJ.ons would add Administrative Penalty provisions made available by relatively recent changes to State law. The final set of pr.oposed changes includes miscellaneous requirements targeted to reduce copper and other pollutants. These areas of emphasis are discUssed in greater detail below. Other facilities. The second is a limit on the annual mass discharge. The copper limit for the identified small commercial facilities i!l being left unchanged, because cost effective methods of meeting more stringent ll.rnits have not been identified. Th~ focus for these facilities will be on -imple.menting beilt 'C'IAnagement practices l-ather t.han on new quantitative effluent limits. For all other industrial facilities, a new, lower concentration limit is proposed with a sufficiently long compliance schedule to allo ..... time to achieve reductions in copp~r corrosioTi and othel' non-traditional copper sources. Five meetings with industrial dischargers were held to solicit comments on the proposed local limits. Many comments focused on the pollution prevention revie.ws that the RWQCP conducted at six me:tCl.l finishing facilities, to help determine ho'",-much pollutant CMR:40S :94 -2- lOol.dings can be lowered in a cost effective manner. Industrial repre.sentatives -.... er-e not confident that the identified reductions could be fully achieved or that the costs and benefits identified in t.he st.udies would prove to be accurate. Admjnistrat~ve Pen21tles The proposed ordinance incorporates a relatively new State law that provides authority for the City to assess monetary penal ties administratively (without court order) in response to ordinance violations. This authority is limited to $5,000 per day of \~iolation and $10 per galIen of discharge. The individual charged has the right to a hearing conducted by staff and the ability to appeal the outcom.e to Council. Council may decide to hear the appeal or deny it. Staff does not" envision using this a"i.lthority for all violations, but rather for" intentional, repeat, or egregious violations.
