EXECUTIVE SUMMARY .
The Transit District's propose{! bus shelter advertising program would replace the existing
non·ad .... ertising bus shelters with completely new shelters provided hy an independent
advertising company, Patrick Media. All of th.e new shelters would be lighted and meet
Americar.s with Disabilities Act (ADA) siandarcfs.. Seventy-five perccnl of the sh.elters
would contain two-sided, back-lit 4 fool by 6 foot advertising panels; the remaining 25
percent would be advertising fret' .. Maintenance would be upgraded to weekly cleaning
and grdffiti abatement within 48 hours. The pl.n will only be pursued when six key
cities approve the program. To dale only three cities (Mountain View, Milpitas and
Sunnyvale) have approved the program; Santa Clara, Sari Jose and Palo Alto have yet Lo
tue.a position on the program.
If Palo Alto were to receive a pro r(lta share of advertising shdiers during the two years

Staff has concllJd~d that tht proposed adverti~;,ing program is irll:onsislenl v,ith the City's
urban design objectives. would creaie, visual clulttrlbJight along publ ic thoroughfares, and
conflict with City policies to prohibit hillbClards and off-premise advertising. Because the
District is required to comply with local ordinances, tht: program could not be
implemented without an amendment 10 the City's sign ordinance. Furthermore, .s.taff
believes the District has a commitment to maintain and expnnd bus stop amenities, which
encourage and butld ridership and help the County achieve air quality standards and
congestion management plan objectives. For these reasons, staff recommends that the
Council not support the proposed bus shelter advertising pmgrarn.
As alternatives 10 the recommended C0urse· of action, Council could cons.ider the
following alternatives: (l) approval of the program with conditions to addre.';s local
concerns; and (2} rejectKHl of the program and continued discussion with District staff on
bus shelter maintenance and funding allernatives, including having the City assume
responsibiiity for the bus shelters in Palo Alta; or (J) rejenion of the. program with the
undersTanding that bus shelters in Palo Alto might b(.': rCnlov<?d, if the: District cannot
identify resources t(1 fund continued b1J~ sheller mainlcnancr;!, or (4) rejection of the
program and consideration of a City-run bllS shelter advertising prcgram,

There would be no tiscal impact on the City if the staff recommendation is accepted and
the District continues the current bus shelter program. The fisc-a1 impact of the
alternative Council responses to this plan range from potential addition31 revenues, if the

on a revenue .haring plan (Alternative #1), (0 $),000-$10,000 in new coSls for Palo Alto

districts (with limited exceptions).

business.. This s~(.;tioll prohibits off-site signs and (.Jutdllor bilJboard:-; and lhllS
preempts the state billboard laws of the Outdoo~ Adv.::rtising Act.

. , 'The City Attorney has determined that th.e District is a "local agency" and. therefore, not
exempt from applicable City ortlinances. The pending merger 1)[ the Transit District and
Congestion Management Agency would not change the District's relationship ar.d ,""tatus
relative to City ordinances. jf the City were 10 agree to the bus shelter advenising
program. either {a) an amendment to the pertinent sections of the: sign ordinance would
be required to expressly pc-nnit such off-premise advertising, or (b) the District wouid
need to apply for a waiver to the provisions of the sign ordinance. The lauer process
requires review by the Architectural Review Board and approval hy the Dlreclor of
Planning and Community Environment or City Council with fmdings similar 1.0 those
required. for a variance.. TIle City AHomcy has detennined that these fmdin.gs are not

most passersby" Consequently. more shellers maybe proposed for El Camino Real, Page
Mill Road. etc. However, until the six key cities agree to the program, the District and

On June 29, 199:3-;:1 Request for Pioposals was approved by the Transii District Soard
Supervisors arid iSSU90. Two propo.!ia!~ were received. These proposals were then evalJJated,
in November of 1993 by a (our member independent panef with professional backgrounds in
advero.s\ng, shette( programs, transit management. property manage.ment and. maintenance
and construction. E.ach firm was also inteNiewed by the panel. In aCC(lrdance ...... $ the RFP
proce$$, the panel selected Palri'" Media Group, Inc. (Pac;clI) as the number one ranked firm.
