Adoption of the new requirements must occur by Septerr~er 30, 1994 as specified in r,he July' 21., 1993 Cease and Desist Order issued by the Regional Board. The Cease and Desist Order was issued because the RI':QCP discharge does not meet all of the limits imposed on it for discharge to San Franci"sco Bay. A February 1993 agreement bet'""een the City and CLEAN South Bay was incorporated into t.he Cease and Desist Order and also requires the adoption of new requirements for industrial and commercial discharges. These r.equirements are called "l-ocal Limits" by the State and Federal regulatory agencies. Discpssion To prevent the initiation of r.m] tiple ordinance revision processes~ a nuffi0er of other changes are being proposed at this time. One set CMR ;405: 94 -1 - o of proposed revisions w01Jld add clarity to the storm drain (as contrasted to the sanitary sewer) pollution preyention requirements of the ordinance. The current ordinance broadly prohibitQ contaminated storm water from entering the storm drain system, but lacks certain practical details necessary for clarity and enforceability. Another set. of proposed rev-isions would add Administrative penalty provisions madE! available by relatively recent changes to State law, The final set of proposed changes includes miscellaneous requirements targeted to reduce copper and other pollutants. These areas of emphasis are discussed in greater detail below. Local Ljmits The pi'oposed Local Limits focus on copper requirements for three types .of industrial and commercial facilities: 1. Metal fj nishing facilities (electroplating and printed circuit board product ion) ; 2. Small commercial facilities using metals (vehicle service. photoprocessing. metal fabrication, macbine shops); and 3. Other facilities. The copper limits for metal finishing facilities allow for two methods of compliance. The first is a cQmbin3.tion of concentration limits and mandated .pollution prevention practices. The second is a limit on the annual mass discharge. The copper limit for the identified small commercial facilities is being left unchan~ed. because cost. effective" methods of meeting more stringent limits have not been identified. The focus for these facilities will be on implement.ing best management practices rather than on new quantitative effluent limits. For all other industrial facilities. a ne ... " lower concent"ration limit is proposed with a sufficiently long cornplianc.fl schedule tq allow t.ime to achieve reductions in copper corrosion and other non-t.l-aditional copper sources. Five meetings with industrial dischargers were held to solicit comments on the propos~d local limits. Many comments focused on thE"'. pollution prevention reviews that the RWQCP conducted at six metal finishing facilities. to help dete~~ine how much pollutant -2- ,1" ... ': v loadings can be lowered in a cost effective manner. Industrial representatives were not cQnfident that the identified reductions could be fully achieved or that the costs and benefits identified in the studies would prove to be accurate. The proposed ordinance allows time fer compliance (until July 1, 1996) and allows two different methods of compliance to address this concern. Industria.l representatives were also concerned about the use of average limits because they require more sampling and expense than needed to determine compliance with ma;dIJH~m limits, One of the average limits originally proposed has been deleted in response to this concern. The remaining average limit is-optional; a second approach not involving the average concentration may be used. 8tormwatt: .... Ppllut'ion preYfmt jon The proposed ordinclnce revisions include requirements for nel ... ly constructed facilities to ensure that equipment washing areas, fueling areas, loading docks, and similar areas are isola_ted from the storm drain system. with respect to existing facilities. dischat·ges that must not be made to the storm water syscem are further clarified. Discharges fl.·om construction activities. swimming pools, cooling systems, and equipment cleaning are key examples of discharges not permitted to go to storm drains . . Threatened, as ,~'ell as actual~ discharges would constitute violatil)ns of the ordinalLce. Threater.ed discharges are releases that have not reached the storm drain system yet, but will when ra.infall occurs. Admipistratiye penalties The proposed ordinance incorporates a relatively new State law that provides authority for the City to assess monetary penalties administratively (without court order) in response to ordinance violacions. This authority is limited to $5,000 per day of violation and $10 per gallon of discharge. The individual charged has the right to a hearing conducted by staff and the ability to appeal the out.come to Council. Council may decide to hear· the appeal or deny it. Staff does not envision using this authority for all violations, but rather for intentional, repeat, or egregious violations. -3- o MiscellaneOllS Requirements to Reduce pjscbarges of CoJ;lper and 0tber Pol lilt ant 9 Proposed requirements for new construction include the prohibition of floor drains in certain areas, certain aspirators that mix pollutants with the wastewater to be discharged, and zinc anodes that are used for corrosion protection. Other corrosion protection c:ee,SlJres that do not contribute pollutants of concern can be substituted fer these "sacrificial" zinc onodeB. New laboratories would. be required to have lips on sinks and holding tanks to prevent and contai,n spills that would otherwise go to the RWQCP. 1\11 facilities would have to cease using copper. tributyl tin. ch.romiu;n~ and silver compo"Jnds in cooling systems, pools, spas, and fountains. Machine shops would be required to adhere to :r.equirements pi'evio\lsly published by the RWQCP as best mE\nagement practices. The miscellaneous requirements fOl' existing facilities are expected to have a very sl'nall impact on most facilities because almost all have already complied. ~ 00 lndqstria) Facil..it..i.es The voOst i;mnediate impact of the pre-posed ordinance will be on the approximately 15 metal finishing facilities in East Palo Alto, Mountain View, and Palo Alto. These facilit.:.ies must reduce copper discharges by an average of ~o pOl·cent. Studies completed by consultilnts for the RWQCP '::cund that water savings and ethel' benefits of the pollution prevention efforts will l:esult in the investt11.ent made for the equipro.ent necessary to comply paying for itself within five >~ea.r6. Industrial representatives question the results of the.studies and the use of a five-year payback criteria. In respon·se to these ':onceros, staff is developing proposals for positive financial incentive programs that Council will be asked to consider in the near future. Such programs c01..lld reduce financial impact.s on these facilities, but could require t.he provision of subsidies funded by the RWQCP budget, depending on progroelm design. Impacts of the proposed ordinance on other facilities are not anticipated to be large. The combination of the new facility requirements and the constn.u;tion practices requirements are anticipated to be an extreme,ly small percentage of total facil ity construction. -4 - • ) !:"\ 'IV Staff is sending the proposed ordinance to affected parties and will receive comments through September 8. 1994. The overall goal of this Chapter and the City'S water quality control program is to prevent and control pollution and protect and foster human health and the envi:ronment. It is the intent of the City to update and modify this Chapter as needed to continue to provide a program for pretreatment of indu8trial wastes whiCh is approved by federal and state regulatory agencies. Therefore this Chapter is designed to be no less stringent than the U. S. Bnvir.on.1iental protection Agency "General Pretreatment. Regulations for Existing and New Sources of. Pollution" published at Title 40 of the Code of Federal Regulations, Part 403. as applicable, and as such regulations may be amended from time to time (hereinaftsr the ·Pretreatment Regulations'" . SECTION 2. Section 16.09.010 of the Palo Alto MuniCipal Code is hereby amended to read as follows: l'~09.OlO Definitions. The following words and phrases. whenever used in this chapter, shall be as defined herein. Words, terms and phrases, used in this Chapter not otherwise defined shall be as defined or interpreted or used in the Pretreatment Regulations. Terminology for analyt.ical testing shall be that contained in "Guidelines Establishing Teat P.l·ocedures for the Analysis of Pollutants,: published at Title 40 CFR, Part 136. (14) "Grease n means, and includes, fats. oils, waxes or other related constituents. Grease may be of vegetable or animal origin I including butter, lard, margarine, vegetable fats and oils, and fats in meats, cereal;:!, seeds, nuts and certain fruits. Grease may also be of mineral origin, including kerosene, lubricating oil, and road oil. Discharge of any explosive substance shall be unlawful. Flamnable sUbstances including, but not limited to, acetone, alcohols, benzene I gasoline, xylene. hexade and naphtha, shall not be discharged into t.he sewer system except where present in contaminated groundwater discharges being discharged under an exceptional waste permit issued by t.he city. Where groundwater discharges contain such contaminants, the discharger shall monitor the sewer atmosphere for exploBivity and flammability using a properly calibrated meter designed for the purpose. The frequency of auch monitoring shall be defined in the permit. Whenever a lower explosive level is threatened t.o be exceeded j the discharger shall immediately notify the superintendent of the potential hazard in the sewer within fifteen minutes of mak.ing the determination of threatened explosivity. The discharger shall follow verbal notification with a \'!:t::'itten explanation of the cause of the explosive hazard within five -working daY'~j with corrective actions taken to alleviate the situation and measures taken to prevent. a reoccurrence. The discharger shall not recommence .... ·ithout prior written approval of the superintendent or his designated represen­ tative. Where flaimnable substances are used in processes, separate collection and disposal outside the sewer system sh~ll be provided. (f) Grease and Oil. Gre:ase al/d/ot' oil shall not be discharged into the sewer system if the average concentration of floatable oil and/or grease (defined as that which is subject to gravity separation at. a temperature of twenty degrees CelsiuB and at a pH of 4.5) exceeds twenty mg/11ter; nor shall the total oil and/or grease concentration exceed two hundred mg/llter. 'In addition, the discharge of petroleum oil, nonbiodegradable cutting oil, or products of mineral origin in amounte that cause interfer· ence ()r pass throug.b, as defined by EPA regulations, shall be prohibited. {g} Hazardous, Noxious or Malodorous Substances. No industrial waste shall be discharged which along or in combination with other wastes may create a public nuisance, hazard, make human entry into the sewers abnormally hazardous, or which constitutes a discharge of hazardous substances as defined by Title 17 of this code; Title 22, Part II of the california Code of Regulations; or statutes of the United States government. Should any discharge of a hazardous waste occur, the discharger shall verbally not.ify the BPA, the Regional Nater Quality Control Board and the superintendent as soon as possible, but in no event later than 24 hours after such discharge. Appropriate records of hazardous waste disposal manifests, inventories of stored virgin and used ha2ardo\Js materials, and other documentation required by the HMMP shall be kept and made available for inspection and/or copying at the city's request. Mercaptans and dissolv-ed sulfides shall not be discharged in concentrations exceeding 0.1 mg/liter. (h) Qroanic SQlvents~ Except as permitted by other sections Of this Chapter, the sewer shall not be used as a means of disposal for organic solvents. Dischargers having organic solvents on site or using same shall provide and use a separate collection and disposal system outside the sewer system and shall provide safeguards aqainst their accidental discharge to the sewer. Approved solvent management o.nd a plan t.o prevent entry to a sanitary sewer accidental spill prevention plans shall be filed by the discharger as a condition ot permission to discharge to the sanitary sewer.
