This report requests that Council authDri~e the Mayor to execu~e
Amendment No. 1 to the consultant agreement with Forell/Elsesser
Engineers Inc. (Forell) I in thl;! amount of $93,860 for construction
administration services and A~endmeLt NO.2 with Quality Assurance
Engineering Inc. dba. Consolidated Engineering Laboratories
(Consolidated Engineering) in the amO'.mt. of $22,260 for testing and
special inspection services for building out the Civic Center
eighth floor and a portion of the mezzanine floor. ~unding is
available from the Civic: Cent.er Tower Build Out. CIP 20213.
Background
On March 23. 1992. Council approved the concept of build':;'ng out the
Civic Center to' accommodate the office space needs of the Utilities
Department personnel and, on September 14, 1992 (CMR:407:92),
approved an agreement with For-: 1 1 to design the improvement.s
(CMR:407:92j. That agreement also provided for the future
construction administration services which would be negotiated at
the completion of the design phase. Oa November 27, .1993, Council
awarded a contract to I.P.D. Builders Inc. for cGn5tr~c:ting the
improvements. Therefore, it is now appropriate to proceed lNi th
those previously contemplated constro .... ction administration sE:lvices.
Di-scussion
Amendment No.1 to the C'onsulta.nt agreement with Forell. provides
for the rendering of construction administration services. These
services are required by staff during the build out to assure that
the project is constructed according to the plans and
specification.s i;r:,. a safe and efficient manner. The following is a
summary of these services;

• Prepare changes ~o the d~awings and specifications.
Amendment No. :2 t.o the conswJ.tant agreement with Consolidated
Engine~ring provides for special inspection and testing services
during construction. The.se servir;€.s are required in order for the
City to co~ply l,t,'ith the provisions of the P.A. Municipal Code a!ld
the State of California Ur.iforrI1 Building Code. Council appro'"ed
the initial agreemel"_t \tiith Consolidated Engineering on ,July 26,
1993 (CMR:404:93). retaining their services for materials testing
and inspection on various capital improvement projects. S~rlices
to be rendered pursuant to A'Ttendment No. 2 will includ-e the
following:
• Inspect and test the re~nfarced concrete for minimum
compressive strength, slump and proper placement.
• Inspect structural steel beamQ, joists and hangers for pyoper
certification, size. pl.:.cement" welds and cOflnections into the
existing concrete masonr~ walls and floor slabs.
• I~spect all bolted fasteners into existing concrete walls and
C"olumr.s.
• Inspect placement ot the windo ..... glazing on eighth floor.
Staff requests the CO;.lncil~B authority to approve and issue change
orders not to eXCEed $18,800 under the a~reement with Fore11 and
not to exceed $5,500 under the agreement with Consolidated
Engineering. This represents 20 percent of ~he total financial
commitment under each of these amendment.s to agreements. This
contingenL-Y .... ill be used to defray the cost cf unanticipated
additional testing, inspection, a.nd design change services~ which
may be necessitated by construction work in a 2S year old building'.

Dear Pat:
This letter is in response to your request for an evaluation of the project contract and fees
allotted fOt' the remainder of the project. Havln.g recentiy compieted the Construction
Document phase of the project. we have identified some areCiS of the project wh1ch we feel
fa!1 under the category of Additional Services, and which warrant c":lnsidEration for
compensation. Furthermore, we have re-evaluatec the impact of these items on the
Construction Administration pnase of the project as well as clarification of the City'S expected
scope of services during Construction Administration, <:ind would appreciate your consideration
in a corresponding adjustment of the contract fee.
The following is ,a tist of the servIces which we-feel would be in addttion to the original
cormact scope, and ti-leir impact on the construction acmin]stration fee:
1. Additionaf site visits: The current construction administration portion of the cor"llract
allows for four to six :site visiis from th~ arc:hitectura~ and mechanical sub-consultants.
For the anticipated constl"\Jctio:1 scheduie of six month,::;, and g"lven that the primary
scope of work in ..... oIves these two diSCiplines. more site visits are anticipated during
construction. These site \lisits would be to monitor construction progress and to attend
.a few of the weekly jobsite meetings. The increased allowance would maintain the high
leve' of coordlnatj-on established during (he dssrgn phase of the project.

2. Acoustic Review: During the desrgr, phase. an acoustic review of the figh!/; fioor office
