Report in Brief
The purpose of this pub1 ic hearing is to receive objections from affected
property OII/!lCrS of proposed assessments related to completed weed
abatement work,
Ba.ckground
The Fire flfarahal' s Off ice for Santa Clara County administers the contract
for weed abatement. within the City of Palo Alto, ira accordance with an
agl-eement between the City and County.
On November 8. 1993, in accOl .... dance with Chapter 8.08 of tile Palo Alto
lo1:unicipal Code. City Council declared weeds to be a nuisance and ordered
tha.t the nuisance be abated. A Public Hearing "'as held on December 13,
1993. fOl" the objections to the prol>osed destruction or removal of the
weeds.
Once the above steps had been taken, the County Fire Marshal's Office
instructed its contractor to abate · .... eede on City and private properties
within P;1.1o Alto. That work has now been completed. Property owners
were notified the first week in November 1993 that weeds were to be
abated by March l~ 1994, either by the Q\rmers~ or by the County. If the
property O\'mers chose to have the County abate the weeds. the abat~ment
charges were levied against the respective properties as an assessnlent by
the Co\mty Assessor. Those not abating the weeds were since informed by
the County of the costs for destroying and removing the weeds,
The Fire Department has published the necessary notice of this hearing in
the Palo Alto Weekly. The cost report by" the county Fire Marshal j s
Office has been posted in the Council Chambers for ten days prior to this
hearing.

with the recorda of weed abatement t.hat have taken place" Should there
be any modifications in tile Pl"oposed assessments as a ret1;ult of the
hearing, changes in the assessment apread will be necessary. After these
recalculationfl are completed, the asseSSl'nent will be submitted to the
Coanty Assessor for ontry on the next tax roll upon which general City
taxes are to ~ collected.

WHBREAS. the Council of the City of Palo Alto has
heretofore declared 'Weeds growIng on certain properties within the
City to be a public nuisance by Resolution No. 124a~ dated November
8, 1993; and
WHBREAS , the Council on December 13., 1993~ did adopt
Resolution No. 72'15 thereby'urde:dng the weed nuisance abated; and
WHBRBAS, subsequent to the giVirl9 of said notice, the Pire
Chief, through jlia hdmini8tr-ator. the Santa Clara County Fire
Marshal ~s Offico. has caUFH~.d, to be abated the \!ief}ds on the herein
described propertieD; and
WHBRP.A.">. the lIire Chief,. through hiD Administrator, the
Santa Clar.a county Fire Narshal's Office .. h~B f.iled his report and
assessment list for weed abatement ao provided by laIN and a hearing
has been duly set and noticed$ for obj~ctioJls to said report and
assessment list and for confirmation: and
WHBRRAS. the Council has duly considered the l.·eport and
assessment list and any objectIons theret.o;
NOW .. THBREFORE. the City Council of the City of Palo Alto
does hereby RH'SOLVR .tJ.9 folloW8:
£BeTION.1. -The :feporl:: and aSSe69Jll.ent list 1tl in all
respects complete and correct and i8 hareby conflnned. The amounts
of the cost for abating the nuisance are conthmed and those
remaining unpaid, as shown on Rxhiblr-, -A" attached hereto and
irlcorporated herein, shall constitute opecial assessments against
the, respective parcels of land and arc a lien on the property for
the amount of the respective assessment.
SEctION-4. All written or oral protests or objections to
said report and assessment list are over.r:-uled or denied .
.5.R.crIQH . ...l. The unpaid assessments shown on Kxhibit IIA'I
shall be entered upon the 1994·95 tax-roll against the parcels of
land and shall be collecled at the uarne time and in the same manner
as general City taxes, be subject to the same interest and
penalties, and be subject to the same pl'ocedul:e and sale in case of
delinquency. All laws and ordinances applicable to the levy,
collection~ and enforcement of City tax~s an~ hereby made
applicable to this special assessment.
