This report requests that the city Council reaffirm the City of
Palo Alto's Oisadvantaged Business Enterprise ,OSE) program and
adopt the attached resolution (Attachment 1) implementing an DBE
qo~l of 18 percent for fiscal year (FY) 1994-95 (page 4 of
Attachr!Qnt 2:), for work performed on federally-funded projects.
The staff-recommended action relates to continuing compliance with
federal qovornment requirements necessary t,o recei vo federal
transportation fUnds.
Federal regUlations require recipients of federal funds to
8stabli.sh a DBE proqram and a [)RE goal. The purpose of a DBE
p:t:"09ram is to implement a federal policy supporting, to the fullest
~xtent possiblo l participation of firm~ owned and controlled ,by
minorities and 'Women in fedeorrlily-fundod' programs. CalTrans is
respol'lslblll) for ensuring compliance with requirement;s for DBE
par:t1cipation on projects us.i..ng fedaral funds. Annually, the City
~UBt r~a{tir~ its DBE program -and establish a DBR participation
goal in order for CalTrans and the Feder~l Highway Administration
{FHWA) to continue to release the funds for the lntermodal Surface
TranspottClltion and Efficiency Act (ISTEA) federally-funded
projocts.
The city of Palo Alto's DBE program will continue to apply only to
projocts using the ISTJ?A. funds, and includes the following:

The progran becor:oes effective il':l:::lediately uPQn C()uncil approval and
covers the period fron July it 1994 to JUne 30, 1995. subject to
Council approval, stl'lf! expects to publish it in July 1994.
Foderal rogulations require establ1shF.ent of two types of DBR goals
(1) an overall goal for tho entire program (for a one year period)
and (2) contract goals tor each specific primo contract. The goal
is not a 'quotl&.. It Is. rather, a numoric objectivo b~sed on the
number and typos of contracts to be awarded, availability of DBEs
in tho: &rtla, and past results of 08& utilization. The rainimum
l"oquired 'overall OBE qoesl Is 10 percent.
In Fi' 1993-94, Council. approved the establiahr.u;mt of an overall DBE
9'oal of 18 porcont. That ,,-loal W.1S chosen bocause the santa Clara
county Transportation Agency and the City of MOUntain View each had
certified DBE prO<jt'aBs \lith annual goals of 18 percont. The goal
was determined based, In part. on the1~ research of availahility of
DBEs in this area and the county's DBE uti lization of past
federally-funded projects. Since the City is in the same
q(!ographic 8l"ea and is sQrved generally hy the same D8E fi:i."ms
available to santa Clera county and Mountain View, the City also
adopted the 90a1 of 18 percent. Sinc-e OBE qoals are reviewed
annually, this fi~ura m~y be adjusted based on the City's
experience.
ouring FY 1993-94, council awarded design contracts to two
consultants for the ISTEA-funded projects. The amount of federal

and state funding for the two projects in F~ 1993-94 vas
approximately $1.11 .. illion. The first contract, for the
Embarcadero Bike/Pedestrian Bridqe and 8ike path. Extension projoct,
'Was awarded to JiHH, Inc., 'With 2'6 percent OSE pArticipation
attainb:d; and the second contract, for PligEi HilllFoothill
Intersection Improvements, was awarded to NoltEl'A~BociateB, with
14 percent DB& participation attainod. Sinco tho City's D!)E
participation in FY 1993-94 fluctuatod botween 14 and 26 porcont,
there is no basis to chanqe the goal tor F't 1994-95. Consequently,
staff recommends an overall OaF. qoal of lS percont for f'i' 1994 .. 95.

ALTO ADOPTING A DISADVANTAGED BUSINESS
ENTERPRISE (DBB) PROGRAM FOR FEDERALLY FUNDED
CITY TRANSPORTM'ION PROJECTS
lfilBRBAS, in order. t.o comply with federal requirements to
obtain federal funds for City transportation projects, the City of
Palo Alto must approve and implement a Disadvantaged Business
Enterprise (IIDB8") progt'am prior to approval by Caltrans and the
United States Department of Transportation (IIOOT·) of any request
for federal funds;
WHRREAS. the overall goal established by the DBS program
for DBE participation in the perfoxmal1ce of contracts financed in
whole or in part with DOT funds shall be 13 percent and shall cover
the period from July 1, 1994 to June 30, 1995;
NOW, THEREFORE. the Council of the City of Palo Alto does
RESOLVE as follows:
~crI.QR...l...... The Council hereby adopts the "Disadvantaged
Business Enterprise Program· City of Palo Alto~, a copy of which
is attached hereto and incorporated herein by reference.
SSCTION 2. The Council hereby establishes the overall
goal of 18 percent for DEE participat.ion in the perfot:'fM.nce of
contracts "financed ill whole or in part wi'th DOT funds during the
period of July 1. 1994 to June 30, 1995.
SECTION l.-"-The Coullcil hereby directs the City Manager
or such person as tbe City Manager may designate to publish
newspaper notice t.his yeal:.· and every following year (or fiscal
year, as the case may be) during the existence of this DEE Program~
setting forth the goal established by the City for that year for
the participation of DBE participation in th~ perfo:rmance of
