'this l."eport requests that Council approve the Police Depaxtment's
continued participation in the CAt-IO automated fillgerpl"int system.
Funding has been included ill the proposed 1994-95 polic~ Department
budget.

On January 1, 1986 r Senate Bill 190 provided for implementation of
a Statewide automated fingel.'priHt system that could be accessed by
local. law enforcement agencies. This bill appropriated $7. OOO~ 000
to the Department of Justice for the purchase of equipment and
services to create this Statewide system. The bill also pxovided
procedures for loco'll government to receive equipment based upon a
sharing of costs with the State. The Stat.e paid 70 percent of the
cost of the purchase of the equipment. All other coata fo1':' imple~
menting local systems are the responsibility of local government.
To be eligible to participate in thiG statewide program. and to
receive the 70 perc:ent matching grant from the State~ each county
was requil'ed to form a local policy board. The Santa Clara Cotmty
CAL-ID Local ,Policy Board was fonned in 1988 and is currently
composed of ~ ,Supervisor Ron,ald Gonzales. from the BoC'trd of
Supervisors; Mr. John Smith. Chairperson. Santa Clara CQunty RAN
(Remote Access Network) Board; Council member Donald Burr, City of
Campbellj District Attorney George Kennedy; Shel·iff Chal,"les
Gillingham. Chief Louis Cobarruviaz, San Jose Police Department,
representing the largest police department. Mr. Harry peacock, City
of Saratoga; Mr. Dennis Handis. Santa Cla~a County Probation
Department; Judge Paul Cole. Santa Clara Municipal Court; and Chris
Durkin. representing the Police Chiefs' Association of Santa Clara
County. A staff committee subsequently developed the Santa Clara
County Program.

'l'he. City of Palo Alto's share for 1994-95 is $32,683. Funds bave
been included in the Police Department's proposed 1994-95 budget.
Reqommendation
Staff recommends that Council adopt the attached l"esolution
authorizing the :Jlayor to amend the agreement providing for Palo
Alto Police Department's continued participation in the CAL-ID
automated fingerprint system for 1994-95.

WHERRJ\S, the County and the Incorporated Cities entered
into an agn~ement dated April 26, 198!l, entitled "AGRS&f.ffiNT TO
PROVIOE LOcAL LAW ENFORCIlMENT AGENCY ACCESS TO THE Cl\LIPORIHlI
IDBNTIFICATION SYSTSN' (hereinafter "Original Agreement·), in ord.er
to fund, implement and operate a local automated fingerprint
identifi-cation sys-t~m (he:t.-einafter 'Locul 10 System" J, which will
pi'ov.1de iocal law enforcement agencies with direct access to the
-California Idel'ltif.ic~tion System 'hereinafter ~C.l\.L-ID Systcm ll )
through the use of local remote access network equipment (hereinaf
tel.' 'Local RAN Equipment"'; and
h"HSRahS, the count~' and the Incorporated Cities desire to
contil)ue th~ Od.gj nal AgrcE'rnent and to modify its terms with
respect to the financial contributions which the County and the
Incorpor.ntcd Cities will each make to the City of San Jose in order
to irr,plen·.ent and operate the Local ID System and to extend t.he term
of the Agreement for another year..

hereby RESOL~ as follows:

tion and operation of the Local ID System entitled "Sixth Amendment
to Agte.(Jment to' provide Local Law Enforcement Agency Access to the

City of San Jose'a finance Departmellt the City of Palo Aleo's ch~ck
in the amount of Thirty~Two Thousand Six Hundred Eighty·Three
Doll.~s ($32,6e3.00) for the Local 10 System, which is the City of
palo Alto' 9 financial contribut.i.on to the operating budget for
~iscal year 1994~9S for the Local 10 System.
SEC:rlQN 3. The Council finds that this is not a project
under the California Environmental Quali.ty Act 8.nd, the:c.'efore, no
environmental impact assessment i& necessary.
