Members of the Council:
Notice i.s hereby given, pursuant Assembly Bill 3001 (AD 3001),
Public Resources Code (PRe) Section 41730 et seq. that the City
Council will hold a public hearing to consider adoption of the
Cityls Nondisposal Facility Ele~ent (NDPE).
B.a.CkgrQund
In 1990, the Califol"nia Integrated Waste r"anagement Act (Act}
required all cities and counties to prepare and adopt a Source
Reduction and Recycling Element (SRRE) that prcpoees programs to
reduce or-recycle 25 percent of all solid waste currently
landfilled by 1995, and 50 perGent by the year 2000. The Act also
requires all cities and counties to prepare and adopt a Household
Hazardous Wa&te Element (RJiWE) that proposes programs to safely
collect. recycle, treat and dispose of household hazardous wastes
generated by households. The City's SRRE and HHWE were approved
and adopted by Council on.June 6, 1991 (CMR:307\91). In 1992. the
California legislature enacted AS 3001 which amended the Act. This
statute required all cities and counties to prepare another
element. the NDPB that ·describes nondisposal faci] ilies necessary
to implement the jurisdiction I B SRRE, This NOPE identified the
utilization of the City! s Green Composting Facility and the
Sunnyvale Materials Recovery and Transfer Station as Nondisposal
Facilities necessary to implement the City!s waste reduction goals.

Public Works staff has prepared the NDFE consistent with applicable
regulations. A d:t'aft of this NOFE wail submitted t"o the Santa Clara
County Local Task Force (LTF} for review and comment regarding the

Element, In accordance with'the requirements of i"RC Sections 41734
(a) and (b). The NDFE was approved by LTF.

The NOPE is not Bubject to the environment review requirements of
the California Environmental Qualit}' Act (CP..QAl, in accordance with
the requirements of PRe Section 41735 (a),
Holding thie pub) ic hearing will satisfy the requirements of
Cal1fo).'nia' Code of Regulations Section 18766, Council is rEqUested
to consider all the public comrnents and to adopt the NDFE under the
attached reoolution. 'fhe final approved NOFE will be transmitted
to the County of Santa Clara I'lithin 3D days of its adoption and
submitted to the California Integrated Waste Management Board by
December 31~ 1994.

Nondi'lposal Facility Element
Ca.lifomia Public ResoUTUS Code (pRe), Section 41130 et seq., requires every California city
IIl\d oounty to prepare and adopt. Nondisposal Facility' Element (NOPE) for all new or
expansions of ex:isting NondisposaJ Facil,ties. which will be needed 10 implement the local
SO\lt~ Reduction and Reoycling Element (SRRE). A Nondisposal Facility is defined as any solid
wa.s1e facility. wilh the exception of solid waste disposal or transformation facilitie.s, whtch cue
required to obtain a solid wast. facility permit (PRC Section 40151).
The City of Palo Alto has prepared, adopted and hereby transmits '0 Santa Clara County the,
City's NDPE as required by PRC Sec';on 41730. The City will submit a copy of its NDFE to the
California Waste Managemenf Boud faT nwiew and approval. The City's NDFE \'rill b"
incorporated into tho City'S SRRE at !.he rime of the firs! fjve4 year revision of the SRRE (pRe
Secnon 41136).
'[his NDFE identifies the PaJo AlIa Green Composting Facility and the Sunnyvale M:<ttcria!s
R~overy and Transfer (SMaRT) Stali{'ln as nondisposaJ fClciHties the City intends to utilize to
jmplement ils SRRE and meet the so11d waste diversion reqltiremenls of PRe Section 41780.

acrordance with the requirements ofPRC Section 41734(a) and (b). As indicaled by PRe Section
41735(8). the adoption 01 amendment of th[s element is not subject to environmental review
under the CalifOrnia Environmental Quality Control Act.
