Reoort in Brief
This hearing is the second end last public hearing required to form
the assessment district _ This report recommends that Council
conduct a public hearing and adopt a resolution {At.tachment 1)
adopting the Engineer's Report, overruling protests and confirming
the assessment for :~e California Avenue Business District parking
garage on Cambl;-idge Avenue.
Background
On September 27, 1993 Council held the first of two req--lired pub::ic
hearings (CMR:S04 :93'. No action was required by Council other
than to open the public hearing. receive public input and close the
public hearing. At the September 27, 1993 meeting, ataff reviewed
the history of the ~roject; described the new parking structure,
its estimated cos~. schedule and required public noticing. Prior
to c~:'lsing the pl';' 1:'-hearing, four persons spoke and forty-four
petitions were r"' =e_ ".red i:-, fa'J"or of the prGj ect whereas three
persons spoke and one petition was received opposing the project.
In order to proceed with forming an assessment district f_or a new
parking structure, Council must hoJd a second public hearing and
adopt the Resolution Determining Convenience and Necessity,
OVerruling Prot.ests, Adopting the Engineer's Report, Confirming the
Assessment~ Ordering the Work and Acquisitions and Directing
Actions ..... ith Respect Thereto {Attachment I}. This r"esolution
overrules protests, adopts the final Engineer's Report containing
the assessment roll; boundary map diagram, asseSSTr.ent amounts,
methc:3. of assessment and Technical Report supplement.
Future Actions

a'..lthori2;ing the issuauce of bonds and approving the official
statement. Then the official statement ~ill be distributed by the
financial advisor to the pot-er.t ial purchasers of th~ bonds. It
describes the projec~, the bonds and provides information about the
City and the assessment district.
The bonds 'IN"ill be gold in November, and staff will z-eturr:. to
Council with a recommendation to award the con~truction COntract
and the sale of bonds on No\tember ."22, 1993. construction ot the
project will begin in 3arly J4nuary and be completed in October
1994.
Public Outreach
Staff has mailed infozmational letteys, placed notices in the Palo
Alto Weekly, to inform the prope:rt.y owners of the two public
hearings and posted flyers along evert st.reet. 'Within the district.
Also, staff has held two property owner informational meetings to
provide details of the project s!".d answer q-I.lestions. Four property
owners attended th€ first meeting. Quest ions raised expressed
concern about the total number of new pa~king spaces. the cOst pe~
n~w space, the need for the structure ~nd the method of assessment.
Maintenance Costs
Mainten~~ce costs for the new structure will be paid by revenues
from the sale of califo.l'nia Avenl.!e Business Dist.rict parking
permits. Staff estimates the: total annual maintenance cost of the
garage will be abou~ $94 per space for a total of 195 garage spaces
or about $19,.400. The total annual mair.tenan,:-e cost of the

The total annual revenue colle~ted by the sale of yearly parking

Bnvironmental Asse~sment
A negative declaration (Negative Declaz-ation No. 92-E!A-26) for the
project was approved by Council on January IS, 1993. No further
environmental review is required.

ASSESSMENT, ORDERING THE WOR!:: ANn ACQUISITIONS
AND DIRBC~ING ACTIONS WITH RESPECT THERETO FOR CALIFORNIA
AVENUE PAMING ASSESSMBNT DISTRICT NO. 92-13
The City Council [the ·council'") of the City of Pdle Alto
{the "'City") does RESOLVE as follo .... 's:
SECTION 1. On AuguSt. .9, 1993, this Council adopted
Resolution No. 7230, A Resolution of Preiirninar,i' Determination a."1d
of Intention to !1a.ke Acquisitions and lmprovements for the
California Avenue Parking Assessment District No. 92-13 (the
'"Resolution of Intention"). and in it directed the Engineer of
Work to make and fil~ a report in writing <the "'Engineer-'s
Report·) as therein specified.
SErTIQN 2. The Engineer'S Repcrt was made and filed. and
con:sider~d by this Council and found to be sufficient in every
p5rticular, whereupon it was determined that the report should
star~d as the Engineer's Report for all subsequent proceedings
under and pursuant to the Resolution of Int~ntion~ and, as
required by la\ol'~ this Council has conducted two public hearing; to
take testimony and for-hearing protests in relat ion to the
proposed acquisitions and improvements and th€ l~'vy of assessments
therefor, notices of which hearings were mailed, posted and
published all as required tr.l law and all persons interested and
desirino; to be heard WEre giv~n an opI;:"ortunity to be heard, and
all matters a:ld things pertaining to the acquisitions an.:)
improvements were fully heard and considered by this CC'..Lncil, and
any protests~ both \IoTitt"€r~ ajld oral, were d .... ly heard.
SErTlon 3. This Council ~xpressly finds that the t,lublic
interest, convenience and necessity re'-IUire that the acquisitions
and improvements described in the Resolucion of Inteucion be made
and, consequently, that the provis:'_ons of the Special J>.ssessment
Inv~stigation, LiIT'.itation and Majority Pretest Act of 1931,.
Division 4 of the Streets and HighwdyS Code of Cali fornia, shall
not apply to the proceedings unde!" the Resolution of In.tention.
SECTIQN 4. The owners of one-balf of the area to be
assessed for the cost of: the acquisitions and imprc,vements did
not. at or prior to the time fixed for the: hearir.gs, file writter.
protests against the proposed aCq',J,isitions and impz-avements or the
grades at which the wOI-k is proposed to be done, as a whole or as

engineer's. estimate of costs and expensE's. in whole or in part, or

hereby overruled.
SG;f'TION S. The district b,=nefited by the acquisitions and
improvements and to be assessed to pay the costs and expenses
thereoL and the exterior boundaries thereof, are as shown by a
map thereof filed in th~ office of the city Clerk, which map is
made a ~r~ hereof by reference th~reto.
SErTION 6. Based on the oral and documenta.ry evidence.
including the Engineer's Report. offered and received at the
heari;}gs, this Council expressly finds and determines t.bat~ ia)
each of the several subdivisio!1s of land ""ill be specially
benefited by the acquisitions and improvements at least in the
amount, if not more than the amount, of the assessment apportioned
against the subdivisions of la:J.d, respectively; and (b) tbere is
substantial evidence to support, and the weight of the evidence
preponoera.tes in favor of, tne finding and determination as to
special benefits.
SECTION 7. The Engineer'S Report, including the plans and
specifications for the proposed improvements and estimated
assessments against each parcel of land within the Cali fornia
Avenue parking Assessment District No. 92-1), and any revisions
thereto; is hereby approved. Final adoption and approval of the
Engineer's Report as a whole. and of the pla~s and specifications.
maps and descriptions of the lands and easem€nts to be acquired r
estimate of the costs and e.x:pense5~ and the assessment.; as
contained in the Engineer'S Report~ as her~inabove determined and
ordered. is intended to and shall refer and apply to the
Engineerrs Report~ or any portion thereof, as amended. modified,
revised or corrected by, or purs\j.ar.t to and in accordance with,
any resolution or orderr if anYr heretofore duly adopted or made
by this Council.
SECTIQN e~ The acquisitions and improvements describ~d in
the Resolucion of Intention be made. and that the assessment to
pay the costs and expenses thereof is hereby levied upon each of
th~ taxahl e parcels of land 'Wi thin in the California Avenue
parking Assessmer.t District No. !t2-13 in accorda.nce with tne
assessment formula specified in the Resolution of Intention, which
formula is hereby approved. and to which forrnl..lla reference is
hereby made for fUL-ther particulars.
SE.r'T'IQN 9. The City Clerk shall forth'..:ith cause to be
delivered to the official of the City wh~ is the superintendent of
Streets of the City a copy of the Engineer' S Eeport containi ng

the assessment and a description of the method of apper-Cionroent of
the asses~ments as herein approved and the Sup~r intendent of
Streets shall file the same in his or her office a~d the Sdrne
shall cO::lstitute the assessment roll in and for these proceedings.
The City Clerk shall al~Q cause to be filed with the Recorder of
the county of Santa Clara a notice of 6ssessrnerl': subs~_ant ially in
the form specified lY.f Section 3114 of the S~rEets a::1d HighwdYs
Code of the St.ate of califo .. -nia and duly executed by the City
Clerk. From the date of recording the notice of assessment, all
persons shall be deemed to ha .... e notice of the contents of the
assessment herein ccnfirmed.
SECTIQN 1Q. Jurisdiction is hereby expressly reserved by
this Council to authorize the issuance of i~provement bonds under
Bond Plan Or Section 13.16.150 of Chapter-13.16 af Tie-Ie 13 of the
Palo Alto MUnicipal Code .

pursuant to the provisions of Chapter 13.16 of Title 13 of the PaJo Alto Municipal Code (the
-Act-) adopted its Resolution of Preliminary Determination and Of Inte-ntion No. 7230 for the
acquisition and/or construc~on of the p.ublic improvements more panicularly therdn described;
WHEREAS, the Resolution directed the underslgneO 1.0 mak~ and file a report presenting

necessary or convenient for the operation of the improvements, plans and specifications for t.~e

DESCRIPTION OF PROJECT
The California Avenue Parking Structure consists of a two-level (ground plus. one story
above) public parking structure in the caJifornia Avenue Business District. Presently. the
dl!Signated site, Jocated on the south side of Cambridge Avenue, between. Birch Street and
Nogal Lane, is occupied by Ci'y Lo, 3, which encompasses all of Santa Clara County
Assessor's Parcel Number 124-28-51. The proposed p.1Tlcing structure will be constructed to
the property lines to allow for the maximum amount of parking spaces. This required a zone
change from PF, Public Facility and CC{2), Corr.munity Commercial, to a PC. Planned
Community Distric!~ including zem lot Tinc developmenl.
The parking garage will be a concrete structure with three TOWS of concrete columns. 18 feet
on center supporting the second level. One row of concrete columns will be along
Cambridge Avenue. one along New Mayfield Lane, and the third row of columns will run
down the renter of the building. Concrete beams will span between the columns supporting
the second level concrete slab deck. Additionally. there will be a shear wall along
Cambridge Avenue and a shear wall along New Mayfield Lane at the midpoint of the
building. \\'here the parking structure abuts. the pC1:'i. ofiice and the hardware store. concrete
masonry walls. will be constructed. The proposed ex.terior of the structure includes brick
veneer over concrete, pre-casl architectural concrete panels with and without inlaid brick,
landscaped planter boxes, and metal trellis at various locations. The planting areas run
almost the entire length of the structure. along Cambridge Avenue, approximately 200 feet of
the proposed 250 foot lengtFt. The exception is for vehicle and pedestrian access areas where
no planters will be present.
The current City Lot 3 consists of a total of 90 parking spaces, which includes 3 ha..-idicap,
31 compac~ and 56 standard s!alls. The proposed parldng struc'"re will have 186 public
parklng spaces of which 88 wm be Slandard, 92 will be oompac', and 6 will b" handicap
accessible spaces (includes 1 van accessibie space). The ground level will be approxirr..ately
27,400 sq ft consisting of 34 standard spaces, 40 compact spaces, and 6 handicap accessible
spaces. The second level will also be approxima'ely 27,400 sq. f<. consisting of 54 standard
spaces. and 42 compact spaces. The outside dimensions or the building will be approximately
250 feet by III feet, and the to!al square footage will be approximately 54,964 square fee,.

The proceedings rannula to be used in detennining the annual apportionment of benetits in the
levy of annual assessments upon the real property w:thin the proposed assessment district is
based upon the· weighted assessm~nt formula developed as part of the 1983· 84 Callfomia Avenue
Study by the consulting firm of Angus McDonald &. Associates ,""orking with property owners
in the C~ifomia Avenue area parklng assessment district '~Dlstrict"). This formula was updatr..d
and revised by Angus McDonald &, Associates for use with Parking ,.~ssessment District 92-13.
The proceedings formula is based uPOl1 three main poiflts:
L A property's major benefit is. the value of the number of parking spaces, which it does
net have to provide on-site.
2. NOt every parcel's parking. dema.nd <:onforms uactiy to the average; therefore, a
moderating element which considers the total size of the parcel is justified.
3. Properties which have been in the District for a longer time have been paying more for
tl1e benefit received, and such past payments should be taken Lnlo consideration.
A parcel's parlcil'lg deficiency (or its burden on the District) is calculated by first calculating the
total parking requirement for the parcel under City ordinances generally then in effect. By
subtracting the number (if any) of spaces provided OIl-site. this would lead to the number of
spaces wh{Ch the Dlstrict must pro .... ide.
The financial concept of discounting, wbicn reflecls Ihe compounding effect of innatlor., is used
as the first step in valulr.g past payments inlo the District While the actual calculations are
complex, the underlying concept is one doliar in the future would be equal to an amount Ie::.,;,
than one doUar i1l the present. The concept is used to determine the present value of a dollar
paid in each year. The base year J968 was established, as this was the first year of G-Bond
payments. (Since the E-Bonds apply to all properties on "~e ; .. <is of "">e.,sed property value,
City Staff agreed that no adjustment was neces.sary for payments towards these bonds.)
P.as.t payments into the Bond Plan G were further weighted according to the dollar amount of tile
District's oor-.ded indebtedness in each year, and according to the spread of the burden. The:
total bond amount was used as a surrogate for actual annua! payments, SO that the weightlng
system is consistent throughout. The District's lotat parking deficiency in each year was used
as a 'Utrogate for actual assessable sqUMe feet under Ule Bond Plan G, also for the sake of
consislency over time.

The combination of the rliscounted vallie of a dollar in each year with the bonded indebtedness
and the spread of the burd~n for that year results in a series of weights. The earlier a
development staned paying into tile Bond Plan G, the iower lhe as~igned weight. The weight
is C2JTied by tile prcperty, not by the owner. SO is not revised if a property changes hands. ff
a development has been expanded or otheJV.Iise mooitied since the beginning of payments, t.~e
apprcpriate weight is assigned to each phase of the development. jf a change in use increases
the parcel's patking requirement, the amount of the assessment will incTeasei. The larger t~e
amount of a new bond, lhe more equal are the weights assigned to older and newer
developments.
The ~'eight is multiplied by the parcel's parking deficiency. resu!ting in a ~~s:sessment

The District's sum of weighted as5ejsmenl factors is divided into 75 percent of the annual
assessment amount to yield the parking/use assessment rale. The sqlJare feet of land in the
District are summed and divided into 25 percent of the a.T1nuaI assessment amount to yield the
land assessmellt rate.
The amount paid by each parcel IS equal to L~e product of its weignted assessment factor
(parking detkierlC)' multiplied by the wejght) atld me parking/use assessment rate, plus its. land
square footage multiplied by the land asses.s.ment rate. Each property pays according to its share
of the total number of parking spaces which must be provided by the Dis-tricf, moderated by its
share of the total land area in the District.

The advantage of this fonnula is tl'Iat it relates the assessment amourU directly to the number of
spaces which a par~l would have 10 provlde on-site if it was not in the assessment district,
