In March of 1993, Cal·OSHA issued an abalement notice requiring the heating and ventilation system at Fire Station 6, 711 Serra Way (Stanford), to be inspected, cleaned, and maintained. In addition, on a subsequent inspection in December of 1993, Cal·OSHA required the abatement of vehicle exhaust from entering the habitable spaces of the building. This would require the installation of a diesel exhaust removal system for tire apparatus. The City I)as provided similar installations in all City owned tire stations through the CIP process over the past few years. The Department of Energy has provided a similar installation at SLAC. Soon after receiving the OSHA notice, Fire Department statfinformed Stanford of the need for the required maintenance. Maintenance of heating, ventilation, and air conditioning (UVAC) systems is identitied as Stanford's responsibility by the Palo Alto/Stanford Fire Service Contract. Stanford has completed some cleaning and inspection of the ventilation registers, although not within the ductwork. Stanford has also relocated an air intake to minimiu police vehicle exhaust from entering the building (which resulted from Stanford CMR 267:94 ,. , ... ,. i I .' ," i ).-. , f· \ police vehicles being warmed up in the parking lot at the beginning of each shift). However, installation of the diesel exhaust removal system has not yet been funded or ac<:omplished. Stanford staff has indicated that they have forwarded this information to their attorney for a conlract review process. Some question exists from Stanford's perspective regarding responsibility for installation and maintenance of the newly required exhaust system. As a result of the extended period of time to resolve the contract issue with Stanford, concerns have been expressed from the firefightel~' union, and two fire department employe~~ have filed Workers' Compensation claims for exposure to diesel exhaust fumes. Staff has expressed the sense of importance of this matter to Stanford, as well as our need to respond appropriately to CaI·OSHA and our employees in a timely manner. Staff is awaiting Stanford's response at this time. However, given the time limitation 011 the Cal· OSHA notice, the system needs to be installed immediately. Statf recommends that Council approve the BAO to fund the installation of a diesel exhaust removal system at fire station 6. Although this BAO rellects no reimblU~ement from Stanford, the City Attorney's office will conHnue to work with Stanford to clarilY the contract issues and resolve financial responsibility issues.
