Members of the Council:
Report in Brief
Council is required by State law to hold two public hearings on
this subject in order to establish an assessment distri-;::t. The
first public hearing is to receive public input, and the seco~d is
t.o receive additional public input and consider resl:llutions
approving the Engineer'S Report, confirming assessments and
authorizing the issuance and sale of bonds.
Background
On August g~ ~SS3, (CMR 450:.93) Council adopted Resolution No.
7230 i Preliminary Determination and Intention to Make Acquisitions
and Improvements; Resolution No. 7231, Preliminarily Approving the
Engineer'S Report; and Resolution No. 7232, Approving Plans and
Specifications for the Califo~ia Avenue Parking Assessment
District No. 92-13.
If Council approves the resolutions at the second public hearing to
be held on October 12, 1993, the award of the construction contract
will be presented to the Council in October 195-3. The Assessment
District bonds will be offered for sale by the end of the calenday
year. In order to avoid any construction impacts to the business
di.atrict during the Christmas shopping season, construction is
scheduled to begin in January and be comp!eted by october 1994.
Staff has mailed inforw~tion to the property owners on the time and
location of the two publi~ hearings. placed notices in the £alg
W..o Weekly once a week for two consecutive weeks and posted flyers
along the streets within the district. staff has also held a
property owner infonnational meeting with members of 1:he district,
to explain the de~ails of the project construction, CQst and timing
and their estilT'~ted annual assessmer~t. Another infoT1T1ational
meeting will be held prior to the second public hearing, once the
bids are received and actual assessments are known.

In order to proceed with the formation of an assessment district
for the new gal:age, Counci1 must hold two public hearings as
required by a recent amendment to the Brown Act. At the first
meeting, Council will receive comments from in~erested per~ons.
After all public input has been given, Council will close the
hearing.
Prior to the second public hearing, staff will open bids on
September 28, i993 and finalize the Engineer's Report. The second
public hearing on the assessment district ~ill be held on Tuesday,
October 12, 1993. The final Engineer's Report will then be
preBe~ted and Council will consider three resolutions: (il
Resolution Approving the Fi.nal Engineer's Report and Conf inr.ing
Assessments. {ii) Resolution Authorizing Issuance of Bonds; and
(iii) Resolution Approving Official Stat..ement and Ordering the
Public Sale of Bonds.
Merr.bers of the California Avenue Area Development A.Esociation
(CAADA) Parking Committee are surveying district property owners to
det.ermine the extent of CAADA support for the project. Their
survey will be presented to the Council at the public hearing.
EnYjronmental Assepsment
The project will have no significant environmental effect for
purposes of the California Environmental Quality Act, as shown in
the negative declaration for the project approved by Council on
January 18, 1993. (Negati'.:e Declaration No. 92-EIA-26.) No
further environmental review is required.
Recgmmendation
Staff recommends that CO'.mcil open the first public hearing.
