September 16, 1993 THE HONORABLE CITY COUNCIL Palo ~to, California Award of Contract for Landfill Environment.al Contrt"Jl Syst._~ Maintenance Members of the Council: Report in Brief This report recommends that Council approve a one-year contract {Attachment B), with options for two additional years i with EMCON Associates in an amount not-to-excead $50,000 per year to provide for maint~nance services for the landfill gas and leachate extraction systems. Funjs for the first year of the contract are available in the ~f 1993-94 Refuse Fund Operating budget. Funds for years two and three are contingent upon Council approval for each subsequent year. DisQussion Und~r requirements mandated by the Bay Area Air ~Jality Management District and the Regional Water Quality Control Board, the City was required to install and operate a landfill gas extraction system and a leachate extraction system. Each of these sy~tems requires routine maintenance to function properly. Palo Alto Landfill Gas Corporation, the lessee of the landfill gas system, has the majority of the responsibilities for maintenance of this system. The City is responsible lor maintenance activities related to ongoing filling operation8 a~d vand21ism. The contract provides for these maiI'1.tenance responsibilities, as \IIell as all maintenance and repair activities related to the leachate extraction system~ An Invitation for Bid was issued to seven environmental service companies and t.hree responded. The scope of work identified several fixed schedule maintenance activities, as well as ~ time and materials task for non-rout ine maintenance and repair. Staff recommends that Council determine £MOON Associates to be the lowest responsible bidder, based on th~ '.mit prices for the fixed schedule maintenance activities, which were over 40 percent lower than the other bids submitted (Attachment A). Additionally, EMooN Associates submitted the lowest rates for services to be charged as time and materials work. -1- • 2 BecqmmeDda~ion9 Staff recommends that Council: 1. Y.e:_runal Information Trle Cit-I" of Paro Alto Sanitary landfill is a '37~acre Class III Sanitary landfill loca-t.ed at the easterly end of EfTlbafCadero Road in Palo Alto, California. Regulatory agencies with jufisdiction o\'{er the faCility have mandated Certain environmental control systems be installed at the Faciiity, including a IBndflH gas extraction system and a leachate extraction system. Under this Agreement, The Contractor shan provide la;-,dfill gas a"d ieachate extraction system maintenarce services over a three-year period as defined herein. This Agreemem provides for a one·year contract with the option of exrending the contract annua"y for two addftlonar years. The City of Falo Alto reserves the right to modify Oi cancel the COntract based on the COl)tractor's performance andlor changes in appropriations tor this work il"l each fiscal 'year's budget as adopted by the Palo Alto City Council. The City shall negotiate the extensions of tile contract with the Contractor on an annua! basis. The continuation of this contract and The extension of the contract over the three year period is subject to the Contractor's pertormance and the C!tv of Palo Atto's allocation of funding for each fiscat yeal. The arrangement between the City and the developer requires the deyeloperto perform all monitoring and adjustments to the generator, fiare, and gas ext/action system.
