This report forwards the recommendations af the Planning
Corumdssion on amendments to Section 18.94.0iO of the Zoning
Ordinance that would extend the nonconforming use termination
date for an art studio at 440 Pepper Street.
Backgrmmd
On July 28, 1993~ the Planning Commission considered a zoning
text amendmenc extending the nonconforming use termination
provision for this art studio use at 440 pepper Street~ Thia
action was in response to a City Council directive O~ June :1,
1993, requesting the Planning Commission to initiate proceedings
to extend th~ teromination date for thi3 art studio. (See
attached report to the Planning commission of July 23, 1993.)
Planning Corerniss]QQ Action
At the conclusion of the public hearing' on July 29: 1993. the
Planning Commission unanimously recommended approval of:
1} The n~gative declaration and
2) The added provision to the nonconforming use
termination section of the Ze.:aing Ordinance (Section
10.94.070) of the Palo Alto Municipal Code permitting a
termination extension fr~ July 20, 1993 to July 20.

In taking this action, the Pl~r~'ing Commission also recommended
that language in the preamble of the terminaticn extension
ordinance contain language acknowl~dging property owner
cocmri.tment to redesign the driveway and parking ar.ea in front of
the a:t c studio. The reason tor this requested change to t.he
preamble was tc strongly encourage the property owner t::'l modify
the parking and dl"iveway paved cut:'2. iJ'l front :>f the art studio
with some form of 1~~dscapin9, in order to improve the visua~
compatibility of the art studio site '"it.h adjClcent single family
re~idences. Th~ property owner agreed to this recommended
modification to the preamble of the oldinance.
Summary and Conclusion
Staff supports this modification to the ordinance preamble for
the reason previously cited. It also supports the Planning
Commission recommendation on extending the termination date for
this monotype art studio.
Recommendation
Planning commission and staff recon~nd that the City Council

1) The attached environmental assessment r~commending a
ne9ative declaration, and
2) The attachec ordinance adding provisions to the
nonconforming use terminat.ion section of the Zoning
Ordinance (Section 19.94.070) of the Palo Alto
Municipal Code that permits a termination extension
from July 20, 1993 to July ~O, 2003, for an ar~ studio
at 440 Pepper Street whose functions are limited to

utilizing the art form called monotype.

WHEREAS, \,.he Xirkeoy Art Studio, located at 440 Pepper
Street, is a nonconforming use that, among otherA I is currently
scheduled to have terminated on July 20, 1993; pursuant to the
amortization schedule set forth in section 18.94.070 of che Palo
A1 to Muni cipal Code; and
WHER..EA.S~ the Kirkeby Art Studio has requestea that the Ci '.:y
allow them to continue operating at 440 pep~·er Street 'Lmtil Ju-~y

WHBRBAS, the Planning Commission. after duly noticed public
hearing held July 28. 1993. has rec~~end~ that sectioo 18.94.070
of the Palo Alto Municipal Code be amended to allow such use to be
extended until July 20, 2003; and

The Kirkeby Art Studic is privately owned and op~rated by
Mr. and Mrs. Kickeby. :It is located in an R-l.. Single Family
Residential District jn a 2~200 square foot building located on a
6. '733 square foot parcel. The principal functions of the a.rt
studio are to teach~ and to create and produce monotype prints ~ All
activities at the site relate t.o the mono type process. and are
relatively low profile in nature and compatible with the adjacent
neighborhood. According to the art corrrnunity. the studio is a rare
and valu1ble asset. especially because of its in3tructional and
educational activities in the monc~ype mediurr.. Additionally, some
of its classes are affiliated with the City of Palo Alto'$ Division
Of Arts and CUlture. Alt.ho",j,gh there currently exists on tbe site
a large ·commercial-looking" driveway. the Council acknowledges the
commitment. of t.he property owner "{,o r'9design the driveway in c.
CIaIlDer more compatible with a residential neighborhood. The
Council finds that the studio would cont.inue to enhance the quality
of life in this ~ommunity if it were allowed to conti~ue operation
for another ten years.

and the facilities shall De converted or nc~ified to accommodate a
confor.ming use, or shall bE removed at or before the time limit

however, that no such termination, removal. or conversion shall be
required ~ithin fifteen yearB from July 30, 1978. or within fifteen

A Baseline Public Health Evaluation (BPHE) for the affected area has Leen
approved by the USEPA. The SPHE concluded that the major riSK represented by
t~e contaminated plume would be use of the woter as a potable water supply. a
highly improbable event. The other potential route of exposure to the
groundwater contamina"ts would be migration of v"pors up through the soil into
below ground or ~round level confined spaces. H~~ver. the BPHE concluded
that there was no significant risk: for resh:fents 1 iving or wor'kers werking in
building; bui It 011 concrete sl,bs as this site 1 s. Furthermore. as
remetiiation contjnues. any potentH~l ri..:k. will become less slgnificant. and
eventually the contaminated groundwater will meet drin~ing water standards.
In addition. individuals using the site wi 11 have no exposure to -these
contaminants as the site improvements and activities wlll not intercept the
water table.

This recommendod action responds to. City eow.:U dircctiw of June 21. 1993 requesting
the Planning CornmiosioJl to initiate extending the termimticn date for this use (see Cll)'

packet). The reoommended acti<>n w<>uld result in approving a text aroendment in the
oonconforming use provisions of the Zoning Ordinanco (Section 18.94.070 of the Palo Al'"
Municipal Code).
BACKGROUND

D--..nc;e Studio, CiJy actions on the Comprehensive Plan Map in 1976 and on a !l£W Zoning
Ordinance and Map in 1978 resulted in • number of uses beroming nonconforming and
subject to termination. Many of these uses, dependin;: on the amortization scl!edule that
reflected the age of the Iype of struCtUre wbere the uses were located, were required 10
terminate on July 20, 1993. The zoning regulations also contained an exception provision

regulations stated that the principal criterion that the Planning CommissilJc should consider in
excepti.on applicaoons was. whether the use of the property in question was compaub!e aod
not detrimentaJ to the land uses designated in the CompreheMive Plan in surrounding areas.

dates for a nonprofit ~.bcmoIecular research organi%atioD (Linus Pauling Instirute) from
July 20, 1993 to Juiy 20, 1998 and for a pri"ate dance studio (Beaudoin Dance Studio) from
July 20, 199310 July 2Q, 2003. The Planning Commission acted on these rermination
extensions on January 13, 199:; in res.:x>DSe !O an earlier request from Council.

The art studio at 440 Pepper Streel is ",,"rated by Phillip and Paula Kirkeby, who also
operate the Sgili-Anderson Gallery in Downtown Palo Alto. The principal fwlCtiollS at this
an studio are to teach !!te use of and to crate and produce anistic prints utiJ iring the art
form called moooty!><. (!"hi; technique hereafter is referred to as "monotype".) MollOtype
uses a manwtl press wbich produces a single print Only water and oil-based inks are used
in ~ m::.notype print process.
All activities at this site relate to this monotype process. Those activities inc] U<le instruction
on the monotype process to visiting artists. The lessons DOr1IW1y are provided to one artist
at a time, who are at Ibe .tudio, and extend from approximately three daY' 10 two weeks.
Artists come to the studio at the invimtion of the owners. The lessons usually occur during
normal weekday woding hours. No more than three or four persons are or. site during these
instruction periods and they include the artist, a printer and the L"'lruClor, usually Mrs.
Kirlreby and perhaps an assistant Ie "'J>. Kirkeby. !n addition, loctures are oe<:asionally held
at this art studio for up to 30 individuals where v lsiting artis ts demoD5trate their techniques
using the monotype process. Such lectures are held once tK twK.--e a yeM OD a weekday
evening and !ast aboul two hours. The Kirkeby. also offer two-day workshops on weekends
approximately four 10 six times a year where they teach studeD,. the I!IOIlOIyp"e process.
These workshops are affdiated with instructional "",grams sponsored by Ibe City of
Palo Alto', Division of Arts and Culture.
The Kirkeby', Art Studio at 440 Pepper Streel occupies a 2,200-square-foot reinforced
concrete bloc" building that is located on a 6,733-square-foot parcel. The zoning of this site
is R-l Single-Family ResidentiaJ. The Comprehensive Plan Map designates this site as
Single-Family Res 'dentia!.

REOUESTER EXTENSION
Pbillip >nd Palda KHkeby are reques'ing a IO-year termination extension from July 20. 1993
to July 20, 2003 in order to allow them to continue 10 operate this art !itudio where monotype
prints are produced. (See attached Jetter from their atlOrney Stephen W. Plav,".) The
Kirlttbys 0Wtl this site. Th<.y have stared that fInding all alternative site in Palo Alto that
could accommoda", the monotype press equipment would be extraordinarily difficult.
The Kirkebys have been notified oy the City that the July 20. 1993 termination on their an
studio use at 440 Pepper Street will be def<rred until the OtItcome of this pending action bas
occurred.

approximately five years ago for the sole purpose '" 1U it as an art stuUi<> '" teach
IOO~ 10 >-<tis... In the interim, they wm periodically notifted of their nonconfc'llling
:lSe stailIS bv fbe City as were aU other owners of nonconforming uses subjecr to termination.

""ncept curre:uJy is being discUSS«! by the COlDprebe!lSive PI.., Advisory Committee in the
initial vision and goal sett'e.g phase of the Comprehensive Plan Uydate. It has also been
discussed by the Planned Development Subcommittee, which is oomprised of ARB and
Planning Commission members. While implementation of such a goal to have sucb mixed
functions in residem",1 neigboo.boods ",.,.t likely would not OCCur until after adoption of a
new CompreiJensive P!atl, and would 001 likely app;~ to many R-I neighoo.hoods; the

Considention of allOWing such an art studio a conditional use in R-I smgu, family districts
also was considered as a possible strategy fur allowing !his monotype art studio to remain at
this sire. However. an studios may not be appropriate evell as conditional uses in many R-1
single famL'ly "'igh~.Nds. Therefore, staff believed that initiating. ",""ination extension
in response to the City Council directive would be the most appropriate procedure to
ccnskte: foc extending this monotype art studio use at this time. If an exter.sioD is approved,
sufncient time wocld be afforded in the Comprehensive Plan Update process to ronsider
pctential application of live/work policre:s for awropriate residential neighborh~ before
such a ten:t.ination extension would expire
One last issue regarding this poss !ble rermination extension that 5hould be dis....-ussed is the
groundwater plume, that is discussed in the attache<' EIA Negative Declaratioo. The sources
for this plume are Hewlett Packard facilities al 640 Page Mill Road and 395 Page Mill Road
and the Varian facility at 601 California Avenue. In addition to remediation efforts that are
described in the Atta(;hed EJA including removal of source tank, and groundwater eJtD'actlon
and treatment, the EIA also noted !bar the Baseline Public Health Evaluation (BPHE) of this
area concluded that the,e were no significant i"isks for residents Irving or workers working in
buildings built on concrete slab5 th2t are similar to the concrete block structure where this art

Nonethe!ess .. an edension is SllppOrted because the"e moD01)'pe art studio functions enhance
the cultural and social environmeru of this commuruty and a void of such eu!tura! emichment
woukI occur if Ihese functions were required kJ terminate. Sucb an extensi;)o would require
that the same monotype fuoctioo:; that are described in this r<:p<>rt continue al !his art studio
and that this ... and aocillary functions (e.g. the worksbops and lectures ) do DOl expand or
inrensify overtime.
The proposed extension in !be anacbed draft ordinance specifocalJy refers to an art studio
wbose functions are limited to teaching and to creating and producing artiotic print! utilizing
!be art form called monotype. Thus, the exrension would apply kJ any potential art srudio
perfcnning mo~ art reproductions at this site for !be duration of !be extens ion.
ENVIRONMENTAL ASSESSMENT
The proposed modiflCatioD to the zoning ordinance' s nonconforming u.;e provisions will not
resull in >DY signifocam adverse environmectil impact. A negAtive declaration is anacbed.
RECOMMENDATION

Press is one of the insIitutions that puts Palo Alto in the big Jeagues in the art world,
I strongly recommend that the City CowteiJ find. way to allow the pn!SS to remain.
The best way would be to clung. the Z<>ning regulation and permit VlIrious art activities
in residenlial ~ This would .......,., the pos.ibility of more art in the city
in the future. (ZDning was originally designed to keep noxious induslrial uses out of
residential clistria. for health reasons. Art studios have 00 such hazardous efiects.)

I am writing on behalf of the Kirkebys who own the real property
located at 440 Pepper Avenue.
!n the las! five years, Paula Kirkeby and her husband Phillip have used
the property for the sole purp<>"' of an art studio to teach monotype to artis,",
who are invited to the studio t~ study and learn the technique. The U5C is of a
nature that is unintruslVE' to the neighborhood and causes very little traffic or
noise or other jr.terference wit.h. the purposes otherwise compatible with an
R-l neighborhood.
1n addition the Kirkeby. are willing to work with the neighborhood to
provide opportunities for local resident> to learn about the printm~"ing art.
The continued use would not be detr'unental to the neighb.xtoOOd and would
continue to enhance the quality of life in this community.
The Kirkebys }1ave been very generous with the use of their press, not
only for the City workshops, but also for the Women's Caucus for the Arts,
students in the Palo Alto School District, and also students from Stanford
University. It is a unique treasure for the arts in PaID Alto, and there is no
other site within the city whicr would be appropriate for its operation.

An extension would also be Lmely in view of the fact that the
Comprehensive Plan is presently in the process of being revised and
exa.mined eXl:en:iively , and there may be a re:ommendation for changes
regMdina certain properties in this area, and in particular the nature :md
spedIic: uses in the R-l zones.
I therefore request that the Planning Commission grant an exteruion of
the tetmination date for Mr. and Mrs. Ki:kel>y as requested.
