Amendment to Merit System Rulea and Regulations -Nepotism Policy

This report is in response to a staff assignment from Council to
prepare a modification to Section 302 of the Merit System Rules and
Regulations for the purpose of exempting hourly employees who are
siblings from the nel=-otism policy. The exemption would apply only
to siblings working at separate work locations and who ar.e not in
a superviaory working relationship.
Background
According to the cur:cent. nepotism policy which applies to both
regular and hourly employees~ siblings cannot be employed within
the same division or department. The policy as it is currently
written has pl.'oven to be unreasonably restrictive for City programs
utilizing hcurly employees who possess specialized skills for
temporary assignments.
In the interest of maintaining a proper balance between open
recruitment and protection from nepotism, staff recommenda adding
a provision 'by which siblings may be employed in the same division
or ,~epa.rtment under certain conditions as'outlined in the attached
resolution, We believe the change will enhance departments'
a.bility to hire staff for temporary assignments, yet protects
against improper influence on employment decisions.
All changes being proposed are highlighted in the attached
resolution. The changes affect only hourly employees and arc no~
subject to meet and confer, The employee unions, as a matter of
information, are given copies of these documents.
