This report requests Council approval of the Resolution Authorizing
the City Manager, the Assistant City Manager. or designee of the
City Manaqer l on behalf of the City of Palo Alto, to accept all
deeds and grants conveying any interest in or easement upon real
es~ate to the City of palo Alto and to consent to their dedication.

The Municipal Code currently provides that the City Kanaqer or, in
his/her absence or disability, the Assistant city Manager may
accept, on behalf of the City ~£ Palo Alto, all de~ds or grants
conveyinq any interest in or easement upon real estate to the city
of Palo Alto.
This section of the Code is twenty-two years old and needs to be
chanqed to conform to the rest of the code in teres of authorizing
a designee to sign or accept deeds or grants on behalf of the City.
The attached Resolution will amend the previous :z:-esolutioil to
provide for tbe city Manager, A!;sistant City Manager or any
designee of the City Manager, to accept deeds and grants or othe~
instruments of conveyance transferring any interest in or ease~ent
upon real estate to the City of Palo Alto. This new resolution

will provide for the designee ot the city Manager, in the event
both the City Manaqer and Assistant City Man~9~r are not available,
to si9n Certificate of Acceptance fo~.

WHEREAS. Section 27291 of the California Gove~nt Code.
as amended~ provides that deeds~ grants~ and other instrumEnts of
couveyance of any real estate interest~ including easements, to a
governmental agency for public purposes shall not be accepted for
recordation without the consent of the grantee evidenced by its
certificate or resolution of acceptance attached to or print on the
deed, grant, or instrument of conveyance; and

agency, by a general resolutio~, may authorize an officer or agent
to accept and consent to such deeds, grants, or oth~r instruments
of conveyance j
NOW, THEREFORE, the Council of the City of Palo Alto does
hereby RESOLVE as fellows:
SECTION t. The City Manager or, in his or her absence or
disabi1ity, the Assistant City Manager or any designee of the City
Manager. is authorized and directed to accept, for and on bet-.alf of
the City of Palo ~to, all deeds. grants. or other instruments of
conveyance transferring any interest in or easement upon real
estate to the City of Palo Alto and to consent to their recorda·
tion.
