Resolutions regarding Caljfornia Avenue BUsiness District Parking
Structure
Members of the Council:
Report in Brief
This report recommends th-.tt Council adopt th~ attached three
resolutions {i} ~ {ii) and (iii: to begin the aSSfi'".ssment process and
obtain bids for construction of the Califor..ia Avenue Business
District parking garage on Cambridge Avenue.
Backgrpund
on December 2,' 1991 {CMR 437: 91) / Council directed staff to proceed
with the ~sign and construction of a parking structure at City
parking Lot 3. the Keystone Lot, and create an assessment district
to fund the construction. On January 18; 1993 (CMR ~OJ :93).
Council found that the project would not have any significant
negative environmental effects and approved the proposed Planned
Community zone change. Sta.ff indicated it would provide more
detailed information on the timing and steps necessa::'y for
establishiog ~he assessment district. issuing the bonds and
starting construction when it returned to Council in August 1993+
Discussion
III order to proceed with forming an assessment district for a new
garage, Council is required by law to adopt the following three
resolutions:

k ••• sment Di.trict No 92-13. (Attachment 1). This resolution
formally begins the assessment process and declares that Council
preliminarily determine what the public interest, convenience and
necessi ty require, and that the Council intends to order the
acq~isition, maintenance and operation of the garage improvements
to be financed by assessments withi:l the district. I~ also
provides for bonds to eve'1tually be issued and presents a brief
description of the work. The proj ect scope of work includes
constructL~g a two level, 186 space (ground plus one level) parking
structure and improvements to the adjacent sidewalks~ lighting and
alleyway.

Diatrict No~ '2-~3 (Attachments 2 • 8). This resolution describes
the boundaries of the district and sets the t~c required public
hearing dates for September 27. 1993 and October 12. 1993. The
purpose of the first hearing is to re'Ceive public testimony. if
any, regarding the proposed assessments. The second hearing is for
Council to determine whether the public interest, convenience and
necessity require the acquisitions and improvements and to approve
the Engineer's Report and assessmen~s. The report includes plan9~
specifications, a project description, cost est it'r'.ate, an
explanation of the method of assessment and an asse,ssm\2nt roll
indicating the proposea annual average assessment (estimated) for
each parcel within the district. The total assessment is estimated
to be $2,39S~ODO. The individual annual as~essm~nts are expected
to range from $0 to $9,500.

Aa ..... e:nt Di.trict Mo. 9:2 -13 (Attachment 3). This resolution
approves the plans and specifications in substantially complete
form suitable for calling for bids. The resolution also describes
the advertising and bidding process and sets cont~actor liquidated
damages for work not completed within the time specified in the
contract.
Staff intends to advertise the project in August, open bids in
september and award the work in October 1993, after t.he second
public hearing. In order to avoid any construction impacts to the
business district during the Christmas shopping season,
con8truction is scheduled to begin in January and be completed by
October 1994_
Bond Finane i ng
parallel to the formation of the assessmerlt district, st.aff will
proceed with the necessary steps to sell bonds by the end of the
calendar year. These bonds will finance the entire project
consisting of the design ~ork (mostly completed) ~ acquisition and
construction; project management and engineering administration.
The financial consulting firm of Miller' Schroeder Financial Inc.
is in the process of being ~etained by the City to dev~lop a
comprehensive financing plan~ secure a trustee. and coordinate with
the bond cOWlSel in obtaining the debt financing. The bond counsel
of Jones Hall Hill and White is on retainer to the City for this

Public Outreach
As required by law, the noticing process will include the mailing
of information to the propel:ty mmers on the location and time of

the two public hearings; placing of notices in the ~ bltQ Weekly
once a week for two consecutive weeks and the posting cf flyers
along streets within the district (Attachments 4 &: 5).
Additionally~ the City will notify propertjt owners of two
informational meetings where staff and its consultants w~ll meet
with the members of the district to discuss details of the project
construction, cost and timing {Att.achment 6). Members of the
Califonlia Aven'..&e Area Development Association (CAADA,I Parking
Committee will mail a survey quescionnaire to property owners which
will include individual assessment costs provided by the City
(Attachment 7). The CAJI..DA parking Committee intends to present the
results of this survey to Council at the first public heaz'ing.
EnvirOnmental Assessmenc
The project will have no significant environ-mental effect for
purposes of the California Environmental Quality Act. as shown in
the negative declaration for the project approved by Council . .:m
Jamlarj' 18~ 1993 ~ (Negative Declaration No. 92-EI.A.-26.} Ne
further environmental review is required.

To: Property OWners in the California Ave. parking Assessment
District.
For the past several years CAAOA has been working diligently vith
the City of Palo Alto to procure more parking in the california
Avenue district4 Recent City of Palo Alto studies, which
included all parking in the district, hav-e confirmed the shortage
of parking centered in the area of Parking Lot 3 located on
cambridge Ave. between the Post Office and the hardware store.
The City has now completed the final construction plans for the
Lot 3 Parking Structure, which "'ill add 96 spaces, and has
embarked on the final series of meetings intended to lead to the
start of construction early in January 1994. It is essential to
the final approval that we show the City counci.l that a majority
of the Property OWners in the District approve the construction
of the parkinq structure. Acco~Qingly, please siqn and return
the enclosed petition promptly in the envelope provioed so that
the par~inq committee can receive it by August 23, 1993.
Now we are about to taka the next step to maintain adequate
parkinq in the california Ave. business oistrict. As with the
property own~rs in the area who recognized the need for adequate
parking in the early 1950's and banded together to secure public
off-street parkinq wherever needed in the district~ we should
continue this community effort and provide needed parking
throughout the district.
The cost of creating new parking is very substantial and the
members of the Parking Committee know this only too well. All
are either property owners or represent property owners and each
person on the parking committee is prepared to accept the
assessments on their properties because they strongly believe
that adequate parking is essential if the California Ave. area is
to remain a viable business district.
Some property owners in the assessment district whose prope~ties
are distant f~om Lot J may protest that the construction of a
parkinq structure on Lot J will not benefit them directly.
Everyone should remember that all of the off-street parking that
we have now was paid for and is still heing paid for by the
district as a whole. properties distant from Lot 3 are
benefiting from parking lots closer to them that are being
partially paid tor by property owners whose properties are
distant from those lots.

Tbe comaittee believes that it is tar better to create additional
parking when naeded than to let the California Av~nue district
decay becausa of inadequate parkinq. Please support us in this
effort and return the enclosed petition promptly in the stamped
envelope pro~1ded so that we can receive it by August 23, 1993.
If we cannot show majority support for this project the Palo Alto
City council may not allow the project to proceed.
