Copper Discharge Reduction Memorandym of Understa~ding

Report in Brief
Staff reco~rnends that Counc11 approve the concept of entering into
a Memorandum of understanding (MQUj with the citiF.!S of San Joa-e and
Sunnyvale~ and with the Santa Clara Valley Water District. acting
as manager of the Santc.. Clara Valley Non-Point Source Pollt:tion
Control PJ.~am. The purpose of the MOU is to respond to a
requirement of the R.egional Water Qu.::tlity Control Board (Regional
Board) to reduce the discharge of copper into San Francisco Bay
(Bay) •

Discharge permits for the sewage treatment plants operated by Palo
Alto, San Jose, and Sunnyvale require submittal of a proposal to
reduce the amount of copper discharged to the Bay by an additional
950 pounds per year (lbs/yr). A Cease and Desist Order issued to
the co-permittee agencies (including the City of Palo ~to), of the
Sar..ta Clara Valley Non-Point Source Pollution Control Program,
contains the same requirement. This reduction l which is to be in
addition tc other stated copper discharge reduction requirements;
could come from either sanitary sewer or storm drain sources. To
respond to this requirement I a series of meetings haa been held
among parties interes~ed in this matter; and a proposed method for
addressing the 9S0-po!.!Ild annual discharga reciuction requirement has
been fO!:'mulated. The attached MOU, which contains the required
proposal, is intended to be submit:ted to the Regional Board to
fulfill the permit requirement.

dated December 9, 1333. A copy of the draft ve~sion of the MOU r
which differs f:r:"om the attached draft final MOU in specific
language only, but net in ge:1~ral approach, was included in

Memora.ndum of Understanding
The MOD contains a proposal to meet the 9S0-pound annual c~pper
discharge reduction requi::;:ement through efforts to reduce the
copper in storm drain discharges. Storm drain di&charges from
Santa Clara Cotm:y to the Bay contain more than five times the
amount of copper discharged by the three sewage treatment plants.
Because less effort has been made to control storm drain
discharges, anc because of their greater annual copper discharge,
it appears that controlling storm drai:l discharges will be more
COGt effective than additional c~ntrols on sewer discharges.
Therefox'e. the MOtT contains draft measures for addressing the
copper content of storm drain discharges (·control measures·) ~
The specific control measures are not being finalized in this MOU,
however ~ because of the need for more informat.ion and furtht::r
evaluation. Specific control measures will be included in the
County's Storm Water Manag~ment Plan.. to be submitted to the
Regional Board in -September 1994 (and to be updated annually
thereafter). Specific control measures will be budgeted annually
and acted upon by Council in annual budget decisions.

SECrION I -PURPOSE, OBJECTIVES, AND BACKGROUND
PURPOSE Ml) OBJECTIVES
The basic goal of this MOU is to aa:ord priority to making reasonable further progress in
reducing !be discharge of copper to tile lower South San Franci.",..., Bay and its m"butary
creelcs and rivers. Jts objective is to allocate a 9S0-p0und average arnuaI copper Joad
reduction and ro provide a fiam<:worir for. and ccmmi:mer~ 10, future control measure
activities designed 10 accomplish this reduction.
BACKGROUND
On Juoe 16, 1993, !be California Regional Water Qualiry Control Board, San Francisco Bay
Region (Regional Board) adopted. wasu:load allocation for copper requiring the POTW 5 and
!be Program 10 achieve 20% reductions In their average IllII!Wll mass loading ,of copper by
1998. The wasteload allocation also requires tile Program and POTWs to werle ~r to
allocate aDd demoJlSlTale an additional average annuaJ reductioo in oopper Ioadi!lgs of 9".,0
poonds per year by 1998.
The SI>It Water Resoun:e. Control Board bas no< approved the Regional Board', wasteload
allocation. However, the Regional Board bad issued NPDES permits to the POTWs
requiring the achievement of copper load mluctioc;; based on the wasteload allocation.
Tbese NPDF..5 petmits bave been appealed by 'be POTWs. The appeal, question the basis
and need for rhe copper load reductions specifIed in the wasteload allocation.
Notwi!hstlmding these appeals, good faith efforts are being made by the P01Ws aDd tLe
Program to mluce copper loads.

To obtain the broadest possible tnput on a proposal, and Lo facilitat~ cooperative efforts
among goveIllIl'leIJt, businesses and C'.once:med citizens, a South Bay Copper Reduction
Dlalogue (SOCRD) ..... established. The SOCRD included rep=,nllltiv<s fr~rn the Regional
Board, EPA. and buslJlCSS~ citizen, and em-ironmentaJ organizatior.s (Participants).
Ilo>ed on the SBCRD's deliberations, the 950 pound per year additional ccpper load
reduction (discus.-"'ed above) has been allocated to Siorm water reductions to be accomplished

be asked to assume respoosibility for additional copper load reductions if the reductions
allocated to storm water are not fully reali1..ed.
SECTION U -CONTROL MEAS\JRE ACTIVITIES
The Program through its co--pennittees will selecr and implemeru conrroi measure activities
drawing from, but not limi[ed to. those acrlvities contained in Appendix A 10 this MOU.
The seJecred measures will be incOfporated into me Program' s revi'loeCl Srorm Water
Manag<menl Plan, which will be submitted to th' Regional Board by October !, 1994. Tbe
SW.MP wiil include measures whkh n:flec( a le\'el of effort designed to rea<:h the objective.
IMPLEMENT A nON

Upon receipt of co-pemJinees' commitments to impIernent selected tontrol ~. the
Program will incorporate such measures into .hs revised Storm Wa:er Managemem Plan.

Appendix A of this MOU IIUly be modifJe.d when sucb activities and schedules arc
incorporated into the SWMP or during the Program's annual update process. The Program

STORM WATER CONTROL MEASURE ACfIVlTIES (Appendix A)
This Appen:Iix is a list of control me:lSUre aCLivities which the SBCRD idenrir1ed t('l be
comidercd by the Program's co-penninees: for implemenl2llion. More derailed descriptions of
these: control measures are pro:sented in Appendix D.
COPPER REDUCTION ESTIMATES (Appendix B)
This Appendix provides .1 form for nx:ording copper reduction estimares on .an ar.nual basis
resuJting from lhe implementation of control measure activities listed in Appendix A and will
be included in the Program's annual reports.
COPPER SOURCE ESTIMATES (Appendix C)
Tbe four tahles in rhis Appendix focus 011 characteristics of copper resulting from land use
practices. activities that generate copper. copper c{lnveyance mechanisms, .and influent
loading 10 POTh's.
