Consultant Sgrvice Agreement Related to CpqC Vas utility
Proceedings

This report requests that council authorize the Mayor to execute
the attached agreement wi~~ Resource Management International
(RMI) in the amount Qf $130,000 for s~ecializ~d consulting
services on gas utility matters before the California Public
Utilities commiasion (CPUC) during FY 93-94. R~I was selected
through a Request for Proposal (RFP) process and wi11 be
representing th~ City for the first time~ In addition, staff
recommends that Council authorize the city Manager or her
designee to execute one or more contract amendments in the amount
that Shall not excead $20,000 for unforeseen additional
regulatory related services. CPUC gas proceedings are ongoing
and bear heavily on the City's ability to maintain a competitive
gas utility~ FUnds for this service ~re aVailable in the FY-
1993-94 utilities Consultant Services Budget.
PiScussion of Consultant Seryi=~ for FY 93-94
During Fiscal Year 19~3-94, proceedings related to gas matters
which are being heard at the CPUC and the Federal Energy
Regulatory commissicn (FERC) will continue to be an area of major
concern to the City.
It is important that the city's interests be advocated in these
regulatory proceedings. To this end, the city will present its
own witnesses~ cross-examine other utilities' witnesses~ submit
briefs, file petitions and take other actions as necessary to
advance its needs~ Reliance upon consultants vith expertise in
CPUC matters is necessary due to the complexity and extent of
technical and procedural issues involved in these hearin9s~

Staff used the RFP process to solicit proposals from a pool ~!
consultants that have developed a respectable expertise in
regulatory matters. Seven proposals we~e submitted. staff
interviewed three firms and selected RMI. RMI will be engaged in
the activities of representinq the City's interest before the
requlatory bodies.
~ in~ormed us that they would not generally represent other
parties that may have & conflict of interest with the city of
Palo Alto. Ho~evar, it either the City or RMI feels that
conflicts could arise., RMI aqrced to recommend alternative
advisors to the City for that particular proceeding.
RecOmmendations
Staff recommends that Council:
1. Authorize the Mayor to execute an agreement with RMI ~or
$130,000 to provide consulting services in FY 93-94 on
matters before the California Public utilities commission;
and
2. Authorize. the City Manager or her designee. to negotiate and
execute one or more amendments to the ag~eement with RMI to
provide for unforeseen additional york related to regulatory
hearings, the value of which shall not exceed $20,000.
