This report recommends that Council rescind the construction
contra=t previously awarded to Petroleum Engineering, Inc.
(Petroleum) for failure to execute the contract and submit all
required bonds and insurance, and a~'ard a contract to rhe next
lowest responsible bidder, Paradiso Construction Co., in the amount
of $33,806 for constructing improvements to the Mlmicipal Service
Center (MSC) Fuel Tank Storage Area. Funds are budgeted in the MSC
Fuel Tank Mxiification Project, CIP 19002 and the Tan.lt
Investigation and Removal ProJect, CIP 19101.
Background
On May 20, 1993 Council awarded a construction contract to
Petroleurrl to cor..struct improvements to the ~.sC Fue;l Tank Storage
Area (CMR 269: 93). Provisions in the contract specifica.tions .;:tllow
the City to award the contract to the next lowest responsible
bidder if within lS days of the notice of award the contractor has
not. provided signed contract documents and the necessary bonds and
insurance certificates. Petrole\ ... m has not. provided these items to
the City. When Petroleum ~as oontacted by staff, it informed staff
that it was in the process of filing for bankruptcy protection
under Chapter 11 of the Bankruptcy Code and was unable to obtain
the required bonds for the prr:ject. Because Pet.role"olm has failed
to execute the contract in a timely·mar~er. the City shall retain
its (S2.000) bid bend as required by the Paic Alto Municipal Code.
The ne~t lowest ~e9ponsible bidder. Paradiso Construction Company,
notified the City of its will.i.ngness to enter into a contract and
extend its bid price (Attachlnent A), even though more than 60 days
will have passed between the bid opening and the award of contract.
A bidder may withdraw its bid after a period of sixty (60) days
from the opening of bids under the terms of the contract
Bp~cifications. Bids were opened o:n April 27th.
The project includes new piping and a pump, which will drain the
area into a se~er, ~nd is made necessarj by the City'S Hazardous
Material Stc-age Ordinance which l:-equires the prevention of the
escap~ :>f pc": ::~leu1'r, into the Baylands area.

Discussign of Construction Contract
aids were received from three contractors as indicated on the
att.ached summary (Attachment B). Staff recommends that Paradiso
Construction Co .• who submitted the second lo· .... est bid of $33,806,
be determined by Coune'll to be the lowest responsible bidder and
award the contract (Attachment C) accordingly. This bid is 23.8
per~ent ahov~ t~ ~~i~e~r's ~~~i~~~~ c! $27,310.
Staff requests the authority to issue change orders of up to
$6,800. which is 20 percent of the cont.ract amount, for unforeseen
modifications to the work by the City's contractor. The higher
than normal contingency is tv anticipate the additional testing for
contaminated soil should it be discovered during excavation. Staff
will return to Council for additional change orde~ authority if
contaminated soil removal becomes necessary.
The project scope of work incl~des the sealing of three existing
drains leading fl·om the MSC fuel tank storage area to Matadero
Creek and the install ion of new electric conduit and controls, a
sump~ pu."l'Ip a.."1d drain pipe to an existing sewer line. The in-~.ouse
design work nas been coordinated by staff from the util ities, Fire.
and Public Works Departments. Ccw.struction ...,i11 begin in early
August 1993 and be completed by September 1993.

This project is catego:r-ically exempt from review under Section
15301 of the CEQA guidelines.
RecOmmendations
Staff recommends that Council~
1. Rescind the construction contract previously awarded to
Petroleum Engineering, .Inc. for its failure to execute the
contract and submit a~l requir~d bonds and insurance.
2. Approve and authorize
