This report. with attached tables and sitt location maps, describes the c~rrent status of nonconforming uses in Pslo Alto. fnforrnation on the stat~s of n~nconforming uses has been periodically distributed to the Council. !:urr2ntljl~ 19 out of 28 noncooforming us.as that are subject to termination will be r~quired to cease operation on July 20, 1993. The previous status report on this subject was sent to th~ C~tjl Council on March 11, 1993 (see CMR:191:3). Current information on nonconfcrming uses~ which is discussed in the f~11owin9 paragraphs and app~ars on the attached map and tables, was obtained from field surveys conducted in early June f 1993. I~ the previous statu~ report on this subject (CMR:191:3 of 3/:1/93), there .... ere 30 nonconforming uses subjec.t to termination. A~ noted if' tna initial paragraph of t~is report, currently, there are 28 nonconforming uses subject to termination, of ~hicn 19 are reQ~~red to terminate ~n Ju1y 20, 1993. The two nonconforming use businesses that closed sir.ce March presumably did so in anticipation of the pending Ju1y 20, 1993 termination date. ~11 of the 19 nonconforming uses ~lth 3 1993 termlnation date became nonconforming from actions resulting from the 1976 Comprehensive Plan and subsequent loning regulaticns that became effective in 1978. The nine nonconforming uses ~ittl later termination dates ..,i11 be req' .. dred to termi nate at various times betw~en 1998 and 2018. These uses incl ude the linus Pauling Institute, that flOW )!till be reQuired to terminate ln (MR:364: 93 L - .. 1998, and the Bea~doin Dance Studio, in 2003. 60th of these uses were granted extensions by the Citi (ouJ1cil in February. 1993. In addition. severa1 other property or business owners of nonconforming use~ have indicated that they may apply for zone changes or request the CHy C(luncll to initiate proceedings that could affect the nonconforming use termination status of their b<Jsinesses or properties. Such actions. would have to be initiated prior to the Juiy 20, 1993 termination date, in order to nave the termination of such tJsas ;t 1east temporarily deferred unt;l legis.lative or discretionary actio~s occur. It should be further noted that sa~e of these uses su~ject to t~rmination are businesses that provide senices to nearby working and residenthl neighborhoods. Such uses include a~to sendee in and near the Downtown BUSiness. District and the California Avenue Eiusiness District; art a.nd carper1try "orkshaps i.n the Olive/Pepper neighboi'haod, and a restaurant near the 8arren Park nei3hbo~hood. The Comprehensive Plan Advisory Committee {(PAC) currently is cDnsid~ring the need to havli! i r.ange of services .. i~h1n reasonable loJalldng dis'tances from residential and work n~i~hborhQods. As a res~lt. these tentative CP~C goa1s cou1d ultimately lead to policy recomme:1dations that acrvocate provision of such Uses in areas where ]976 Comprehensive Plan policies and subsequent 1976 zonir!g r!:gulations made them r.o:'1c(:lnforming iHld subject to terminati.on.
