This report requests Council approval of recr-eation program
contracts which are revenue producing and generate a profit to the
City~ Programs continue to expand as p;lrticipation increases.
Al though staff continues to investigate the market in the mid
per,insula a~ea, staff is a ..... ·are of no other persons or groups with
the specialized skills and knowledge to provide these speci_fic
services. Approval is also requested for the annual Palo Al"to
Unified School District contract tor use of school facilities to
conduct City recreation programs.
Ba.ckground
The Recreation Division utiliz.es -a number of contractors who
provide a variety of services and programs for the comrr.unity. Fees
for these programs are revier,,, .. ed and approved by t.he City Council.
Should registrations for any of these progra~s fall short of the
minimum required enrollment, the activity · .... il1 be canceled. 1>..ny
f2e ccller,;t.ed for canceled activiti;;!s 'Wi11 be returned to

Art David schedules all the ul1lpi res and officials for the
adul t basketball and softball leagues th.at play year-round.
Tea~ registration fees cover the costs of the officials and
umpires. During the year, 171 teams register to play in City
le3.gues~ Annu·al reven;';'es in this program exceed $60,000.

3. Neil Berquist -$37,000 -Gymnastics West
Neil Berquist provides j nstructors for gymnast tcs EL'1d related
classes conducted during the year. This program has grown in
recent years. Program participants are expected to exceed 750
during 1993-94. Annual revertues in eXCESS of $4.5,000 are
anticipateri for 1993-94.
4. Palo Alto unified School District -$25,100 -Facility Use
This agreement provides for the City's use of School District
facilities to conduct c~~tain City recreation programs. The
p-ecre~'i:ion Division uses the Schoel District facilities year
round for programs '..;hich incl ude youth and adult sports: gym
programs and special classes. This agreeTIlf2nt also allo'lt.'s for
use of the Gunn, J. L. Stc.;nford and Jordan s .. iI:1 pools for
summer program~ and gymnasiums at cunn, J.L. Stanford, Jordan
and Palo Alto High School for ~Ioutb and adult sports.
staff recommends that Counci:: approve and authorize the Mayor to
execute the attached agreements to provide revenue producing
recreation programs on a cop-tract basis and for the use of P~lo
Alto Unified School District facilities for certain City recreation
programs.

Administrative Procedure
I. The Busines$ Manager shall be responsible for the: coordinarion and interpretati0n of Board
policies and procedures ilnd the delerrrunarion of a fee schedule for the use of facilities.
2. Groups ihall have priority in the use of facUities as follows:
a. School and school.sponsored groups, clubs. and student body organizations.
b. Schoo!-oonnec:red groups (e.g. PTA, BoosIer clubs, employee bargaini.'lg unirs
and/or organizations).
c. Departments or agencies of local municipal goverTunents.
d. Community organizations fonne:d for educational, political. economic. artistic, and
mvroil interests of the citizens oflhe COmmllnlry.
e. Other approved groups.

regular conducl of school progra..-ns, the use of school district fadlities shall be conditioned
upon the user's agreeing to hold the Palo Alta Unified School Disttict, its Board of
T~"'teCs. the individual rnero':ers thereof, and ali district officer&, agents, and employees
free and harmless from any lo~s., damage, liability. cost or expense '[har may arise our of or
be ~used in any way by such use or occilpancy of school property. {please refer to

10. Groups using school fa..'ilities shall be responsible for the cQndition i'1 which they leave til::

damage shall be grounds for refu.w of future school facility use.

13. Use of school playing fields shall 001: be permined wr.ile it is rair.ing. or if the field is wet

present a Werj hazard to users.
14. An approved application may be revoked ",·itb reasonable notice when school facilities are
needed for school purposes.
15. No facility use permit shall be granted for a period e.xceeding one year.

$1 million and such self-insurance is afforded to the pale ~to
Unified School District. its directors. officer.s, agents and other
employees. for liability or loss derived from the obligations under
