Assembly Bill 408 (AB ~oa) decri:mir,alizes park long violations, re
moves parking citation processing trem the courts and establishes
a civil s}'6t~m for administrative a.djudication of parkin.;; offenses.
While the operative date of the legislation is Jv.ly 1. 199J( it
allows for a. phase-in period until January 1, 1994~ Ho ... ever~ the
Santa Clara County Municipal Court has notified all agencies wittdn
the County that they will cease handling citation~ as of June 30 1
1993. As a result, effective July 1. 1993. the City will be
responsible for processing and adjudicating parking citations. As
part of the legislation, the governing body of each jurisciction
that issues parking citations must es't.ablish a schedule of parking
pena~ties for parking violations, late payment penalties and
administrative fees. These penalties and fees for Palo Alto ~ill
be inclUded in t.he 1993-94 Municipal Fee. Schedule.. Hoit.!'ever,
because the penalties and fees must be effective on July 1 a~d the
Y.unicipal Fee schedule is not effective until August 1, a
resolution is needed to establi$h the penalties and fees fo;" the
month of July. Additionally, the legislatior. requires designation
of the Parking Examiner function by an individual agency's
governing body or exec'..lti ve officer ar,d iJpproval of program
guidelines. Council adoption of an ordinance designating the
Parkinq Examiner and approving the program guide:lines is also
requested. The ordinzo_nce is proposed for codification a.s Chapter
lO~60 of the Municipal Code, repealing and replacing that Chapter,
since it presently deals ~ith parking meters and parking meters
have not been used in Palo Alto for many years.
As described in CMR:206:93, AB 408 becomes vperative July 1, 1993.
An tIIaministrative adjudication process will be implemented that
includes a nc-charge review of citations by toe Police Department
~ith an appeal in writi~g or in person before a Parking Examiner.
A final appeal to be heard in civil court is also available. The

administrative tees, and any other related charges .be established
hy the qoverning body of the jurisdiction ",here the notices of
parking violation are issued. Additionally, section 40215 'WaS
amenaed to include language that the ad'lllinistrative review of
~ontested parking citations be conducted before a Parking Examiner
designated by the issuing agency's governing body or Chicf
executive officer, and that the reviews be conducteod in accordaTlce
with writt,en procedures established by the issuing agency that ..... ill
ensure fair and impartial decisions.

The Parking Examiner will conduct administrative reviews of
contested citations in writing or by personal conference. The
leqL;1ation require~ that a Parking Examiner dernonstrate
qualifications, training and objectivity prescl·ibed by the
qoverninq body or chief executive of the issuing agency. The
legislation also demands that the continued employment,
compensation and/or performance eval~~tion shall net be in any way
linked to the amount of fines collected by the E~aminer.
'roar .. Guidelin ••
Training materials and guidelines for the parking Examiner program
are retl~cted in Appendix C. These were originally drafted for use
by the city of Los Anqeles and endorsed by the california Public
Parking Association.
The purpose of the materials is -t:0 provide training and guidance on
policies and procedures used l.n the operation of the Parking
Examiner proq't.'am to aS$ure fair I equitable and i.mpartial decisions.
It is important to note several other major changes in AB 408 in
the process of contesting parking citations. Prior to AB 408,
parxinq citations could be contested, under criminal procedures,
for A period of up to fiv6 years after issuance, based on the
statute of limi tat ions for criminal infractions. Under the new
process, parking citations are a civil matter and must be contesteQ
within 21 days of issuance or within 10 days of th~ mailing of the
delinquency noti~e (a total of about 33 days ira real t~me). If
c1 tations are not contested .i thin this timefra:'!le, there is no
further recourse or procedure tor an appeal to civil court. An
appeal to civil court can be made only after a hearing has taken
place.

The burden of proof has also changed from 1'beyond a rea:.:;onable
doubt-vhich is used in criminal cases to a "preponderance of the
evidence" used in civil cases,
The new process does not provide tor the testirnonl~ of the off ieer
~~o issued the citation at the hearings. In other ~ords, there is
no longer a right to confront or question the citing officer.

Prior to All 40a, parking' fines (with the exception of state
mandate.d tines relat.ed to disabled. parking} .... ere set by the
Municipal Court ot indi'.idual counties. cities ..-auld recommend
ce.rt~in levels of fines that -.. ere sucsequently revie'.'ed and adopted
as part of the counties' bail sChedules. Using this process 1
parking fines varied from agency to agcncy~ Under AB 40a~ parking
fines become civil penalties, and issuing agencies vithin the same
county are required, to the extent possible, to standardi~e these
penalties so there are not significant differences between
89'e.ncies~ Additionally, the legislation a110"ll'5 for charging of
administrative fees to assist in defraying the costs of the Parking
Examiner program.
Staff has participated in meetings of agency representatives in
Santa Clara county and has s-urve}'ed other cities in the area to
detErmine the levels o~ parking penalties and fees. Appendix B
includes a breakdown of penalties and feas for 11 cities in Santa
Clara and San Mateo Counties, as well as six other cities in the
Bay Area. As shown in Appendix B; the ltI.ajcr ity of agencies plan on
a standardized penalty of $25 for ~05t parking violations.
Appendix A reflects the proposed parking pen,:ilties arid fees for the
parking violations associated ".-1 th Califcrnia Vehicle Code sections
and the city of Palo AJto~s Municipal Code. A co:rr:parison of
current fines to pr~posed penalties reflects a reducticr in $o~e
penalties such as parking in a red zone, c~oraqe on the street;
overtime permit parking, etc. and an increase in other violati~ns
such as removal of chalk markings, unla\r,'ful alley parking. parking
without permit in permit area, etc. Staff proposes to maintain the
penalty for overtime parking. the most frequently cited violation;
at $19.
It should be noted that $5 of each parking penalty includes an
assessment that vill continue to be imposed by the StoLe and county
for jail and court construction.
staff is recommending the approval of an additional penalty for
late payment of citations and a fee that would be charged at the
time a request is made to the California Departmr.=nt of Motor
Vehicles (DMV) for associated unpaid parking citations.

vendor (City of Inglewood). A late payment p~nal ty of $23 is
imposed if a person does not payor arrange for a co~rt appearanc~

proposl!!s to inr.:rease the penalty to $25. under AS 408, the late
penalty must b~ paid, cr elM. appointment 'With the Parking Examiner

Approxi~ately 12 percent of all citations issued result in a late
penalty fee.
Under the current procedure, if after 20 days fro~ the mailing of
the delinquency notice, the citation has not been taken care of,
the city requests D~v to place a registration held on the vehicle,
DMV 'Withholds the annual registration until the parking citations
have been paid, OKY currently charges a $3 administrative fee for
each citation for which a registration hold is req~ested. Staff
recommends that Council adopt a $5 DMV registration hold tee (of
which $3 is sent to DMV) to assist in defr~ying the costs of the
Parking E)CaIiliner program. Based upon current figures I staff
estimates that about 1S percent of citations issued result in DMV
registration holds.
Imple.eutation
Pending Council approval of the park.ing penalties and fees, the
proqram guidelines and the Parking E~arniner position, staff will
implement the program on July l~ For about the first three U'lonths,
the Parking Examiner 1Io'ill work a 40-bour-work '.N'ee:K in order to
catch up on the backlog of appointments, This backlog \oI'as created
when the County court calendars through .June 30 ,,;ere filled up t.y
May 25, and staff began makil~g appointments to begin .July 19 fer
the Parking Examiner. Aft6r the backlog is reduced, staff
anticipatE'S the Examiner to ..... ork about a 20-hour ... :eek.
Staff is currently working with the. City of Mountain Vie.... and the
Mid-Peninsula Open Space Park: District 1.n the development o.f
a9reements regarding their use of Palo A.lto's Parking Examiner.
Staff ~ill return to Council for approval of those agreements in
the near future.
Recommendations
Staff recommends that COUncil approve the attached resolution
establishing parking penalties and fees for the month of Juli 1993,
and the attached ordinance to establish t)l.e Parking Examiner
program.

WHEREAS, Assembly Bill No. 408 of the 1931-1992 Regular
Session of the California Legisla.ture eub.stit-uted civil per..alties
established by local parki'lg enforo:"em.ent agencies for-trle pre·
existing system of criminal finea enforced thrcugn the court.s.
W.dEREAS, Aase."hly Bill No. 409 is operati"J€ on and after
July 1. 1993. Parking violation civil penalties together with
attendant late payment penalties j and other related fees and
cha.rges wi 11 be enacted as part of the Municipal Fee Schedule
adopted within the budget ordinance for fiscal year 1993-1994, to
become effective August 1, 1993. In t:te inte::-im, the Council
intends to establish parking violation penalties and charges tor
July 1993, and therefor until the MUnicipal Fee schedule becomes
effeC'tive, if for any reason its effective date should be delayed.
NOW THEREFORE, the CouDcil of the City of Palo Alto does

late payment penalties, administrative fees and other charges set

URGE'NCY THEREOF, TO TAKE EFFECT IMMEDIATBLY
WHEREAS; Assembly Bill No. 408 of the 1991-1392 Regular
Session of the California Legislature eliminated criminal
enforcement of motor vehicle parking restrictions and substituted
civil penalties enforceable through the local agency where the
parking violation occurs.
WHEREAS, Assembly Bill No. 409. is operat-ive on July 1,
1993. In order to replace the cr::'minal penalt ies for parking
violations undet: prior state law and local ordinaoces wit-h civil
penalties, a schedule of parking penalties WJst be effected on and
after July 1. 1993 t and t.he adrnini.e:trativ~ review process for the
assessment and civil adjudication of these penalties which Assembly
Bill No. 408 requires Irr..lst be ir!tplE"mented concurrently.
WHBR..EAS, the arnni:cistrative review procedure which is
required by Assembly Bill No. 408 includes an initial review by the
procEssing agency followed by an appeal before an impartial
administrative hearing examiner. This ad!'!1,inistra.tive review
procedure is hereby authorized and established.
Wf!EREAS. this ordinance is promulgateu as an emergency
ordinance with immediate effect July 1, 19~J~ due to the imminent
effective date of this change in state law. the refusal of the
S~ta Clara CQunty Municipal Court to phase out of parking
violation processing gradually after that date, and t:h'? l..lrgent need
to i.~l~'t'\'Ient. a replacem-ent system of civil parking penalties ar~d
administrative revi.e''III1' procedures.
NOW THEREFORE, the City Council of the City ot Palo Alto

W10.60.010 Parking violationa punishable as
civil penalties. Viol ation of any prav! siorr of
Chapter 10.36, 10.40. 10.44; and 10.4-6 c,f this
Title 10 (hereinafter f"'2ferred to as a "parking
violation") shall be punishable by a civil penalty
(hereinafter referred to as a ~parking penalty~).
These parking penalties, together with any late

payment p~nalties. adrr.inistrative fee. 8nd o~her
related charges shall be established by ordinance
or reeolution of the City Co"uIlcil.
10. '0.020 Notice of park:1.n.; vio.lat.1cJls a..c.d
notice of delinquent parking vlo1atiou.R. The
amount of the parking per.3.1ty appl icable to a
parking violation and the tim~ and procedure for
the registered owner or the lessee or rentee of
the v~hicle to deposit U:e par~ ing penalty or
contest the penalty shall be indicated upcn the
notice of parking violation when it is served by
being affixed to the vel-dele or as other'6ise
provided by law. If the parking penal ty is not
paid within the time and in the rnalli~er stated on
the notice of parking violation l the Police
Department or its d~signat€:d processing agency
shall deliver or mail to the registered owner of
the vehicle a notice of delinquent parking
violation.
10.60~030 Polioe Department review of
parking violations. Within 21 days of the
issuance of a notice of parking violatior; or
wi thin 10 days from the mailtng of a notice of
delinquent parking violation (whichever is later) ~
the person served with Buch noti~e (or that
person' e representative) IT'ay request (by
telephone, in ..... '1."iting. or in person) an
investigative revie'W by the Police Department.
Upon this review, the notice of parking violation
and all penal ties and fees based thereon may be
cancelled if a determination is made that either
the violation did Dot occur, the notice of parking
violation was defectively issued or served, or
that the registered o~er was not responsible for
the violation; however, under no circUfilstances
shall a personal relationship with any cfficer,
public official, or law enforcement agency be
grounds for cancellation. The decision of the
Police Deparr:ment. shall be mailed to the person
requesting review.
10.60.040 Appeal of pazkiZl9 violations to
Parking Examiner. Within lS days from the mailing
to that person of the results of the Police
Department's review, that person ~ay contest
through an administrative review before a ~arking
Examiner by depositing the full amoun;: of th~
parking penalty and a written explanation of the
reason for contesting the parking violation. If
the person served with the parking vi~lation
provides proof of financial inability to deposit
the full amount af the parking violation

Department 1. the requirement for payment of the
parking penalty as a prerequisite to contesting it
shall be waived. If the vehicle is immobilized or
i~pounded for unpaid parking violations, the
re~lirernent for payment cf parking penalties as a
prel.-eq'..lisite t.o contesting t:hern ehall also be
waived.
~O.60.040 Designation and qualifications of
Parking .Exa.DUne't'. The City Manager shall
designate a parldng Bxa..'11inEr having the
qualifications i training, anrj objectivity
necessary to perform the duties of that position.
The parking Examiner's cor..t ir .. ued employtt'l.ec.t I
performance evaluation, compensation l and benefits
shall net be directly or indirectly linked to tr.e
amount of fices collected as a result of decisions
by the Parking Examiner.
10.60.050 Hearings before the parking
~ner. The Parking Bxaminer shall notify the
person contesting the parking penalty of the date
and time scheduled for hearing and provide the
option of proceeding on a written statement or in
person at that time. Prima facie evidence of the
pa.i:'"ldng violation shall be establ ielled by the
Police Department' B production at the hearing of
the notice of parking violation (or a copy
thereof), information from the California
Department cf Macor vehicles identifying the
registered owner of the vehicle, and the decisi::m
of th.e Poli(.:s: Department being contested.
Hearings shall be conducted informally. to be
guided by rJl~s of legal evidence. The ~ppellant
shall he entitled to teslify arcd to present
...,itnesst?s. Upon completion of the hearing, the
Parking Examiner may cancel the ~otice of parking
viola~ion and all penalties and fees based thereon
if a detenmination is made that either the
violation did not occur, the notice of parking
violation was defective~y issued or served, or
that the registered owner was not responsible for
the violation; however, under no circumstances
shall a personal r'2lat~onship wi th any officer,
public Official, or law enforcement agen.cy be
grounds for cancellation. The decision of the
parking Exarr,iner shall be mai led or personally
delive~ed to the appellant and shall be final and
not subject to reconsideration. Unless cancelled
by decision of the Parking Examiner. the parking
penalty and all late charges and fees based
thereon shall b~ collectible as: provj ded by the
laws of California.

The city manager is authorized to set
portion or all of any city-owned parking
permit parking and to issue permits
as provided in this section.
{b} The city manager rnay issue pa:::.'king
per1!li ts upon appl ication therefor a~d upon tr.e
payment cf a fee in an a.rnount to be determined by
the city manager. Such permit shall designate the
parking lot for whiCh it is issued and shall be
affixed at or near the center of the rear bumper
in such a manner that it can be rea.dily identified
from the rear of tl'"Je vehicle for .... hich it is
issued. Such pe~~t may contain such instructions
aoa to its use as r-.ay be deemed appropriate r,y the
city manager.
(c) The city manager shall install signs
adjacent to psrmlt parking spaces indicating that
they are reserved for permit parking only, and the
holder of such a permit properly displayed may
pa'"Ck in any such space on the lot. but only in
such space.
(d~ A vehicle with a permit shall nc~ park
for more than seventy-two consec'.ltive hours in the
same city-owned parking lot or structure. This
subsection shall not apply to official city
vehicles ..
{e} No person who owns or has possession,
custod:r or control of a vehicle shall park that
vehicle or alIa .... it to be parked in any pel."1'Ciit
parking space adjace:Dt: to which there is a Bign
indicat iDg that such space is reserved for pe:mdt
parking only without displaying a valid permit
therefor. This prohibition shall not apply to tbe
use of such spaces d~ring the period from six p.m.
to eight a.m. or on Sundays and holidays.w
SECTIQN :3. This ordinance is an emergency rr.easure
necessary for the itnmediate p:r-eservatian of the public peace,
health, safety and general welfare within the meaning of ~~ticle II
of the City Charter and shall go into immediate effect. The facts
constituting the necessit}' are:
~sembly Bill No_ 408 of the 1991-1992 Regular Session of
the California Legislature becomes operative on cTuly 1,
1993. The Municipal Court of Santa. Clara Coun~y has
refused to phase out its role in processing par-king
violations gradually, as provided for i:l AB 408. In order
to replace the criminal penalties for parking violations
under prior state la .... and local ordinances with ci\;il

penalties. the aa..l1inistrative r~vi€w prot:ess for the
assessment and civil ;idj1.ldication of these penalties which
AB 408 require.s must be effective on July 1, 1993.
