2.1 CITY
The City Manager shall be representa~ive of CITY fer all
purposes under this Agreement. CHAD CE~~LA is de&ignated as the
PROGR~~ MANAGBR fer the City ~~nager, and he shall supervise the
progress and execution of this Agreement, and sba-I! be assisted by
SEAN KE~<mY, the PROGP~~ ENGINEER.
COz..."TRACTOR shall assign a single PROGRAM DIRECTOR to have
overall rt:sponsibil~ty for the pro.gress and Execution of this
Agreement for CONTRACTOR. Valerie Fanniug hereby is designated as

8. SCOPE OF WORK FOR HOUSEHOLD HAZARDOUS WASTE PROGPAM
1. General information
Since 1983, Palo Aila has sponsored Househo!d Hazardous Waste {"HHVO/")
Collection Events (nE .... ents n) for its residems. The Contractor shi.3j] operate
HHVV Coiiection Events in accordance with the schedule listed below from 9:00
a.m. !O 12:00 noon at the Palo Alto Regional V/ater Quality Control Plant
("PARWQCP") at 2501 Embarcadero V.;ay. At these E'.,IentS, arl HHW with the
exceptlon of those materials prohibrted by the Department of Toxic Substance
Control ("OTSC") variance and certa:n recyclablE: hazarco'Js wastes (motor oil,
used oil filters, antifre€7.e, and automobile bat1eries) shall be cul!ec~8d from City
~esider~rs, packaged for shipping, and transported to app~oved Treatment,
Storage, ai',d D;sposal FaCilities ("TSDFs"'j. The HHVJ Program sha~1 be
conducted in compliance with the California Healttl a:ld Safety Code section
25158.1 ("HSC 25158.1"') as amended and permit variances grar,ted by the

1. General information
Under this Agreement, the CCr1tractor shall operate a voluntary Small Quantity
Cumrnelciai Source Hazardous \Vaste Generator Collection Program ("SaCS
Program"') for the collection and mar,agement of hazardous .... .;astes generated
by sma!! quantrty commerclar SOI..lrces.
The sacs Program shall be opera~€'d by the COr"ltractor in conjunction wi::r, but
separate from the HH'N Prcgram.-T~e O:)ntractor shall operate the sacs
PrJgrarn ir~ cornplial1ce 'Nrth all federC:~J state, and locar !a\l\.'s, r€gulations and
ordinances, including bLJt not limited to, HSC 2S 158.1 as arr.ended, Tne sacs
PiOQram shall only pruvide hazardous IIVas,e co~iectior;, transport, ,nanagemBnt
and dispasaj services for those businesses vvithin the PARV'/QCP service area
as defined under Section 4.2 of this Agreemen: Walo Alto, East Palo A:!o, Los

and 4:00 p.m. or such other time periods app~ovcd bv the Program Manager
on the same days of the week as the HHW Program Collectiori F.vents,
Quarif~ed businesses shall be required by the Contractor to airange
appo:ntments with the CO,ltracror for participation ir: the sacs Program.
The service area for the sacs Program shalJ i.1ciude the comillunities of
Palo A!::c, East Palo Aito, Los Altos, Los Altos Hilis, Mountain Vie .. v, and
Stanford.
5. Requirements fOj ParlLl;jQltrJ.t,s
The Contractor shall only allow approprlately qualified businesses within the
]urisdictjons !:s!ed fn Sectic!1 CA, vvh!ch meet :hc d€fin1tiOIi of a "smaH quantity
comrDerciaf source" as defined in HSC 251 58.1 [d). as amended. to participClte
in the SQCS Program. The Contractor shall be sole!y re5ponslb~e io vf':rify
smarr quantity commercial source status of arl participants,
6. Fees
The Contractor shai: be soJely responsibie for reCOVering ar; sacs Program fees
and costs from the Program participants, subject to the Jimitations set 10rttl
under HSC 25158.1; as amended. The City expressly disclaims any
responsibil'lty or Ilab'll'lty for payment of The cost of operatlng the sacs
Program. The Contractor is authorized to co!~er.t fees on a CDst-re::overy baSIS
from the sacs Program Participar:l.s for services rendered at 1h€ time of

inspection, review, and audit by representatives of "the PARWQCP jurisd'~crior"l
during normal business hours throughol:t the term of this Agreement for a

8. .M.on7.Dl'Y Event Summary Report
A Monthly Event Summary Report shall be prepared and submitted by the
Contr3ctor to the Program l\r1a0ager within rwo \2) weeks after each sacs
Program Collection Event. Each rE:port shan jnG!u~e, at a mJoimum, the
following:
8.8 Name, Federal Environmental Protectlon Agency hazardous waste
generator identification number (as appJicablel, address, and telephone
number of each participant served by the sacs Program hereunder;
8 b Volumes and types of wastes col'ected from eacrl suer, parricipant by
the Cor.tractor;
B.c Fees charged to each such participant by the Contractor;
8.d Volume and types of wastes collected by DOT Hazard Class; and
8 .• Copies of all uniform hazardous waste manifests, bills of lading for
nonhazardous wastes corrected and managed tr~rough the sacs Program

co"ect'on programs to accept hazardous wastes gener~tPd by S~al1 Quantity
Comercial Sources (SQCS). Tne HealH irld Safety Code cef;r:es SQCS as
busioess~s ~hjch generate less than iOO ki1D~ra~s of hazardDus waste per
month. SQCS business~s are required by State ir\.j Fe,j2ral 1 <:\'0<{ to approprl.:t€1j
manage their hazardous wastes, howeve~7 enforcement of these requirements is
limited b~cause there are no requ1reroents for SQCS b~sjnesses to register ~j!~
the State as hazardous waste g~ner~tQrs or report their hazardau5 ~aste

The site is located in a seismic nea of high risic, subject to Violent
earthshaking and potential liquefaction in the event of an earlhquak€. T~e
wastes will generally be received in sealed conta1~er5 a~d will be segregated,
packaged and shipped off-site for disposal which wlll 1 imit the period of
exposure of any materials. Th~ storage and temporary containment area are

explosio~s resulting from improper collection, handling, packaging or
transporting of the hazardous wastes collect~d at the PARIoiQCP. Due to tM>?
l1m~ted quantities of hazardous waste (Tess than 100 kilograms per businesses
per month), the risk of spills, fires, release or explosion is considered
minimal ~ith the positive benefits of proper collection and disposal cf the
hazardous l\Iaste more than offset i ng Ute n:i ni mal increase in ri sk.
Proper program operation including desig~, equipment and personnel train1ng
will minimize potential hazards associated with an sqcs collection progra~.
Appropriate ~perational consideratjo~s including screening of wastes during
arrangement of appointments and during deliver.v to He colTectio"1 site, site
iayout to facnitate segl'egation of hazardous wastes, and use of adequateiy
trained staff and proper equipment .in minimize the potential for such.
hazards.
Operation of both the H~~ and SQCS colrection programs are subject to
operation and health and safety requiremerlts mandated by tMe Cal ifornia
Department of Toxic Substances Control (DTSC). The DISC specifies opera~'0~~'
criteria to ensure these collection programs are operated to protect hu~an
heaTth and the envirDnment. Both programs ~jll handle essentially t~e Si~2
types of wastes and lIIil1 be subject to D"TSC regulatory rcquire;;;.er.ts, Palo
Alto has operated its J1KW program since )983 without a single accjdent
reported. An equivalent record exists statewid~ for all colTection progre;,m
of this type including e number of sqcs programs.
