Discussion Qf the Joint Powers Agreement
The Joint Powers Agreement provides a mechanism to addx __ ess the
capabilities requ.ired to l-espond to and effectively handl~ fire and
resc\."e sit'l,.;.ations in the foothills area ~hich. adjoins Palo Alto and Los
Alt.os Hills. By sharing resources, Palo )l.~ltc will realize a small
reduction in overall expenses, ~hile all part-icipating ~,e.>:r..bers will
obtain an incre.3.sed availability of staffing resoux'ces d ..... ri:-:g emergency
operatior'~s .
The management of the jClint program is detailed in the attached Joint
Powers Agreement along with methods by which administrative, operat.ional l
pol icy and decision making authority will be handled by each
jurisdiction.

THIS AGREE!4ENT is made and entered into on
199.3. by and between the City of Palo A.!t.o, a chartered m1J.nicipal
corporation of the State of California ("palo Alto~} and the City
of Los ~tos (·Los Altos~) and the Los Altos County Fire Protection

WHEREAS, the parties have det.;:rmined that there is a
rrrutual need for a joint staffi.ng of the City of Palo Alto Fire
Station Number Sj and
WHEREAS. the parties desire to enter into an agreement
pursuant to Chapter S. Division 7 ot Title I of the California
Government Code~ commencing with Sectio'n 6500 {the 'IJPA law~ l,
authori~ing the joint Exercise of powers for the operation of a
jointly staffed fire station; and
WHER~~ Palo Alto and Los Alt.os tnaintain and operate
separate fire protection organizations wit.hin tt.eir respective
boundaries; and
't."HBREAS. Los Altos cont.racts with the District to provide
fire protection oervice8 to the area within the bouudaries of the
Districti and
WHEREAS, Palo Alto and District have contiguous
boundaries and similar fire protection needs; and
WHEREAS. Palo Alto owns and operates Fire Station Number
S loc:ated in the Palo Alto Foothills Park, 3300 Page Mill Road,
Palo Alto. This station is staffed on a seasonal basis (fire
season) during the s\unmer. Normally~ the fire season begins cn or
about June 1 and continues through October 1 of any given yeari the
fire season may begin earlier and continue through November of any
given year. The parties propose that this: station be j ointl.y
staffed for the 1993 seasonj and
WHER..EA.S. Palo Alto, Los Altos and Di;;trict wish to
cooperate in the joint staffing of Palo Alto Fire Station Number S;

NOW, THEREPORS, it is agreed by and betwp.en the pa.rt.ies
hereto as f~llows:
1.~ One employee h:om Los Altos and two frO-ill Falo Alto
will be assioned to Fire Station Nillnber 8 on a 12 hO'..ir basis
C8: 00 A.M .. 9: 00 P.M.) when the fire danger rating is lcwjrr.e:c_ium/
h.igh. Wh~n the tire dange:::: rating is .extreme, the staffing will ce
increased to two (2} Lo& Altos err.ployees ana t ... ,o (2) Palo Alto
arnployees on a t~'enty-follr hour basis.
;2. Los A~tos emplc,yeee will be under the command ar..d
Bupervision of the Palo Alt.o officer 3.ssigned to FirE Station
N·.unber a.
3. District will pay the salary(s) of the LOS Altos
employee (s) assigned under this agre~ment. Los Altos will provide
District wit.h all invoice reflecting the persor.nel assigned,
including dates and hours. This invoice for payment will be
forwarded DO later then the fifteenth (15) of each month that this
agreement is in effect, begirming the month that this agreereent is
authorized. Salary under this agreE'_'nent is the hourly overtime
rate for a Los Altos Firefighter/Engineer at -B~ Step.
4. Each party shall continue to provide all applicable
employe~ benefits far its respective employees assigned under this
agr~ement, in:cluding ,,"orkers' compensation covBrage. Each emfrlayee
assigned under this agreement shall continue to be subject to the
personnel rules and regulations of his/her respective employer, and
with any labor contract to which he/she is a party.
5 _ Pal-c· Alto; Los Altos and District agree to prepare
a. .. d utilize ar. QPERATIONAL LEITER OF l.~T1ERS_T~_J_:N"§' to derine a~'tual
pr.actices and procedure;; of this agreement. The respective fi-roe
chiefs of the aforementioned jurisdictions may modify t:he
QPER.ATIQN&....~_ETTER OF UNDERSTANDING based on the best interests of
all parties.
6. TERM. This agreement shall be in effect for a
period of seven (7) months from the date herein above written
unless sooner terminated by ei~her of the parties giving to the
other fifteen (15) days written notice of such ter.rnlnation.
7. Ear::h :;.arty agrees to indemnify. defend and hold
harmless the other parties, their officers, agents~ and employees
frore any and all derr~ds~ claims, or liabilities of any nature,
including death or injury to any person. property damage or any
other loes, caused by or arising ouC of the performance or ~ailure
to perform this Agreement.
