The frontage of the property along Page Mill Road is d.siqnated as a scenic roadway in the comprehen&ive Plan. Further, Ordinance No~ 2~87 requires a scenic corridor setback of 200 feet from the front prope~ty line along the Paqe Mill Road frontage. A va.riance is reql.lired because portions of the. resi~ence and garage as well as the entire retaining wall would be located within the scenic corridor setback (see the attached setback map). Description and analysis of the project are contained in the attached April 23. 199) staff report to the Planning Commission. funning Commission AcJ-ion The Planning Commission, at its ~eeting of April 28, 1993, voted ~-1 (Carrasco, no) to recommend City Council adoption of the n~gatlve declaration and approval of the requested site and desiqn application and variancei and modification of Condition 10 to requir~ that ~~e landscape plan include only native pla~ts. Minutes of this meeting are included in your CouDcil packet. findings and Conditions The findings aDO conditions recommended by the Planning Commission are shown below, ~ith Planning commission additions appearinq in italic. That the project, as conditioned, ~ill net have any signi~icant environmental imp~cts~ i~ that the project is designed to minimize grading, visu~l impacts, and disruption of site soils and to retain existing trees; 2. There are exceptional or extraordinary circumstances or conditions applicable to the property involved that do not apply generally to property in the same district in that the ~ajority of the buildable area on the property is within the 200-foot setback. The remaining portion of the property is coyered by mat~re oak trees on steep terrain; 2. The gra!"Jtinq of the application is necessary for the preservation and enjoyment of a substanti~l property right of the applicant, and to prevent UMrea$onable property loss or unnecessary hardship in that compliance with the 20D-foot setback ~ould require that CMR:297 :9) 5J13)93 page 2 - the majority of the buildir-g site tie locdted in a grove of matur~ oal<: trees .. hich w'Juld require significant tree removals and ~ould expose the building to a greater tire haz~rd. A building pad in this area would require a much larger amount of cut and fill to obtain a level building pad, thereby increasing the danger ot soil erosion; and 3. Due to topography and existing mature oak trees which cover a majority of the site, the area of the sjte 'Where the improvements are propcsed is not highly visible from the existing residences to the north or east. BY placing the buildinq pa'::'"tially belo,-, grade, the building profile was lowered to minimize the visual impacts from Page Hill Road and the nearby residences to the '-'est. Generally, only the driveway. lower portions of the retaining wall and portions of the slate roof and vertical wood siding on the residence and garag-e would be visible from Page Mill Road and the nearby residences. Conditions L '!'he new residence shall meet all pertinent requirements of Title 24, state Energy Code. 2. A detailed grading and drainage plan shall be submitt~d to the Department of Public Works for review and approval prior to issuance of a building permit. Excavated fill shall be placed in such a manner as to ~e$emble natural contours. All roof drains shall o~tfal1 to paved surfaces or drainrock, or other protect~d a~eas, approved by the Department of public Wo~ks. Cons~ruction details for the percolation trenches shall ce submitted with the detailed drainage plan. 3. All topsoil from areas to be graded shall be removed and $tockpiled f~r re-Use after grading is completed. 4. Graded slopes shall be stabilized by re5eeding with a rye grass/wildflower mix and use of staked jute mesh (flame proof ~OO percent biodegradable). 5. The project soils engineers will be required to certify that the grading was done in accordance with their recommendations, prior to finalization of the building permit. 6. The. revised plan shall include the common and botanical names of all species used, number, size, type, location and spacing of all plant materials~ The plan shall also include specifications for maintenance of the existing oak trees during construction and recommendations for soil mixes or other measures needed to ass·.."re adequate and continued coverage of denuded slopes. The approved landscape plan shall be installed prior to October 15 of the construction year. Tree Remo .... tl: The applicant pr0poses to remove an existing 8 inc~ multj·trunk oak tree which is in good condition. lhe tree is located at th~ western edge of the eXlstlng oak 9rove adjacent to the proposed residence. The applicant proposes to remove the tree in order to minimize the visual i~pacts by locating the house as far aW~J from Page Mill Road as ~Gssible. The applicant also proposes to 5electively prune the oaks ~jthin lDO feet of the house to reduce the amount of flammable material. Visu_a1 Impacts: Sight linE! studies were performed by the appTicant to determine the­ potential ~isual impacts (see the attached photo analysis). The appli~ant placed poles and tape on the site to simulate the proposed residence. Photograph:; wen: taken at 15 locations both on and off of the site. Due to topography and mature oak trees which cover a majority of the sitE. the area of the site where improvements are proposed ~s not highly visibTe from the north or east. Although home) are located t~ the r.orth and east, the existing topography and oak trees ..... ill largely screen the proposed house from the n~ighbor'n9 residences. The Transportation DivisIon reviewed the rewlsed driveway alig~~ent and finds it to be acce~table. Although the sight distance for ~ehicles exiting tne drlveway is limtted primarily by tw~ large pine trees near the southern property line, there are mlt'gating circumstances. Tne driveway approaches Page .l1ill Road by heading sOl.!th, then turning right ('.IIe::;t) to meet the road. Thus, a driver would be facing ol1coming northbound (downhill) Page Mill R030 t'r-affic before reaching the edge of the roadway. This prol{id-es t'"O W'indows of siQnt ~f oncoming traffic. A driver could se~ approac.hing traffic up to approximately 25D fe€t thrcugh this Window (the minimum safe stopp~ng sight G15tance is 225 feet). Th~ second lliindow occurs it the edge of Page Mill Road, wnere tne sight distance is approximately 170 feet. A condition of approval would require the applicant to clear the vegetation around the bases of the pine trees along Page r-'Iill Road in order to maximiZE the sight distances. Dr; vewav Surface Mat~rJll The applicant has proposea' a gravel driveway. However. pursuant to the Llnifonn Fire Code. the conditions of approval would require a pa\led surface. The proposed lot coye~age (i .E., ~ith a gra~el dri~eway) is 6,087 square feet (1.5 percent of the site). The p~opcsed driveway would cover E,957 square feet ~hfch would increase the lot cD'o'erage to 13.044 s~uare feet (3.3 percent of the site). This would meet the Zoning Ordin~nce requirement which restricts lot cQ\lerag€ to a rnuirnum of 3.5% of the site. Drainage; The majority of the sih drains toward the northeast intu Adobe Creek.
