May 6, 1993 THE HONORABLE CITY COUNCIL Palo Alto, California Resolution Ratifying Approval and Execution of the Agreemen~ AmOng the Bonneville Power Administrlltion j Certain Mev.bers of the Northern california Power pgeney and thD City of Palo Alto Members of the Council~ Report in Brief: The Bonneville Power Adlr.inistration ha.s requested that each signatory to the contract referenced in the attached resolution provide a formal resolution of the regulatory body authorizing the execution of said contract. Discussion: ~he attached staff " report, CMR 497:92~ ~as for the purpose of authorizing the Mayor to execute the referen~ed agreement. Council approved this action by motion and unanimous consent on November 9~ 1992. Bonneville Power Administration's administrative procedures require that such autho,izations be done by formal resolu~icn of the utility's regulatory body. The City Attorney's office has drawn up a resolution ratifying the previous action ot the Council in order to comply with Bonneville's request. AND CERTAIN MEMBERS OF THE NORTHERN' CALIFORN'rA PO",'"ER AGEN'2Y WHEREAS, on November 9, 1992, th~ City Council, by its unanimous consent, approved and authorized the Mayor to execute a letter agreement, form dated June 23, 1992, Ccntract No. DE-MS7;1- 89SP92819, among the United States of America, Department of Energy, acting by and through the Bonneville Power Administration, tl'"jo!:! N~-rthern california Powers Agency I and c.:eI'tain members of the Northern California Po~er Agency, including the City of Palo Aj,to, wllich provides a contractual mechanism for future purchases and salea c! surplus energy, surplus capacity. power exchanges, and otber m~tually agreed to services; and WHEREAS, the Bonneville Power Administration ha~ re~uested the Northern California. On November 9. ~992. the City Ccuncil~ by its unanimous consent~ approved and authorized the Mayor to execute, a letter agreement, ferm dated June 23, 1992, Contract No. DE-~~79- S9BP92S19. by and among the United S~at~6 of ~~erica, Department 0: Energy, acting by and ~hrough the Bcnnevi~le Power Administration, the Northern California Power Agency, and certain IT',embers of the Northern California Power Agency, and such consent and approval is hereby ratified. ~~~ The City Council hereby finds that the action taken herein does not constitute a ~projectW under the california Environmental Quality Act, and, therefore~ no environme~tal assessment is required.
