No budget amendment is necessary. tsacxqrDund In the past, the City has issued a Request For proposals <RFP) for banking services and safekeeping services every three years. Tne last RFP for banking services .... as issued in 198'9. The City received proposals from eight banks. and ul tirnately selected security Pacific Bank. The city and Security Pacific signed a contract for three years. In early 1992 Bank. ot A..llerica and Security Pacific merged. Thus, Bank of America took over the City of Palo Alto bank account. During most of 1992 City staff and Bank of America staff have been working together to transfer the City's seven accounts to the Bank of AlPerica system. The Securiti' Pacific contract. nolol a Bank of Aaerica contract, expires on December 31, 1992. For safekeeping services, in 19139 steff recommended and Counci 1 approved a contract with Bank of California tor one year ~ith the option to renew for an additional two years (CMF.:494 :9). 'l'he contract cost was less chan $5,000 per year t and .... 'as renewed for t~~ years. This safekeeping services contract e~pires on November 3D, 1992. CMR:533:92 ". o 1l __ nLQt_Amer.ica Exten!!ion thro\!!.gh 1993 Staff recommends that Council approve extending the Bank of Ameri~a contract for one year (January 11 1993 -Dece-rnber 3L 1993) in order to give staff time to complete tl"le tran~ition from the security pacific system to the Bank of Merica system and properly evaluate the services of Bank cf America. In late 1993 staff ~ill conduct a RFP selection process and deter~ine if the City should remain with Bank of America or choose another bank instead. The conversion from one bank sj'stem 'to eJlf'!other system i $ a difficult and time-consuming ptoce~s. Bank systems cover deposits, checks, reconciliation, t~ansfer instructions, payroll transfers, cash handling procedures, computer information s~stems, armored carrier instru;:-:t.ions, and legal contractsj all must b~ updated~ This process involves t~e Finance Department, Information Resources DepartmentJ ci't-y Attorney"s Office, and all City locations that handle cash. As a result of the extensive changes, ic is difficult to evaluate the level of service provided by Bank of America until months after thg changes are completed. Staff ...... ould like to evaluate the level of service from Baruc of A.Inerica durir.g 1993 ~ It is important to not~ that ~hen staff reviewed the b~nk propos~ls three years ago, Bank of Ame~ica wa$ chosen as the number two bank after security Pacific Bank. Thus, staff thinks it is appr~priate to stay with Bartk of America for calendar year 1993. cost of Servioe Bank of America has agreed to provide banking sendees at a competitive rate. Bank of America staff has irl'orked .. dth City staff to change operations in order to save money on the new contract. One example of the savings is the change from making deposits at the local branch to making de.posits at the Sar. Francisco cash handling location (still through the ar:r.ored carrier) at an estimated savings of $7,775 per y~ar. 8ased on information provided by Bank of Ar.erica, staff believes that the contract extension (Attachment A) 'With Bank of Arterica ..,ill resul't. in costs which are approximately equal to tbe old Securit.y Pacific contract. Bank of P..l't'.crica estimates t..he monthly cost to be approximately $4,875 co~pared ~ith the Security Pacific charge of $4,960. The City :may pay for 'banking se.rvices in a variety of \o/'ays. One method is to leave funds -..'ith the banK, so the ban}: hC\s use of the funds. The city loses; the opportunity to earn interest. This is referred to as ncornpensating balances n . The bank currently estimates a need for Sl.7 nillion of cOQPcnsating balances to pay for the cost of services to the City. The other roethud is ~o ~rite a eheck for the cost in lieu of the conpensating balances ~ethod, CMR:533:92 2 1 ;1 ~- I 1 , o in this case $58,500 per year ($4,875 x 12). Staff has historical­ ly paid for banking services through compensating balances. In the 1992-93 hudget, $2,000 was budgeted in the Treasury Division for ~ny costs beyond the compensating balances. staff has performed extensive research on the choice between compensating balances and cash payments. In a June 1'991 stUdy covering July 1990 through March 1991, as well as in a March 1992 stUdy covering April 1991 through December 1991, staff concluded it wa'S best to pay for most services through a co:r.bined oethod which incorporates the conpensating-balances-and-budget method and the cash payment method {a very small amount to pay for any services not covered by corupensating balances). BaD'k of California ExtensiQ_L~hrou9h 1'93 Staff has also negotiated an extension through December 31, 1993 ~or s~fekeeping services from th~ Bank of California. This will allow staff to issue an RFP for both banking and safekeepinq servjces at the same ti~e in late 1993. The Bank of california has agreed to continue to provide safekeeping services for under $5, 000 per year. This amount is already in the Finance Depart·~ent's 1992- 93 budget. staff requests that Council approve the attached resolution which authorizes the city Manager and any de:signated representativo:!, including the Director of Finance, the Assistant Director of Finance and the Treasury Manager, to sign the attached contract with Bank of America. staff also requests Council to authorize the same staff to sign all additional documents required to enter into a bank.lng service agreement -with Bank of America for January 1, 1993 through Dl;!cember 31, 1993, to be paid using compensating balances and a cash pZyn'ent (if neCeS5-3.ry). staff recommends entering into a contract not to exceed $5,000 ~ith Bank of Califcrnia for safekeeping for December I, 1992 througb December 31, 1993. Attached is an updated version of my August 10th Jetter which in<orporates tP.e agreed upon changes to services including the City's rejection of our ideas to do the followinB' • eliminate the Returned ltern account; • link the Returned hem and Depository accounts with a ZBA; • use of our personal computer base<!: wi!e 'Service rather than of our l\foney Transfer Cf!nter~s 800 number; as well as the City's instructions to institute the following changes: • replace Deposit Reconcilement and Partial Ac.col.lnt Reconcilement v.ith Electronic Reconcilement; • consolidate the Concentration, Accounto; Payable and Payroll accounts; • eliminate the Parking Citation account; • eliminate paper wire confirmations; and • use the San Francisr:o Cash Vault to process deposits rather t.l-tan the branch. The Terms will be as follows: • Pricing is committed fr,.rough December 31, 1993.
