This r~port forwards to Council a recommendation by the Planning (omm~s5fon to
revise the text of thc Public Facilities (PF) Zone District to allow retai1
services and eatir.g and drinking services is a conditional use in the PF zone.
Background
On february 24~ 1993, the Planning (omm;ssion on a S to 0 ~ote~ with
C~issioner Ojaklan absent, reco~nded that the (ouncli approve a text
amendment to the PF zone to allow retail services and eating and drink;n~
services as conditional uses in the PF zone. The attached Plann1~9 Commission
stiff report provides background infornati on and t~e draft ordi nance.
On a 3 to 2 vote, the Planning Commission 8150 rEcommended that staff prepare
guidelines to clarify what retail senic:es \ll'ould be al1o'Wed. ThE major!ty of
the Commission was concerned with un1~ztera'il op~n1~g t~e PF zone to all
types of retail uses d!'1d recolMlended that staff prepare guidelines to define
th~ type and extent of retail services t~at would be allow€d. Commissioners
Beecham and Schmidt felt that it was premature to deye10p guidelines. since
the type of r~tail proposals that might be requested was ~nkno~.
COITITIiss;oners Beecham and Schmidt felt tha.t the conditional IJse permit
process, which requires a hearing befm'e the Zoning Administrator and is
s.ubject to appeal to the Plarming torrrnission and' ClJunct1, was a suffiCient
s.afeguard~
Staff does ~ot object to the assignment for prepa~atl0n of guideiines to
further define the extent and u~e of r~tai' services in the PF district.
Staff doe~ not expect any s'igTlif~c.ant proposals for retail services. in the PF
zone in the near future, and would not consider this ite~ a high priority.
Staff COncurs with the Planning Corrmission minority that some experie!'1ce with

This report forwards to the Cc~jssion a proposal for a text amendment to the Public
facilities (PF) zone district, Chapter 18.32 of the Palo Alto Municipa1 Code. The
amendment will allow o(cupancy by retail sery;ces and eating and drinking services
pursuant te appro~al of a conditional use permit, pro~ided t~e retail or eating and
drinKing 5!nice is in conjunction with a p£rm~tted use.

Selfera.l recent projects and inquiries to staff have suggested that the prO'Jisions of
th! zoning ordinance fo-r al10lling retail services and eating and drin,ldng services in
the PF zone should be reviewed. The proje-:; "'ave included the Urban Design Phn,
which encourages vendors and pushcarts on , :.iic hnds such is the (h'le Center
Plaza~ the recent installati~n of In espresso pushcart at the Cultur~l Center, and
the proposed r~-use of the Rhona Williams prQP~rty. Inquiries have included
proposals frocr private vendors to Lltilize! Civic Center PlaZi for the placement Qf
pushcarts, and proposais for pushca.rts, cafe, magazine stand or other 1 H.e servlces
at the Palo Alto CalTrain stations.

Currently the PF zon~ district allows retail ~2ryjce$ as a conditional USe and only

Some retail and eating and drinking services currently exist as a permitted use where
the facility is owned c·r leased a.nd operated or used by the City, the County of Santa
Clara. the State of California, tf1e gO'o'ernment of the UnitEd Sta.tes, the Palo Alto
Unified School District, or any other governmental agency_ An example of a permitted
retatl use is the espresso cart at the (ulturil Center, which is bath leased and
oper.ted by the City_

No Significant impacts were determined to result from the project and an artJerded
negative declaration has been prepar~d (attached).
By revising th~ conditional use pro ... ~sions. to conditionally allow retall ser ... ices and
eating and drinking services in conjunction .. ith a p-ennitted use, the City. through
tt'te Zonin9 Ad1T.inistrator, will e.'(ercise controi o'l'er the location, siting, size and
extent of retai1 and eating and drinking seivices. Staff does not support i limjt~tion on the amount of square footage devoted to retail or eati~g a~d drinking
services because such facilities as the University Avenue Palo ATto CalTnin st.ation
could appropriately utilize all of the existing station buiTdi!1g for retail or eating
and drinking services. The train station, however, should retain a PF lone district
deSignation since the primary l.'se of the site and facility would be the train platfo,"".
If this provision is a~opted, it is anticipated that in the very near future city
staff will receive proposals for placement of vendor ~art(sJ on the Civic Center
Plazi. For proposals to locate pushcarts, the Zoning Administrator has indicated
that she would use the same standards for review as applied to otner pushcarts allo~ed in the downtown area. For example, oniy food, beverage and plant sa12s are pe~itted and approprlite clear d;stanc~ around the pushcarts must be maintained.
The d~s.jgn of an.,'t pushcarts, as well as any iarger facl1ities, wo~ld be subject to
review by the Architectural ReView Board and other review bodi2s, as requir2d.
