This report recommends that council approve the attached permit to
be issued by the Joint Powers ~oard (JPB) , which authorizes the
city and its contractor, Granite Con6~cti~n company, to finiSh
cons.truoting improvements in the railroad right-of-way in the
viCinity of the East M~adow Drive railroad crossing.
Background
on october 17, 1991, council awarded a contract to Granite
construction company to construct improvements to the Alma
street/East Meadow Drive intersection and approved a resolution on
December 16 z 1991 adopting an aqreement with the Calitornia
Department of Transportation {Caltrans) ror railroad improvements.
On March 16., .1992, Council approved an agreement with Southern
pacific (SP) and the Joint Powers Board (JP8) for the installation
of automatic pedestrian gate signals at the Alma street/Meadow
Drive railroad crossing.
Discussion
Ir.itially, Granite construction Company began constru.c~ing
improvements to the Alma street/Meadow Drive railroad crossing in
ootcber 1991. '".t that time Granite had to obtain a right-of-,entry
pe=mit with SP prior to working in the SP right-ot-way. Granite
compl-eted approximately 95 percent of the improvements, but "Was
unable to finish installing the chain link fer.ce and side'Walk
patching until aft".er SP installed the wa.nting devices and
pedestrian qate$. The warning devices and pedestrian gates were
finally installed by SP in AuquGt 1992. The City is now requiring
Granite Construction Company to tinish the project.
To enter the railroad right-of-way and complete the work, Granite
must obtain a new right-ot-entry permit (see attachment) with both
the JPB ~nd the City to comply ~ith new JPB requirements. The JfB
has only recently requested a three party right-oi-entry permit.
This permit authorizes the City~s contractor to install a fence and
patch sidewalk holes which currently are filled with temporary

asphalt concrete. J~ addition} th~ permit requires the City to pay
$90~ for the p~rmit application fee and to pay the reasonable cost
or a flag-person and inspector for 2tpproxim~tely one ..,eek of
con5t~Jction. staff estimates that the total cost for the permit
tee, £lagper50n, and inspector will be ~pprokimately $2,000.
Future Actions

implement L~y special protective or safety measures. Licen.or

obligation to comply with all applicable laws. If any flagman or

Pro~rty _ithout the prior writtan approval of Licansor~ Since
there is the poslibility ot the existence of pipelines or other
structures beneath the Property, it Licen.ee intends to exc&vate
or drill, prior to doing so, Licen~ee shall take reason~bl~ steps
to insure that any underground 8tructu~es are not damaged.
Abse~ee ot markers does net cQnstitute any ~arranty by Licensor
of the absence of 5ubsurtace installation5~ All risk of 105&,
d6ma98 or liability for injury or dam~qe to any person or
property, including the Licensor and its ~mployees, agents,

(i) No substantiel amounts of hazardous materials
shall be handlea at any ti~e upon the property unl~se Licensor
receives prior notitica~ion.
3. Rastrigticns. Licensee shall abide by th.
tollowin9 restrictions in pertorminq the Work and/or while O~ the
Property:
ca) Except at existing public crossinqs, no
Vehicular crossing over any track on the Riqht ~f Way shall be
inatalled or USea by Licens~e without the prior written consent
of Licanscr and Operator.
(b) No work shall be done between the hours of
6.00 p.m. and 6:00 a.~., nor on saturday. I Sundays or legal
holidays without the prior written consent ot Licensor and
ap.rator.
(c) No work performed by Lice~see shall cause any
interference with the constant l continuQus and uninterrupted use
of the tracks, property and facilities ot the Licensor cr
Operator, its lessees, licensees or oth~~. unless reason&bly
connected to the Ecope of this Aqree~ent permitted in this
Agreement, or specifically authoriz~d in advance by Operator and
Licensor~ Nothing shall be done or suffered to be done by the
Licensee at any time that ~ould in any manner impair the safety
of the railroad op.srat:ions of Lice.nsor a.rld Operator.
Cd) Any lar~e open holes shall be satisfactorily
covered at all times when Licensee, or its agents, are not
physically 'W'crking on 't.he Property or in the actual vicinity
thereof. Upon completion of thl! work, all holes will be filled
In to surrounding ground level with clE'.an, earthen fill :material
and compacted as required by the principal. The property shall
be left in a neat and s~fe condition reasonably satisfactory to
Licensor.

of Licensee and subject to the terms of this Aqre~,ent.

8. Fiber optics. Licensee acknowledqes that fiber
optic cable is huried on the Property and aqrees to cooperate
with all telecommunications company(ies) involved to arrange for
a cable relocation and to take all other steps nec.&~iry to
protect said cables prior to beginning any Work.
9. Compl.'ianC'E ___ 'With taw. In t.he prosecution of the
Work on the Property, Licensee shall comply with all applicable
federAl, state a~~ local laws. regulations and enactments
atfectinq the Work. The LicensEe shall Use only such ~ethods as
are consistent with 6~fetYI both as concerns the Licensee, the
Operator's agents. employees, officers, agents l and the property

10. Environmental Spills or Pollution. Licensee

to health, .atety, noise, environm~ntal protection, wast~
dispo.al~ and water ~nd air quality, and furnish satisfactory

occur ot any chemical or material identitied, ~tined or
regulated under federal, state or local law aa a hazardous or
