The current contract expires October 30, ~992. Staff used funds from the City Manager's continqency to cover operatin9 costs from July 1, 1992 through October 3(3, 1992. Staff is recommendinq that a contract ..-ith thF!: City of Inglewood be approved for the period October 1, 1992 through August 31, 199J~ Staff also recommends that cash bandling and customer service be retained in-hOUse and recommends council approval of $97,065 for contract and in-house processing costs from october 1, 1992 thr"lJgb SeptemlJer 30, 199). ~ckqround prior to September 15, l~SO, the county of Santa Clara processed parxinq citations for many cities, including Palo Alto. On that date, the Clerk of santa Clara County Municipal Court discontinued this practice. City staff determined that the most cost effective alternative was to particjpate in a joint contract coordinated by the Santa Clara county Executive's Office. The first joint contract was awarded to Datacom systems Corporation, which in turn provided service for six years. In September 1986 'CMR:465~6), a one-year contract was Awarded to Vertical Management Systems ('VMS). The vendor change was pr-ompted CMR: 429: 92 1 ", - o by an antic1p&ted )0 percent savings in cost. During the term of the contract, it vas determined that VMS was delinquent in making payaents tor tines received on behalf of the City. On August 17, 1987, VKS was notitied that its contract was tenlinated for mate~ial breach~ The city filed suit against VMS for the recovery of over $1-50,000 in out.&tancHnq parking fines. A settlement agreement -was signed by V}lS owners on October 6, 1987. The aqt'"l::!elIIent included $20,000 and pledged deeds of trust on the cwners' personal property to secure the debt. After termination of the VMS contraot, Finance Department staff tempora~ily assumed p~rkinq citation processing responsibilities ror an eiqht-mon~~ period, at a cost of $83,000. Due to the volume of citations and lack ot available comm~rcial computer software to support in-house processing, staff eould manage only the initial collection of fin~ ~ym~nt~~ Additional citation processing was put on hold until a new vendor was round. A multi-yeaL agreement was awarded to Datacom Systems Corporation in Karch 1988 {CMR:195~8). Oatacom Systems corporation was later rerlamed Lockheed Information Management Set"Vices company. The contract was renewable annually by mutual consent. The agreement was renewed for a set:',ond year~ However, in August 1990 (CMR:419:0), staff was informed of Lockheed's intention to increase the cost of citation processing by 27 percent for the third year of tbe aqreement. Due to this significant increase, a request for proposal (RFP) process was initiated to ensure services would be provided at a competitive price~ .'It computl1 corporation As a result of the RFP process, the City entered into a two-year agreement with West Computil corporation in August 1990. This agreement expires on October 30, 1992. Under the agree~ent, West Computil was initially responsible for all aspects of processing including collection of fines, issuance of delinquent notices, setting court dates, placement of Department of Motor Vehicle (OMV) regist:':'ation holds and tracking of habitual parking offenders. Approximately 57,000 parking citations are issued each yaar with associ~ted revenues of between $600,000 and $800,OOO~ Due to problems associated with previouG parking citation vendors, staff has closely monitored the West comput,il contract to ensure compliance~ Approximately eiqht to nine months ago, Staff detected service irregularities, questionable cash handling procedures and evidence indicating the possibility of theft by west computil personnel. Additionally, an increase in the number of complaints about West Computil's customer service was observed. Police and Finance Department staff requested assistance from the City Auditor's Office in investigating these concerns. A criminal investigation was also initiated to determine if any theft of city funds had occurred. To date, the investigations by the City Auditor, Police and Fin~nce Departments' staff into West computil's operations have revealed the following, -Theft: The criminal investigation revealed that at least one of West Co~putil employees working i~ the San Jose office has taken cash payments submitted by ci tiz;ens CiS parking fines for tick.eta;;: received in Palo Alto. In excess of $4,300 .... ·as embezzled, involving at least 14 separate parties. The investigation was completed and submitted to the District Attorney's Office on June 25# 1992. A criminal complaint was subsequently filed and an arrest warrant was issued for grand theft-embezzlement for one West Co!!',putil employee. Failure to Add Pena] ties: A citation becomes delinquent 30 days after issuance. A Notice of Del inquent parking Violation must be sent to the registered owner of the ci t~d vehicle within 40 calendar days, if payment is not received or a court date set. If the citation is not handled within 15 days of m~ilinq of the notice, an additional penalty is added to the original fine. A DMV hold is placed on the vehicle's reqis­ tra~ion 45 days after the issuance of the delinquency notice for any outstaneing citaticns. Based on the investigation, it has been determined that West Computil has not been diligent in following this procedure. This has resulted in a delay or loss at payment in delinquent penalty fines and subsequent DM'V holds being placed on vehicl6 registrations. The Auditor's ir.vestigation included a review of a sampling of citations paid between January 1991 and February 1992. A comparison between the amount of payollents received to the amount which shOUld have been paid was conducted. The result ot the comparison disclosed an approximate difference of 15 percent. The difference represents uncollected citation revenue, which was caused by lack of prompt updating of the data in West Computil's automated system. Based on the result of the sample test, it is estimated that, if information in the system had been updated promptly, the City could have collected as much as $101,000 in parking citation revenues. FailUre to Update Records: As previously noted# as an outstanding citation .becomes increasin.gly delinquent, addi­ tional penalties are added~ The Police Department investiga- CMR: 429:92 3 o tion has revealed that West Computil did no~ update their records to indicate the additional penalties due the City for over 1 1 500 citations. When the fine was paid by the vehicle owner, it was paid at the oriqinal fine rate. At this time, it appears approximately $13,000 of City monies were not collected. Additionally, the Auditor's Office reviewed cita~ion5 in west Computil's data base between January 1, 1991 and September 30, 1991 that were in -inquiry" status, The review disclosed that approximately 1,500 citations were in this status, but actually had registered owner information on file. If proper procedures had been followed, de11nquent notices or DMV registration holds would have been placed en these vehicles; and the chances of collecting parking citation revenue of ~pproximately $19#000 to $37,000 ~ight have increased. After west computil was notified of t~Iis problem, delinquent notices were sent.. Some of these funds have subsequently been received. Failure to Monitor Transactions: During the investigation, the Director of Operations tor West Computil discovered that approximately 285 unauthorized deletions/voids of citations were entered into the West Computil system via its computer terminal in the San Jose uffice.. For security reasons, only one west Computil employee is given authority by the City to void. citations. staff believes that a minimum loss associated with these deletions/voids is $4,000. Due to service problems experienced with West Computil, Finance Department staff undertook payment p~ocessing ana customer service responsibilities on May 11, 1992.. Since that time. even more instances of poor record keeping and unacceptable customer service by West Computil have come to liqht~ For example: -Staff has received numerous complaints from citation holders, many of whom a~e unable to register their cars due to West cornputil's failure to updatE. records to reflect paynlent and to folIo .... up by releasing the DMV registration hold~ To maintain proper accolL'ltability, staff must require proof of payment before issuing an abstract to the DMV to release auto regis­ tration holds. Many customers are angry at having to request copies of their checks fro~ the bank and they are requesting that the City reimburse them for the expens-e. The City's request to proviae proof of payment is especially difficult and costly for-custc1!Iers 'Whose banks do not return paid checks to its customers. -The vendor has failed to follow uo on citations that have been adjudicated by the courts. Once-a citation has been cleared, the vendor is required to remove the DMV hold. West computil has~not consistently performed this task. Often the regis- CHR: 429: 92 4 tared owner ~ill pay the DYaV the citation charge, along with the registration fee, and subsequently request a refund froom the city, because the citation has actually been previously paid. The ve;ldor misapplied several paYiIlents. Payments have been incorrectly credited to citations which were issued by other issuing agencies. Staff has had to correct th-a misapplied payments and clear the correct citations. -several payments were incorrectly deposited into a bank other than the Ci.tyl s. Staff has contacted: the aqency which received the bank credit and requested adjustments. Although citations issued afte~ May II, 1;92 have the newly­ established mailing address, the vendor delayed changing the forwarding address on delinquent notices, as requested by statf on .Iay 13, 1992. The change did not OGcur until the end of June 1992. Additionally, the concern remains that notices are not mailed on a timely basis. Since April 1992, manual citations, which are handwritten and deliveI'"ed separately to the vendor, have not been entered into the vendor1s record keeping systEm. This represents approxi­ mately 600 unprocessed citations~ After West Computil was notified o~ this problem, some of these unprocessed citations have been entered into the data base. Some of these citations have sUbsequently been paid. In addition, West Computil has actually lost OVer 70 citations. These citations have had to be rescinded. ID-Hou~. To effectively manage payment processing, two full-time temporary e~ployees vere hired, and the hours of one of the current part-time employees presently working at the Utility P~ocessing Center were extended. Funding of $17,000 for parking citation processing was provided from the City Manager's contingency, for operation through June 30, 199.2. Citations issued by police officers I parking monitors and park rangers previously included instructior,s to mail payments dj rectly to West Computil's san JOSe Citation processing Center post office box. City staff i~ediately took steps to redirect mail-in payments to a post offica, box which was established in Palo Alto for the exclusive use of receiving parking citation paYlI'.ents. Citations issued after May 11. 1992 were addressed with labels bearinq the ne~ly established post office box number. Payments ~ailed to the San Jose address for citations issued prior to May 11, 1992 are retrieved by Finance Department staff twice a week. CKR: 429: 92 5 "~ !o' -. Payments received at the Palo Alto post. office bcx are processed at the City1s Bryant stre~t processing center. All processed payments are forwarded daily by Federal Express to West Computil's Huntington Beach office for data entry into the vendor's record system. West Computil continues to have the responsibility of lIIaintaining recoro:!s of all issued citations and bail forf~itures, mailing delinquent notices, generating Donthly reports and placing DMV holds for non-payment of citations. Walk-in payments are accepted at the Revenue Collections pUblic counter. CustOMers wishing to contest their citations can sc-.hedule court appearances as well. Staff also issues abstracts to release DMV holde, and responds to custo~er inquires ~~de in person, as well as those made by telephone, regarding current citation status and delinquent notices. Cash bandling policies and procedures have been established to assure accountability. The City Auditor's Office has conducted a preliminary overview of the interim process, and has approved current operating procedures for citation payment processing. Staff has processed 15,605 citations from May 11, 1992 throu9h August 31, 1992, and deposited $3)7,94~ i~ revenue. Additionally, staff was able to negotiate a $4,900 reduction in cost per citation charqe with West Co-mputil through a contract amendrnent4 The amended contract is effective June 1, 1992 through october 30, 1992. ~~ed :Interim Proee5_~i1l9 OperOlLtion The current contract with West Computil expires October 30, 199~. In addition, $10,000 will be budgeted tor rent and $6,000 for furniture, supplies , and miscellaneous expenses, for a total cost of $87,000. De~inqu.~t Citations To maximize the recovery of parkinq citation revenue from severely delinquent in-state and out-ot-state cita~ions, it is necessa~~ to contract with a firm that specializes in the recovery of monies from unpaid citations. Parking citation processing firms do not specialize in delinquent and out-ot-state revenue recovery 4 Processing firms limit their production to data processing functions, placing and releasing DMV holds, an~ receiving payments. Collection of delinquent revenue is not an integral tunction of their operations. Recovery of delinqUEnt parking citatio~ revenue requir~s specialized technical and administrative skil14 Data Ticket, a firm that specializes in the recovery of delinquent citation revenue, submitted a proposal in response to tee City's RFP for parking citation processing. Data Ticket has the informational resources, knowledge of state laws, technical skills, and the necessary on-line DMV interface (outside California) capabilities to effectively enhance recovery of revenue from delinquent citation holders throuqhout the cO'.mtry. Their commission is so percent of collections, ~hich is consistent ~ith the industry standard, and reasonable, given the difficulty of the task. Without the assistance of Oata Ticket, the probability of collecting any revenue from delinquent citations is unlikely. Staff estimates that approximatelji 54,000 Autocite citations will be issued during fiscal year 1992-93; and the remaining J,OOO citations will be issued manually. Staff requests authority to issue change orders of up to $5,472, which is 15 percent of the contract amount, for potential legislative ch-3nges, including pending legislation on decri;ninaliz-ltion of parking citations. Costs associated with in-house processing will continue to require fun~in9, it the city is to maintain control over assets and provide customer service. The cost of recoveriny lost revenue fron! seriously delinquent citations is a new factor which is needed to enhance revenue recovery. The estimated current cost of recovery is $12,5-00, or 7 percent of processing cost. However s ongoing citation processinq costs are only $37,000, or 45 percent of the total current contract cost of $79,500 with West computil. ORDJ:NANCE OF THE COUNCIL O~ THE CITY OF PALO ALTO AMENDING THE BVDGET FOR THE FISCAL YEAR 1992-93 TO APPROPRIATE ADDITIONAL FUNDING TO REVEN\lE COLLECTIONS IN THE TREASURY DIVISION OF THE FINANCE DEPARTKENT FOR CASH PROCESSING OF PARKING CITATIONS WHEREAS, pursuant to the provisions of section 12 of Article III of the Charter of the City of Palo Alto, the Council on June 22, 1992 did adopt a budget for fiscal year 1992-93; and WHEREAS, tor two years the city of Palo Alto has contra'Cted 'With West computil Corporation to process parking citations issued in the city of Palo ."1 to; a.nd WHEREAS, diligent contract monitorin9 revealed irregularities, questionable cash handling procedures and revenue through contract employee theft; and WHEREAS, the police investigation of West Computil's tiona resulted in the District Attorney's office issuing an warrant on June 26, 1992, to a West Computil employee; and service l(l$S of opera­ arrest WHEREAS, during the investigation, the Finance Department assumed responsil:lility for payment proc'assing and customer services associated with parkinq citations; and WHEREAS, to continue cash processinq and customer services, additional fundinq is needed for salaries: and equipment in the Revenue Collections program; NOW, THEREFORE, the Council of the City of P3.1o Alto does ORD~N as follows: SECTION l~ 'The sum of Ninety Seven Thousand Sixty Five Dollars ($97,065J is hereby appropriated to the Revenue collection program in the Treasury Division of the Finance Department and the Reserve for Capital Projects is correspondinqly reduced~ ~I.oN 2. This transaction will reduce the Reserve for capital projects from $5,047,649 to $4,970,671 as of June 30, 1992. SECTION 3. The Council of the city of Palo Alto hereby finds that the enactment of this ordinance is not a project under the California Environmental Quality Act and, therefore, no environmen­ tal impact assessment is necessary. ." · ...... o SEC"I'ION 4.
