PALO AI TO YMCA -USE PERMIT A@ VARIANCE REQUEST ~bers of the Council: REPORT IN BRIEF At the meeting of November 18, 1991, the City tQunc;1 indicated its cDncept~al approval of the Use Permlt, Variance and Parking Deferral requests of the Pa10 Alto YMrA. Several amendments were made to th~ original matfon to approve the project in order to re~ise the c~nd;tions of approval. Staff was directed to revise the conditions of approval according to Council direction and return to them for final adoption at the Council meeting of November 25, 1991. The revised conditions of approval are attached to this staff report. STAfF RECO!'!HENDATlON rn addition to taking action on the outstanding motion (as amended) to approve the Use Penni t, Variance and Parking Deferral requests based on fi ndings contafned in the October 31, 1991 staff report to Council (CHR:489:91), there are three additional Hems related to the projec.t which the City Council should take acti{ln on. These includE the follOWing: 1. Readoption of the attached resolution certif.ying the Fi!'1al HR. 2. Staff recommands raadoption of th~ Resolution because the Hitigaticn and Condition Monitori~g Repo~t. ~hich is part of the resolution, was amended to refiect the changes to conditions of approval directed by the Council + Recommendation from the PTanning Commission that the City Council ·direct staff to explore the possibility of requiring applicants to pay a f~e for co~dition monitoring and enforcement purposes.- As noted in the Ctty Attorney's report dated November 6 t 1991 (attached)~ th~ Council can implement such a program by directing staff to pr!pare an appropriite imp1ementing ordinance for future City Councll action. The contents of the report shall include, at a min1mum: documentation of neighbor complaints; results of the regularly schedu1ed neighborhood meetings; the status of complidnce with all condltions of approval and the City Mun'icipal Code; -recommendat ions for any nec2ssary code compl i alice efforts. (c) M~c~anical equipm~nt as~aciated with the facllity shall be designed and specified so that when all mechanical equipment is operating, noise levels do not exceed 40 dBA at property lines. Ho~ever, the City Council finds that this alterrlative wou,d not meet the cbjecti'les of the YMCA to ~xpand and remodel in an orderly way, and continue to provide r€creational and otner communlty services, becal.<:se program areas could not si:nply be reduc~d in seop!, but would rather ha~e to be elimjnat~d in whole. The liaison shall be provided the authority to correct any violation of the use permit conditions and to make every eff~rt to avoid disturbances to the neighborhood. The name and phone number, and any changes thereto, of the liai$on shall be provided t~ the Zoning Ad~inistrator so that the City ha~ continuous notice of the identity of the liaison. (Condition :E:ffective Upon Execution of Use permit) 1.2 The applicant shall schedule regular meetings with the neighborhood, a minimum of one every sjx months. to review the status of compliance with the terms of the use permit, the status of noise an~ disturbance control and the status of neighborhcoa relations~ ~dvance notice of these regular meetings shall be provided to the Zoning Administrator in order to allow attendance by a City representative. Follo~ing the first year of eemi-annual meetings~ the mee~ings may be held once yearly, ~ith ~he consent of the neiqhbors~ (Condition Effec~ive Upon Execution of Use Permi t) 1.1 The applicant shall fund preparation of a ~ritten condition monitoring and operations status report to be prepared annually. The Planning Division will administer preparation of the report by a land use consultant chosen from the City's list of qualified consultants. The YMCA shall post funds: cc~/er ing the costs of report preparation, not to' exceed $5~ 999 ~ __ Ooo for each repcr-t, in accordance 'With the Department of Planning and. Community Environment's Lt.dopted guidelines for technical cons~ltant contracts~ This amount may be i~creased annually based on the Consumer Price Index (all urban consumers, base years 1982-1984=100, for the San Francisco-OakLand-san Jose CMSA, published by the US Department of Labor, Bureau of· Laber Statistics). The contents of the report shall include, at a minilflum; -documentation of neighbor complaints; -results of the regularly scheduled neighborhood meetings; -the status of co~pliance with all conditions of approval and the City Municipal Code; -r£commendations for any necessary code compliance efforts'T".i. -traffic counts Q_n Ro~~_.F..9ad and at the projeqt driveways. Each report shall be presented to the Planning Commission for review at a r.oticed public hearing to be held each year following the date of execution of the use permit. A sound barrier shall be constructed along the full length of the northerly, westerly and southerly property lines. The barrier shall be construct~d to a height of 7 feet and of a concrete or masonry material. If a majority of all adjacent property owners indicate in writing a preference for wood rather than concrete or masonry, the Zoning Administrator may consider allowing such a change. Any barrier co~structed shall be of a material with a minimum surface ~eight of 3 lbs. per square foot~ and shall have no cracks or gaps in or at its base. The noise barrier shall be maintained in good aesthetic condition and in such a manner as to not ~ed~ce its sound attenuating properties~ 4.2 Mechanical ventilation shall be provided for the entire building, including ex~sting areas. 4.3 All mechanical equipment associated with the facility shall be designed and specified so that ~hen all mechanical equipment is oper~ting, noise levels do not exceed 40 dBA at the property line~. The cost of employing such forces and equipment shall be do~bled as a penaltYI and such cost shall be borne by the applicant. OTHER 8.1 Prior to receiving occupancy of the new addition, the YMCA must demonstrate that it has complied with the requirements of Title 17 (Hazardous Materials Storage) of the Palo Alto Municipal Code, including obt~ining a permit for storage and use of pool chemicals, if the Fire Department determines one is necessary. 8.2' The applicant must comply \Io'ith Section 12.32.015 (e) of the City's Municipal Code, which prohibits the filling of new pools, spas and hot tubs with water supplied by the Palo Alto w3ter utility. 8~3 The applicant shall work with the Utilities Department to determine all utility design and capaci~y requirements including 'Water, se'oIier, gas, electric, and phone facilities. This report presents a discussion of such issues, and a recommended ~ra~e~ork for action. 'piscussion A.B. 3180 (Chapt. 1232, Stats. of 1988) requires all state and local agencies to establish reporting or lIIonitoring programs tor projects approved by those agencies whenever approval inVOlves significant environmental impQcts identified by a mitigated negative declaration or environmental impact report. Although A.B. 3180 ~as codified as PUblic Fescurces Code Section 21081.6, the uncodi:.fied portion of A. e. 3180 contained a legislative p=onounce~ent that ~.B. 3~80 imposed a state-mand~ted local program I but that no ,state reimbursement would be required: "becau$e the local agency 4 4 .has the authority to levy service charges, fees, or assessments sUfficient to pay for the program or level of ~ervice ~andated by this act." Therefore, the legislative intent vas to aeterm.ine (it not to formally authorize) that local agencies have the authority tQ require development to pay for the cost of monitoring the environmental effects of the development. Although the Planning Comndssicn TS initial discussion focused on code enforcement, we advised that the City has fewer options 'With respect to code enforcement, and the fl,,;.;lding thereof ~ than 'With mitigation monitoring. The City's code enforcement options are essentially set forth in the Palo Alto Municipal Code, and take the form of administrative, civil and criminal remedies. Due process conslaerations limit the City's ability to require. c~de violators or potential code ..... iolators to fund code enforcement processes directed at them. The area.
