Report in Brief
This report requests that council approve and authorize the Mayor
to exe.cute Alnendment No~ 2 to increase the budqet of consultant
agree%ent N04 C-0013897 with Kennedy/Jenks/Chilton Consultants in
the amount of $21,450 in the third and final year of the agreement,
to conduct new storm water pollution prevention program ele~ents.
Funds are available in the F¥ 1992-93 operating budget for the
storm Drain Enterprise Fund.
Background
In order to reduce metals and other pollutants being discharged
into San Francisco Bay, the Regional Water Quality Control Plant
(RWQCP) has initiated a number of programs to reduce these
pollutants at their source before ent.er-inq the city sewers~ On
September 10, 1.990, Council approved an agretament with }(enne
dy/Jenks/Chilton Cor.sultants (~C) in the amount of $l25,OCO~ to
conduct waste minimization study reviews tor large industries and
public participation activities for small businesses .fac~.nq new
pollution control requirements. The agreement was for a one-year
period Vitll the possibility ot continuing the contract fer two
additional years. Amendment No. 1 increased the amount of the
agreement to '$175, 000 in the second and third years of the
agreement. The purpose of Amendment No. 3 currently being proposed
is to add a storm drain pollution prevention component to the third
year of the aqreement. This component is contained in the attached
addendum to Exhibit A of the agreement4
In the third year of thE agreement, an additional $21,450 will be
required to address the storm drain component of pollutants flowing
to San Francisco Bay~ The first two years of the agreement focused
on pollutants frOTh the sanitary sewer (as oppcsed to the storm
drain) system. A r~latively small proportion (ll percent) of the
FY 1992-93 agreeme"t is prcposed to be focused on ::;tonn drain

system sources of pollution. The money will be used: to develop
inforuational and inst~uctional materials to encouraqe resi~ents,
Bchool children and businesses to prevent storm drain polluti~n.

into between CITY and CONSULTANT for the prOVision of professional
engineering consultant services related to CITY's rr.etals source
reduction program for discharges to the sewer system; and
WHEREAS. the parties may agree to amend said agreement
from time to time; and
WHEREAS, the parties now desire to amend said agreement
to allow for services related to stor.m ~ater pollution prevention;
NOW J THEREFORE, in consideration of their mutual
covenants, the parties hereto agree as follows:
SBCTJQN 1~ The first. paragraph. of Subsection 6.1 of
Contract No. CO013897 is hereby amended to read as follows:
-In consideration for th.e full performanCe of
the Basic Services and reimbursable expenses
described in Section 4.1 of this Agreement,
CITY agrees 'Co pay CONSULTANT a fee not to
exceed one Hundred Twenty-five Thousand
Dollars ($125,000) for the first year of the
term, One Hundred Seventy-fiVE Thousand
Dollars ($175,000) tor the second year of the
term and One Hundred NinetY-Six Thousan~, Four
HUlldred :ti'ifty Dollars (~196. 450) for the third
year of the term of this Agreement.
Notwithstanding the foregoing. CI-rY' 9
obligation to pay CONSULTANT's fees under this
Agreement is contingent on the City Council's
continued appropriation cf sufficient roonies
to fund this Agreement during each fiscal year
of the term.'"
