This report requests that Council approve and a~thorize the Mayor
to execute Amendment No. 3 to consultant agreement NO. C-0014794
with James M. Montgom€ry Consulting Engineers, Inc. for $156,446 to
perform aclclitional work to meet regulatorr requjrements. Funds are
available in the current year's operating budget for the Palo Alto
Regional Water Quality control Plant (RWQCP).
Background
Consultant agreement No. C-0014794 was established early in FY
1990-91 to conduct a number of environmental studies and tasks
required by the Regional Water Quality Cont_'ol Board {Regional
Board). The agreement ...... as eS't.ablished as a one-year ag.reement with
the possibilit:i of two additional }'ears, dependi.ng upon the City'S
needs and budget. The initial agreement in the amount of $141,443
was modi.fied by Council {Alnendment No~ 1) on December 17, 1990,
increasing the first year's authorized amount to $310,443.
Amendment No.2 estaLlished the authorized a~ount ($210,000) for
the second year of the agreem~nt. The ~urpose of Al~endnent No.3
currently heing proposed is to establish the authorized amount for
the third year of the agree~ent.
Piscussion
The FY 1992-93 environmental study needs of the RWQCP, which have
been clearly identified to date, are less than the preceding fiscal
year. More studies may be required in December 1992 .... hen a nel,,'
discharge permit is issued. However, it is necessary to pl"oceed
immediately with currently identified tasks. The key tasks are:

WHBREAS, CITY and CONSULT~'~ entered into Contract No.
CO014794 (Ithe CONTRAC'l'I) for the provl.sl.on of consulting
engineering services to conduct environmental studies for the
Regional Water Quality Control Plant; and
WHERRAS, CITY and CONSULTANT enter-ed into Amendment
Nos. 1. a~-i 2 to the CONTRACI' to modify the scope of work and
compellsat on with respect to Phases II and III of the CONTRACT; and
services

WHEREAS, the parties wish to provide for a new scope of
and additionaJ compensation for a Phase IV of the
NOW~ THEREFORE, in consideration of the following cove
nants~ terms and conditions, the parties agree:

Section 4.1 of the CONTRACT to read, as follows:
-4.1.4 Phase IV of Basic Serviceg. under Phase IV of
the Basic Services. CONSULTANT shall perform the following
tasks described in Exhibit -AI, as ~ended: Best Management
Practices (SMPs) for Machine Shops and Pottery Shops shall be
developed to minimize wastes discharged to the sanitary sewer.
Sample facilit;.ies within the service area of the Reqional
Water Quality Control Plant (RWQCP) will be visited. -ideas
solicited, and the lite:'at.ure shall be reviewed in order to
identi:::y cost effective and reasonable BMPs. The results will
be set forth in \/I'itten conclusions whiCh will be present.ed to
the City. CONSULTANT &~ll proceed with PhaEe IV of the Basic
serv-ices after the execution of Amendment No. 3 to the
CONTRACT and upon receipt of a Notice to Proceed under Phase
IV from the PROJECT MANACER ••

SECTION ~. Pal.'agraph 6.1.3 of the CONTRACT is hereby
amended to read! as follm/S:
'6.1.3 In -:,onsideration of the full performance of
Phases II, III and IV of the Bc:.eic Services described in
Section 4.1 of the CONTRACT, CITY agrees to pay CONSULTM'T a
tee not to exceed one b~dred eighteen thousand five hundred
fifty-nine dollars ($118,559) for Pr4se II of Basi~ Services,
one hundred fifteen thousand dollars ($11S~OOO) for Phase III
of Basic Services, and sixty-one thou~and four hundred forty
siy dollars {$61~446) for Phase IV of Basic services~
SBCTION 3. Paragraph 6.1." of the CONTRACT is: hereby
amended to read/ as f~llows:
'6~~.4 The amount of CONSULTANT' B compensation for
Phases II, III and IV of the Basic Services shall be
calculated as Bet forth in Exbibit ·BI~ as amended, up to the
maximum amount s~t forth in paragraph 6~1.3.'
SECTION 4~ ¥aragraph 6.1.6 of the CONTRACT is hereby
amended to read~ as follows:
'6.1.6 For Additional Service'l. For CONSULTANT's
additional services, as dE:Jcribed i.:l Section ".2 of this
Agreement, compensation shall be as prescribed in Bxhibit 'B',
as amended, but not to exceed fifty-nine thousand four hundred
fifty-one dollars ($59,451) for the first year of the ter.m of
this Agreement and not to exceed ninety-five thousand dolla,rs
($95,000) for each of tee second and third years of the ter.m
of this Agreement.'
SECTION 5. Section 7.2 of the CO~"TRACT is hereby
amended to read. as follows:
'7.:2 TIME IS O~ THE ESSENCE.
It is understood and agreed that t~ is of the
eseence of this Agreement. and that, following execution of
the applicable Amendments to the Contract acd receipt of the
Notices to Proceed for PhaS~8 I, II, ILl and TV, respectively,
CONSULTANT shall commence work un the initial and subsequent
tasks under the Phases I, II, III and IV af the Basil.:
Services, respectively, in acco=d~~~e with the time schedule
set forth in Exhibit 'AI, as amended.-
SECfION 6. Exhibi t A is hereby amended to read in
accordance with the attached 'Exhibit 'Aft as amended.'

MACHINE/METAL FABRICATION SHOPS
TASK 8.1 • PERFORM LITERATURE SURVEY
CONSULTANT shall review available literature on waste rr.ducnon practices of the:
machine shops and metal fabrication industry. Two potential sources include the EPA
developmcmt documents for pretreatment guidelines and the California DOHS Alternative
Technology Section tcports. CONSULTANT ,hall contact EPA headquarte" to obtain
information on the status of \\'on: in metal fabrication and machine shops. All availahle
best management practices (BMPs), regulations, and y/aste reduction .recommendations
,ball be locale<! and provided '0 the CITY.
TASK 8.2 • REVIEW EXISTING INFORMATION
After the literature review, CONSULT A."'IJ' shall meel with ClTY staff to review ex:.sting
information on machine/metal fabrication shops located within the RWQCP service area.
Information 5U':h as the number of machine/meta.] fabrication shops already identified,
r:ypes IUd quantities of wastes generated. and current disposal practices .shaH be reviewed.
Based on the literature review and di:.;cussions with CITY staff, CONSL~ T ANT shall
J1R:pll'e a memorandum summarizing the findings. The memorandum shall also dcflne
what types of commercial businesses belong in the machir~/metal fabrication category_
The definition will become the basis for selecting businesses for evaluation.
TASK 8.3 • INTERVIEW MAC!-fINE/METAL FABRICATION SHOP
OPERATORS

TASK 8.4 -SAMPLE WASTE SOLUTIONS
CONStJLT ANT shall de\lelop a sampling plan to (:oUect two samples from each of the six
facilities visited. It is anticiparM that grab samples wiil be collected. Samples Mil be
collected by CONSULTANT for analysis at the RWQCP laboratory. CONSULTA1'IT
shall utHize the sample results 10 estimate the am;Junt of po!JutantS generated by these
facilities.
TASK 8.5 -CONTACT RELEVANT ORGANIZATIONS
CONSULTANT shall contact chemica! and equipment suppliers, trade organizations, and
reguI~ agencies to delennme the following:
Obtain Material Safe~ Data Sheets (MSDS) to detennine 1l1e mews and cyanide
concentrari.oos of the c~!'I1monly·used c-hemiCills and solutions.
Contact equipment suppliers anG: trade organizarions to de,lermine alternative
chemicals and treatmert systems available.
Detennine the eX!enrs that other agencies (Department of Health Services) (:~ntIy
regulate the wastes from these facilities.
TASK 8,6 -DETERMINE NEED FOR BMP.
Based on the infonilarion developed in Tasks 3, 4, and 5~ CONSULTANT s:lall determine
whether best management practices (BMPs) to control wastes from machine/metal
fabrication shops are necessary. CONSUL TA~j shall subr.1.it a brief (3 to 5 page) letter
ieP<'rt, meet with CITY. review the results to-date, and decide whether and how
machine/metal fabrication shops should be regulated. The applicability of BMPs shall
depend on the foDowing:
Quantity of wastc..i generated by this commercial cau:gory.
Availability of alternative prcxlucts and effective waste reduction measures.
Potential of storm waler discharg~s.
CONSULTANT shall .also identify other institutional arrangements requiring continued
development. These items may include coordinatior: with regulator)' agendes and
development of a hal.lling program for the generated wastes.

It is anticipated that the two meetings ""ill be necessary in order 10 answer questions and to

MAG meetings and prepare final BMPs for implementation. CONSULTANT shall also
prepare a inspection and follow-up ptan, including staffing requirements, for
implementation of tlIe final BWoPs.
TASK 8.8 • UPDATE LIST OF MACIlINElMETAL FABRICATION SHOPS
CONSUL'!'.A.NT shall update a list ofma-:.hir.e/metal fabrication shops withln the RWQCP
service area. CITY bas utiliud the PacBeil Sm3.l1 List and the Industrial Was!:: Section's
computer database to develop the initial list of machine/metal fabrication shops.

CONSULTANT shall visit 20 facilities to determine whether Ll,ey conduct activities that
should he regulated and to explain the BMPs. A final listing of machine/metal fabrication
shops 10 be regulated will be provided to the CITY for input into its data management
system.

In a recent investigation of Li.e Palo Alto Cultural Center~ the Regional Water Quality
Control Plant (RWQCP) staff has identified certain pottery and ceramic wastes as being
high in metals. CONSULTANT shaD ""51 the CITY in cIel=:lining the ,mount of metals
