Proposed changes to Title i7 of the Palo Alto Municipal Code (Ha2ar~ous
Materials storage)

Report in Brief
staff is recommending Council adopt the attached ordinance proposing
changes to the procedure for reviewing applications for permits required
by the Hazardous Materials storage Ordinance (Title 17). The proposed
changes will simplify the process and also enable the City to more
effectively comply with the California Environmental QUality Act
("CEQA-}. Addi tional unrelated minor changes to Title 17 are also
proposed.
Background
The purpose of Title 17 is the protection of health,. life, resources and
prop~rty through prevention and control of unauthorized discharges of
hazardous materials.
The current provisions of Chapte~ 17.34, Environmental Review, separates
the CEQA review required for hazar~ous mat~rials storage p~rmits. It
also provides additional reviews based on the types and quantities of
chenicals involved, which are not necessarily relevant determinants
under-CEQA.
The current provisions were enacted in early 1988 to provide the public
with information about companies that are using and storing hazardous
materials within Palo Alto. However,. after almost four years of
experience with the provisions, the Fire Department has found that the
current system has confused the public and is too costly and time
consuming to administer.
The proFosed changes would provide a single CEQA review on projects which
involve the storage of hazardous materials. Thus, for example, if a
p~oject requires Architectural Review Board (ARB) approval as ~ell as a
Title 17 storage permit, a single, integrated CEQA review .. ould be done
for both applications, rather than two separate CEQA reviews, as is done
now. However, a separate Fire Department CEQA review process would be
undertaken only when a Title 17 storage permit is required for project

approval. These cases are very rare, in tt.at most Title 17 storage
pErmits are requested in conjunction .. ith thE need. for physical or
facility changes which would precipitate review by another body#
qenerally the ARB. In all cases, the proposed procedure for r-eviewirl9
the environmental aspects of hazardous materials -would !ilore closely
tollo~ both the letter and intent of CEQA than de the current
regulations. In order to <:larify the limit of ARB authority and
responsibility with respect to projects that include storage of hazardous
materials, an amendment to Chapter 16.48 (Architectural Review) is also
proposed.
In addition to the proposed chanqes relating to CEQA, other unrelated
minor ~mendments to Title 17 are also proposed~ One of these propos~d
amendments would authorize certain designated Fire Department positions
to iasue citations for violations of Title 17. This is simila~ to the
Fire Oepartment's current authority under the Fire Code.
The ordinance is categorically exempt frem the pr-cvisior.s of CEQA.
Therefore, no environmental review or findings are necess~ry.
RecPmmendation
staff recommends that the City Council adopt the attached ordinance
amending ~itle 17 and Chapt~r 16~4a of the Palo Alto Municipal Code.

The Council of the City of Palo Alto does ORDAIN as
SECTION 1. Sabsection {c) of Section 17~lO.120 of the Palo
Alto Hu.~icipal C~e is hereby amended to read as follo~s:

(c) Tbe city, or any other public agency specified by
the city, shall approve the location and number of wells, the depth
of" vells, and the sampling frequency, pursuant to ,~he monitorinq

SECTION 2. Subsection (e) of Section 17.12.020 ot the Palo
~to Municipal Code is hereby amendea to read as follows:
17.12.020 Hev.torage tacilities.
(c) Containment Requireme.nts. Primary and secondary
levels of containment shall :be required for all new storage
facilities intended ror the storage of hazardous materials ~hich
are liquids or solids at standard temperature and pressure (S'rp) I
unless specifically herein exempted Py the fire chi~f.
(1) All primary containment shall :be product-tight~
(l) S~condary containment:
(i) All secondary containment shall be
constructed of materials of sufficient thickness, density, and
composition so as not to be structurally weakened as a result of
contact with t~e discharged hazardous materials and so as to ~e
capable of containing hazardous materials discharged from a primary
container for a pe-riod of time equal to or longer than the maximum
anticipated time sufficient to alloY recovery of the discharged
hazardous ~aterial.
(ii) In the case o~ an installation with one
primary container, the secondary containment shall be large enough

(iii) In the case of a storage facility with
multiple primary contai:'lers, the secondary contairuuent shall be
large enough to c?ntain one hundred fifty percent of the volume of
the lax~est pri~ary container placed in it, or ten percent of th~
aggregate internal v~lume of all primary containers in the storage
facility, whi~hever is greater~
(iv) If the storage facility is op~n to
rainfall, then the secondary containment must be able to
additionally accommodate the volume cf a twenty-four hour rainfall
as determined by a one-hund~ed-year stOJ;'lll history. Rainwater shall
be removed from the contair~ent area. Removal sh~ll be done by
means of approved systems that cannot be lett open whi:!n unatterlded.
(v) Sec.o:>ndary contairunent shall remain free of
product from normal use and shall assist in monitoring efforts.
Interior containmer.t shall remain fres of Droduct and water unless
water is a part of the monitoring system: Exterior containment
shall remain free of product and water except for rainfall within
24 hours or water which aids in approved monitoring program.
(3) Laminated, coated, or clad materials shall be
considered single walled and shall not be construed to fulfill the
requirements of both priGary and secondary containment.
~ECTTON 3. Subsection (b) of Section 17.16.025 of the Palo
Alto Municipal Code is hereby amended to read as follows:

(b) Unless the facility qualifies as a minimal storage
site under Section ~7.16.030, or is otherwise exempt pursuant to
Se~tion 17.0S.020~ the emergency response plans shall provide the
followin~ additional information:
(1) Emergency response plans and procedures in the
event of a reportable release or threatened release (as that phrase
is defined in Section 25501(p) of the California Health and Safety
Code) of a hazardous material, 'Which shall include, but not be
limited to, the following!
~i} Immediate notification to city and the
State Office of Emergency Services,
(ii) ProcedUres for the mitigation of a
release or threatened release to minimize any potential harm or
damaqe to persons, property or the environment,

SECTION 5~ Section 17~24~020 of the Palo Alto Municipal
Code is hereby amended to read as follows:
17.24.02D Unconfirmed unauthoriBe4 4ischarqe. (a)
Indication of Loss in Inventory Records. Whenever a material
balance or other inventory re~ord~ e~ployed as ~ monitoring
technique under the HMMP, indicates a loss of hazardous material,
and no unauthorized discharge has been ~Aed confirmed by other
means-, a responsible person sha.ll have five working' daj's to
determine whether or not there has been an unauthorized discharge.
If before the end of such period it is determined that there has
been no u~authorized discha~ge, an entry explaining the occurrence
shall be made in the person' 5 monitoring records~ Where a
responsible person has not been able, within such period, to
determine that there has been no unauthorized discharge, an
unauthorized discharge is deemed con finned and the responsible
perscn shall proceed in accordance 'With section ¥1o~-1-939 (s)

(b) Test Results. Whenever any test results suggest a
possible unauthoriz.ed discharge and nc; unauthorized discharge has
been confirmed by other means, the responsible person shall have
five working days to retest. If second test results obtained
within that period establish that there has been no unauthorized
discharqe, the results of both tests shall be recorded in the
person's monitoring records. If it has not been established within
