Report in Brief
This report recommends that the Council authorize the Mayor to execute
the attached consultant agreement with CH2M Hill California Inc. in the
amount of $150,000 for con3ultant services for the Wastewater
Reclamation Pre-design/ElR project of the Reclamation Program.
~ackground
The Reclamation Pr-ogr;.:.m has two major objectives. The first objective
is to evaluate the diversion of a portion of the effluent from the Palo
Alto Regional Water Quality Control Plant (RWQCP) to reduce the
lII'?lste'Water constituf"nt: mass emissions to South San Fl'anciscc Bay. The
second objective is to evaluate reclaiged ~ater as a dependable
supplementary source of water supply to the water utilities in the study
area.
The Reclamation Program is a three-step pro:;:'l.-arn. under step 1, the
Master Plan evaluates the technical and economic feasibility and
identifies potential reclamation projects. Under step 2, the Finance
and Pre-desiqn/EIR reports define and resolve the financial and
environmental issues associated with the proposed projects. Under step
3, the projects are designed and constructed. step 1, the Master Plan,
was completed April 1992. The executive. sUIIU:lary of tr_e M.:.ster-Plan 'Was
presented to Council in a staff report dated July JD, 1992 (CMR:358:S2).
Council approved an agreement with Hilton Farnkopf & Hobson for the
Finance evaluation under Step 2 on October 15~ 1932 (CMR:454:92). An
agreelflent .for ~;he pre-designJEIR reports under step :2 is the subject of
this report.
Discussion
A Request for Proposal to perform the Wastewater Recla-mat.ion Pre
design/EIR was issued to nine oonsultant firms, and seven responded.
The proposals 'Were revie',Jed in accordance with the Cit~~'s selection
procedure for professional services. Three consultant tin!ls ",ere chosen
and interviewed by the City's selection committee. The se.lection
committee included personnel from the City of Mountain View, Stanford
University, and Palo Alto's Planning Department, Utilities Department,

and the RWQCP. The three consultant firms intervie~ed by the ca~ittee
~ere Brown' Caldwell, CH2M Hill, and John Carollo Enginee~s. CH2M Hill
was e.elected b~sed on the firm's project team, approach, communi·:::ation
skill, team expp-rience, references, and user training programs.
This project was submitted to the Finance committee for revieW' and
approval on November 5, 1992 (CMR:508!92). The Finance Cor::unittee
unanimously approved the consultant selection and stipulated that staff
present the findings of the Pre-design to the COIJncil for approva 1 prior
to proceeding ~ith the full ErR.
The scop~ of work includes developing alternative pipeline routings and
reservoir sitings for the p~epar3tion of the ErR, refining the Master
Plan project cost estimate, obtaining letters of intent from end users
and preparing an environmental impact report for the wastewater
Reclamation Master Plan. If the recla!T'.at.ion proje,=t is a.pprove;~; the
city has the option of amending the consul tant agreement to include
final desigrt and construc"tion management services as part of step 3 of
the program. The scope and tee for these services will be negotiated at
t.'lat time. Funds for the wastewater Reclamation Pre-design/EIR are
included in the F'i 1992-9.3 Wastewater Treatment operating fund.

4.1 BASIC SERVICE~

4.3 GENERAl, DU'1'IES OF CONSULTru.IT
4.3.1 CONSULTANT represen~s that it is qualified to
furnish the s€I"V"ices described under this Agreement. CONSULTANT
further declares that one or more members or employees of its firm
and that of its subconsultants, if any, are licensl.~d by the State
of California to perform their services and that these se.rvices
will be perforIfled by ther:l or under their super,.rision. COSSULTANT
shall furnisI-.. to CITY for approval, prior to ~xec\..:.ti::;r'~ of this
Agreement, a list of' all firms or co:"poratioTIs to be ::~"p::"oyed as
subconsultants.
4.3.2 CONSULTAN'! scates that it is away-e of: the

of this Agreement, CITY agrees to pay CONSULTANT a fee not to
exceed $50,000 for the Phase 1 tasks and $100,OD for the Phase 2
tasks.

CONSULTANT may terminate this Agreement c'r suspend work
on the Project upon thirty (30) daya' written notice to CITY, but
only in the event of s'...lbst.antial failure of performance by CITY or

CONSULTANT shall receive compensation as follows:

11.1 Subject to the provisions of Paragraph ]1.2 below, the

the performance of this Agreement, although inst~ents of
professianal service, are and shall be the property oE ~~TY whe~her

WASTEWATER RECLAMATION PRE-DESIGN/Em
The Palo Al.to Regional '~ater Qual i ty Control PL~nt (PARWQCP},
operated by the City of Palo Alto, p~ovides wastewate~ treatmen~
and disposal services for the cities of Palo .Alto, Mountain Vie ..... ,
Los Altos, East Palo Alto l the TO'ooo·n of Los Altos Hills, and
Stanford university. The PARWQCP is an authorized geneLator of
reclaimed ~ater for un-restricted use. Because the reclaimed ~a~er
from the PARWQCP can pr9vide beneficial reuse, and because potable
vater supplies are limited, the PARWQCP embarked on a Wastewater
Reclamation Progr.2',m. Th~ program is structured in three steps:

Reclaruation Master Plan. The PARWQCP is nc~ proceeding with step
2 of the program. The Scope of Work under this Aqreenent is to
provide Pre-design/EIR services as part of step 2 to the PARWQCP
for the Wastewater Reclamation program. The Master Plan identified
several different alter~ative projects that could be done under the
program. They have been labeled as Project A, E, alternat~ B, C,
and D. The work to be pe.rform~d under this agreement focuses
primarily on Project A, .... hich is referred to as the I'lPROJECT".
Project A inclUdes a delivery and storage system to provide
reclaimed ""ater from the PAR"'~QCP to Stanford Universitj" ar..d any
parks and green belt ar~a5 that ere locdted along the pipe route.
Consul tant may be requested t.Q conduct the final design and
constrllction management as part of step .3 of the Program, if
authorized by CITY, through an amendment in scope and budget to
this contract.
The work under this agreel'l1ent shall bE: divided ir.to t .... 'o phases.
Phase 1 is t~e pre-design and pre-EIR e~vironrn~ntal screeni~g, from
which a preferred alternative route and [-eservoir site can be

and implementation issues associated ~ith the PRGJEC~ before a

three alternate pipe routes and t~c alternate reservoir sites~ and
conduct an initial environmental screening on these alternati~es.
Selection of the site and route shall be reviewed \t(ith CITY. The
environmental screening shall identify any apparent sigr:lificant
environmental impacts that could not be feasibly mitigated {i.e.,
-fatal flaws h ), associated 'With irnpleI!lenting any of the
alternatives. Based on the environmental screening, Consultant, in
consultation with CITY , will select a prefe4red alternative route
