Report in Brief
This report requests that Council award a. contract in the amount of
$149 r 17e.OO to Lewis and Tibbits Inco~orated of Fremont for gas
main replacements on Byron street between Palo Alto Avenue and
Lytton Avenue; Everett Avenue bet .... een Webster Street ana
Middle-field Road; Hawthorne Avenue between Webster street and
Middlefield Road~ and on Palo Alto Avenue south of the Byron Street
intersection. In addition, staff recommends that council authorize
the City Manager or his: designee to ex~cute one or more change
orders to the contract for additional related, but unforeseen work.
Tbe value t:::!f these change orders shall not exceed $15,000.00.
FUnds for this project are available in the FY 91/92 Capital
Improvement Proqra~ Budget for gas main replacements.
BAckground
The steel gas mains included in this replacement project have
experie~ced above averaqe incidents of leaks and are increasingly
difficult to cathodically protect. Replacinq the existing mai~s
and services with plastic pipe wil! eliminate leaks in the area and
reduce loads on the cathodic protection system, thereby extending
its useful life. Retledial tneasures have been taken to maintain
federally mandate~ cathodic prote=tion levels on these ~ains, but
the anode bed serving tbis area is failing under existing loads and
has very limited reserve current capacitj".
Project yescription
The proposed project ~ill install approximately 3000 linear feet of
new plastic gas mains and 51 customer services at the previously
mentioned locations.

Bid Eyaluation
Bids ~ere received frem six qualified bidders on october 2~, 1991,
as indicated on the attached bid summary. The bids ranged from a
low of $149,178 to a hiqh of $302,630. The utility Enqine€"r's
estimate is 147,775.
The lowest responsible bidder was Lewis and Tibbits Inc.. of
Fre~~nt. Staff finds the lov bidder to be qualified to perform the
work.
Recommendations
staff recommends that council:
1. Authorize the Mayor to executoe a contract. with r.e ... is and
Tibbits Inc. of Fremont, in the amount of $149,178.00 for the
Byron Everett Hawthorne Gas Main Replacement Project; ~nd
2. Authorize the City Manager or his designee to negotiate and
execute one or More change o:--ders to the construction contract
with Le~is and Tibbits Inc. of Fremont I the value of these
change orders shall riot exceed $15.000.00.

6. All claims by Contractor regarding extra worle, char~es, delay or other disputes arising
out of the Contract must be submitted to C!TY in writing within ten (10) working days
after the claim 3rose, describing in detail the r,ature and value of the dispured work
or claim.
7. ContractD< hereby agrees to indemnity, defend am:! hold harmless CITY, its officers,
agents, and emplove@! trom any and all demands, claims or fiability of any na1ure.
caused bV or arising out ot Contractor"s. its officer$~. agents", or employees' negligent
acts. arrors, or omissions, or willful misconduct. or conduct for which the law imposes
strict liability on Contractor in the performance or failure to perform this Contract.
8. This Contract represents the entire agreement between the partle.s with respect to the
purchase an<l safe (It the equipment. materials, or supplies or payment for services
which may be the subject of this Contract. An prior agreements, representations,
statements, negotiations and undertakings whether ofar or written are superseded
heroby.
9. No payment. partial payment. acceptance. or partiar acceptance by CITY shall operate
as waiver on th'=! part of CITY of any of its rights under this Contract.
10. Contractor agrees 'to permit CITY to audiT .• at any reasonabie time during the term of
this Contract and for three (3) yea.s thereafte(~ Contractor's records pei1aining to
matters covered by this Contract. Contractor further agrees to maintain such records
for at least three (3) years after the term of this Cont~act.
