Construction Contract and Ameng.ment to Consultant Contract
Members of the Council:
Report in Brief
This report recommends that council approve the follo .... ing actions
for the const~~~tion of the Police wing structural Modificati~ns:
1. Award the attached Construction contract with Lee En9'ineerin.g
Enterprises in th.e amount of '$824,400, and
2. Authorize the Mayor to r~xecute the attached Amendment No.1 to
Consultant contract No. C-55986, -with Forell/ Elsesser
Engineers, Inc., in. the amount of $65,100 for construction
management eervices.
Background
An inspection of the Civic Center building, after the October 17,
1989 earthquake, revealed cracking in several areas in tha Police
Win9'~ The City retained ForelljElsesser Engineers, Inc~, an
engineering' consulting firm; ,",'hich analyzed the building's
structural adequacy and prepared plans and speci fications for
needed improvements, including the Police Wing seismic
modifications.
TWo bid openings were held previouslj' for this vroject, one en
November 6, 1990 and the other on December 12, 1990. Both bids
were rejected by Council, since they ~ere in excess of the $500,000
construction budget (CKR:570:0 and CMR: 1(5~91) ~ The low bid at the
first openlnq -,..as $1,035,659. City staff, with the help of the
consultants and a contractor, modified the plans to provide a more
cost effective design, increased the construction period, reduced
t,he scope of work, simplified construction methods and permitted
alternate methods of plaCing concrete. With these modifications,

bids ~ere solicited a second time. The 10 .... bid at the second
opening was $929,092. Although these bids reflected some cost
savings, they ~ere still in excess of the budget.
Due to the high construction cost r council approved an addition~l
$600,000 for this p~oject in the FY 1991-92 CTP budget, providi~g
a total budget of $l.lOO,OOO~
In preparation for the third solicitation of bids, City staff and
consultants again reworked the desigrl, considered alternate bidding
schedules, and aggressivel)· distributed plans and specifications to
interested contractors. On october 30: 1991, City staff held a
pre-bid meeting wIth pro~pective contractors to describe the
project, revie~ the site and answer questions~
Dispussion of the C __ 9JJ.§.tru.s:: __ tj,on Contract
Bids were opened on November 12. 1991. The. la ..... est responsible bid
was received from Lee Engineering E;1.terpri$es in the amount of
$824,400, 'Which is 10 percent below-the engineer's estimate of
$915,110 as shown on the attac;1ed summary. Therefore, statf
recommends that the bid of $a24,400~ submitted by Lee Engineering
Enterprises, be determined by Council to be the lo-\o\rest responsible
bid end that the contract be awarded accordingly_
construction projects involving existing buildings Experience
unforseen expenditures due to the r.1!Iture of the work and ther~fare
staff is recommending a contingency fund of 20 percent in lieu of
the standard 15 percent4 The increased contingency amount will be
used, if necessary, to compensate the contractor for any
construction taking place on weekends and after hours. City staff
:may direct this to minimize. disruption to the public and City
operations~
The project inCludes strengther:ing existing columns; and beal'!',s .and
constructing 3dditional walls and columns in the Forest AvenUE! end
of parking levels A, Band C. Also r new concrete ~alls will be
constructed on the sides of the Police Wing facing Bryant street,
Forest Avenue and Ramona Street.
Several measures have been taken to minimize disr-uption to the
public parking a:o:ea and Civic center operations. 'l'he contractor's
field office ~ill be limited to the parking stalls located along
Civic center on Bryant Street. The contractcrrs work areas will be
strictly controlled to minimize inconvenience to public and permit
parking. Hours of construction ... ·ill be between 8:00 a.la. and 5:00
p.m. to comply 'With Cit~~ noise regulations, unless circumstances
warrant extended hours. The contractor's operations 'Will not start

until after January 6, 1992, to avoid disrupting parking during the
holidays.
Piscussion of Amendment No. ~COJ1~lJlt_~_nt ____ <::_Q_ntr3ct 1i~55986
with [grell/Elsesser Engineers, Inc,
The council appro·/ed Consultant Contr-3ct No. C-S59B6, for
structural engineering services with Forell/Elsesser Engineers,
Inc. in March 1990 (CMR:213~C).. The contract did not provide
construction ~anagement services but purposely made allowance for
tha scope and fee of construction stage services to be negotiated
after the completion of the design. In this »,ay, the extent of
consultant involvement could be more accurately defined. Staff
recommends approval of an amendmen~ to the consUltant contract in
the amount of $65,100 for construction ~anaqernent services.
Civic center RefinaricJXt9.
City staff is considering refinancing the Certificates of
PartiCipation for the Civic Center. If this does proceed# the
construction monies for the subject project will be included in the
re:fin:ancing.
Environmental Assessment
This project is categorically exempt from the California
Environmental Quality Act (CEQA).
Conflict of Interest Code Exemption
Staff, vith the concurrence of the City Attorney, has determined
thAt Forell/Elsesser Engineers is e~ernpt from the requirement to
execute Form 730 and otherwise comply ~ith the financial interest
disclosure provisions of the City's Ccr.flict of Interest Code. They
ar~ exempt because the consultant's range of duties and the
construction management services to be provided under Amendment No.
1 to Consul~ant contract No. C-559a6 for consultan~ services are
limited in scope and primarily :ministerial in nature.
Elecommendations
staff recommends that council:
1. Approve and authorize the !'I\'ayor to execute the attached
construction contract with Lee Engine~ring Enterprises in the
amount of $824 /400 to construct structural :modifications to
the Police Wing.

3. In consideration of such work, CITY shall pay Contractor the amount spectfied in his
bid in the manner provided in said Standard Specifications dated 1972, CiS amended.
4. Concurrentfy with the execution of this contract, Cor,tractor shall provide CITY with
the Contractor's labor and Material and Faithful Performance Bonds and certificates
of insurance, including any workers' compensation insurance required by the laws of
the State of Carifornia or otherwise required in said specincations.
5. This contract shall not be assigned by Contractor.

this Agreement and for three (3) years thereafter. Contractor's records pertaining to
matters covered by this Agreement. Contractor ~uither agrees to maintain such
