Boundaries of UndergrQund utility pistrict No.30 -Crescent ~_lL...lll Members of the Council: At its me~tinq of March 23, 1987, the Council adopted Ordinance No. 3745 establishinq Underground utility District No. 30. This report is to request Council adoption of a Resolution of Intent to ~end Underground Utility District No. 30 boundary to include six additional properties on Edqe~ood Drive. Attached district boundary saps show existing district boundaries and proposed boundary chanqes. Background The Electric Utility has found that the poles located along the rear lot easements of six properties {1629-~699) on Edgewood Drive are deteriorated ana raquire replacement. Rather than replace these poles, staff finds it economical to provide electric unaerground service from the street side, where underground service points for electric} cable TV and telephone were installed when Underground District No. 30 was rormed~ The City benefits, since it will no longer need to maintain the overhead lines along the rear lot easements cf these properties. Thel"e is no additional cost to t,he City in providing underground service to the si~ properties and, therefore, will not charge any fees to the property owners. However, Pacific Bell rules require that, should property owners request un~erground service where there are existing poles, the property owners be billed the cost ot providing underground service plus cost of removing the poles. These charges will result in a substantial fee ranging fro~ $5,000 to $10,000 per property. In order to exempt the property owners from the telephone connection fees and the cost of the CD.:131:93 .... , --. ; , reaoval ~f the poles, pacific Bell requires that these pr~pertie5 be included as part of an unaerground dis~rict. The proposed amendment in the ~istrict boundary ~il1 result jn the rempval of three poles and p~~vide underground gervi~e to six additional properties. The original boundary had 231 properties and the total number-of poles removed 'Was ninety-seven. On December 7, 1992, a letter was sent to the property owners i~ the district infonainq them of the intent to amend the boundaries of Underground Oistrict No~ 30. A questionnaire, vhich was included with the letter, was us~d to determine the level of support. Staff has received completed questionnaires f~om 131 property owners, of whom 45 percent are in favor, 53 parcent have no preference and, and 2 percent are not in favor. out of the six property own~rs to be affected five have responded, and all five are in favor of being included in the district. proposed Procedure The first step in amending the di3trict boundary is council adoption of a Resolution of Intent to Amend the Boundaries of Underground utiliti--District No. 30. The resohltion defines the district boundaries and sets a time and place for a public hearinq on the matter which will be scheduled for the M~~ch 15, 1993, Council meetinq. The amendinq of the Underground Utility Dist~ict No. 30 boundaries will be initiated by Council'. adoption of the attached Resolution of Intent. 2. After public comment, council will either adopt or fail to adopt an ordinance amending Underground Utility District No. 30 boundaries. Enyironmental tmpact Assessment This project is categorically exempt (Class 2) from the environmental impact assessment requirements under the california Envrionmental Quality Act. CIOU1.31r9l t! No additional underground construction by the City is required. ~Jnds are available in the Elect~ic Capital Improvem~nt Projects Overhead and Underground Extensions and Replacements, for connecting the six additional pr~perties to the underground systems and removing the overhead facilities. Total estimated city expense is $6,000. The cost of converting the electric, telephone and cahle TV services yill be borne by the property owners. The average cost per property for convertinq the services is $2,500. The property owners will be offered the option of finar.:cing t..'leir service conversions pursuant to Section 12.16~091 of the MU~icipal Code. This involves the borrowing of funas from the city ana the repayment of such cost which will be added to the owners' property tax bills over a ten year period at an interest rate specified by the Council as defined in the Code. Council Action and Tentative Schedule The first Council action requi~ed to initiate the procedure will be adoption of the Resolution of Intent t.o Amend Boundaries of Underground District No. 30.
