Members of the Cou~cil:
Sr~te law requires that background investigations be conducted on
all police officer candidates. This report req\lests Council
approval of a two year agreement with Syste~s for Public Safety for
an amount not to exceed S43~200~ Funds for the remainder of 1992-
93 are included in tbe Police Department' s budget~ Fund.ing for the
second year is contingent upon council approval of the 1993-94
budget.
Discussion
The California Commission en Peace Officer Standards and Trail'lillg'
requires the completion of a comprehensive background investigation
on all regular and reserve police officer candidates prior to
employment. The investigations are conducted to verify that
candidates meet the minimtim jOb reqUirements and are suitable for
employment by the City of Palo Alto.
For the past three years, the Ci't.~t has contracted with systems for
P"lolblic safety to conduct these backgroui1ds. The most recent
agreement with them expires January 19, .1993. In November, staff
distributed a request for proposal for background investigation
services to three companies. proposals were received from each
ene. After staff reviewed the proposals, systems for Public Safety
was selected based upon their fees, prior performance and ability
to provide the scope of services that best meets the needs of the
Poliee Department. They return documents in a timely manner,
provide a leqal client bulletin on a monthly basis and are always
willing to discuss personnel selection issues, legal questions and
pre-employment assessments. Contingent upon approval of funds for
the second year ~ the lTiaximuJrl cost of the bio-year agreeroent shall
not e~ceed $43 1 200.

Staff recommends the City Council authorize the Mayor t~ execute
the attached aqreemQnt with Syst.::ms for Public Safety to provide
background investiga~ion servi~es during the period of January 19,
199~ to January 19~ 19954 Funds for the remainder of 1992-93 for
this agreement are includ9d in the Police Department's budqet and
will be included in the Department's 1993-94 proposed budge~ for
the second year of the agreement.

2. Contractor \to'ill receive the necessary documents tor each
potential employee for 'i"hich a background investiqation will be
conducted.
3. The background investigation will consist of ~akir.9 all
the necessary personal, telephone or correspondence contacts, and
reportinq the results to the Chief of Police or his desiqnee in a
specified font and format. Due dates for preliminary and final
reports will be agreed upon at the time investigations are assigned
to the Contractor. Turnover time of backgrounds .... ill nOI1I'lally be

delivered to the Palo Alto Police Department Personnel and Training
Division unless other prior arrangements are made.
4. Contractor will seek or gat~er any infOrMation which is
public record and may be lawfully obtained relating to the
potenti21 employee's criminal history or driver's licens~ record.

7. Prior approval from the Palo Al to Police Department must
be obtained by the Cotltractor far any background investigation that

Mateo, Santa Cruz and Sant~ Clara Counties, an agreement betwee~
the contracto.l· and the Palo Jl.lt.o Police Department must be made in
advance ~ Reimbursement for extended tr ips ..-i 11 require itemized
expenditure lists and loll_II be paid as delineated in Exhibit C. The
compensation rate :!:lay be renegot iated annually and the contract
amended accordinglj'.
8. Contractor hereby agrees to indenmify, defend and hold
ha~less the City, its officers, agents and e~ployee5 from any and
all demands, claims or liability of an~l nature, caused by or
arising out of Contractor's n~gligent a.cts, errors, omissions,
willful lnisconduct, or conduct for .,.,'hic:h the law imposes strict
liability on Contractor in the performance or nonperfonc.ance of
this agreement.
