D. Meyers, Inc. for the 'transportation and disposal of transformer oi 1 ar.d equipment generated by the city. Funds have been appropriated in the utilities Department Electric Operations Division operating budget for FY 1991-92. The Public Works Department operations Division is ch:;irg'J.d ""ith the responsibility fer managing hazardous wastes generated by the City. Therefore, Public Works is administering this project rather than the Utilities Department. Background Transformers, switches, and oils generated and accumulated by the City must be removed, transported and disposed of in accordance with 6~ate and fede.ral regulations. Some of these. wastes are contaminated with polychlorinated biphenyls (PCBs) and must be managed under more stringent regulations. piscussion This contract provides for the reMoval, transportation, and disposal of 34 pieces of PCB-contaminated equipment, ~pproximately 1,700 gallons of PCB-contaminated oil, 112 pieces of non-PCB equipment and an estimated <4 ,700 gallons of non-PCB oils. These items were generated through the decommissioning, replacement or failure of el~ctrical distribution system components. A request for bids .... as issued to 12 hazardous waste !l1anagement firms, and six responded. The bids were revic~ed by staff from the Public Works operations Divis i on to determi:'l02 the lowe.st responsible bidder. The revie .... · included evaluating costs presented in the bids and performing background checks for regulatory record.s, references and experience. Based on this evaluation, -1- CMR:497:91 s. Do. Environmental Assess~ent The award of the attached contract is ministerial and, theref~re, exempt from the California Environmental Quality Act. 'rhe City is required to comply 'With state and federal regulations for the proper-removal, t%."al1sportation, and disposal of its hazardous 'Wastes and no discretion is involved. Recommendations Staff recommends that Council: L Approve and authorize the Ma~'or to el<.ecute the attached contract ~ith s. D. Meyers, Inc. in the amount of $36,817 for the Transformer Oil and Equipment Disposal project. 2. Authorize the City Manager or his designee to negotiate and execute one or more change orders to ~he contr~ct ~ith S~ D. Meyers, Inc. the value of all of which change orders shall not exceed $6,000. All prior agreements, representstions~ statements. negotfa-tlons and undertakings whether oral or written are superseded hereby, 9. No payment, partial payment, acceptance, or partial a:~ceptanc£ by City shalf operate as waiver on the part of City of any of lts rights under this contract. 10. Contractor agree! to permit CITY to audit, at any reasonable time during the 1erm of this Agreement and for three (3) years thereafter, Contractor's records penaining 10 matters covered by this Agreement. Contractor further agrees 1D maintain such records for at least three (3) years after the term of this Agreement.
