The attached ~MQrindum from Michael Eva~hoe. Executive Director of the Santa
Clara County Congestion Management Agency (C~~}. rEquests that the City adD~t
th'! attached resolution designating the CMA CliS the recipient of AS 434 funds.
AS 434 ,Sher 1991) allows the Bay Area Air Quality Mar,agement District
(BAAQMOJ to receive an increase in '.:ehicle registration f€es of up to 54 per
vehicle. to implement certiin transportation control measures. Counties ca~
receive some of these funds for a designated County agency char'ged with
fmpleroentation of local transportation cuntrol r:1easures. Tne attached
resolution designates the CM~ to receive AB 434 furds to finance two-thirds of
the cost of the Santi C1ara County Commuter Network. In anticipation of this
funding, the CMA advised the City to budget $30,648 for 1992·93 Commuter
Network e~penses versus the S115,202 expended by the City 1n 1991-92 for the
Commuter Netw~rk.
Staff recolmlends that the City Counctl approve the attach.?d reSOlution
designating tne Santa Clara County C~A to receive AB 4J4 funds.

BACKGROUND

Although the BAAQMD is legally charged '9.'ith implementing the L-jp reduction
rule, it may delegate implemenl.3tion a..fld enforcement authority to local agencies.

recipient of AB 434 funds.
To be designated as the recipient of AB 434 funds, ~ majority of cities with the
I1'l3jority of the population and Sa."lt.a Clara Count)' must pass resoiutions d~ignating
the c."'IA. Non-Golden Triangle dties wefe asked (0 designate the CMA concurre~J
with the adoption of the Commutec Network Ordinance. All of these cities but
ooe) :as weU .as the Gcy of San Jose, have already designated the c.~ as redpien! of
AB 434 funds.
FINANCIAL IMPACT
In IT 1992-93, approxirn>.tely two-thirds of the Commurer Ne~"'t>rk budget would
be funded through vehicle registration (All 434) fees. The County has agreed to pay
50% of the shortfall, with the r=ining 50% 10 be .plit among the cities on a jOOs
based formula. For the original Golden Triangle dtles, the fY 92-93 assessmems are
significantly lower dun previous years' contributions. The impact on the original

PROG~ MANAGER FOR AB 434 (SHER--1991) VEHICLE
REGISTRA'fION FEE REVENUES
"WHEREAS, the State of Cal ifornia enacted the California
Clean Air Act of 1988 r~quirinq Air Districts to adopt and cities
and (":ounties to iIr'.plemel"';t certain transportation control measures
in order to improve air quality; and
WHEREAS, the State of C~lifornia enacted congestion
Management Legislation in 1989 and 1990 requiring cities and
counties to implement Congestion Management Proqrams (CMP) s to
reduce traffic congestion ~nd improve air quality; and
WHEREAS, the County and the cities of Santa Clara county
have in response to the aforementioned state legislation created
the santa Clara County Congestion Management Agency; ar.d
WHEREAS, the Santa clara CCiunty Congestion Mar,aqement
Agency operates the commuter Net~ork Transportation Demand
Management Program for the benefit vf its Member Agencies; and
~iEREAS, the state of California enacted AS 434 (Sher) in
1991 to p~ovide vehicle registration fee revenues to fund certain
transportation control measures thrQugh the subvention of forty
percent of the county I s proportionate share of the revenue to a
designated countywide overall program manager; and
WHEREAS, in order to qualify for the subvention of forty
percent of the county's proportionate share of the revenue, the
County Board of Supervisors and a majority of the cities with a
majority of the popul=.tion must desig!1a-t:e~ by resolution, a
countywide everall program manager to implement local programs and
projects.
NOW, THEREFORE, the Council of the city of Palo Alto does
hereby RESOLVE as follo~s:
SECTION 1. The city Council hereby designates ~he Santa
Clara County Congestion Management Agency as the countywide overall
program manager for proje~ts and prograns and the recipient or the
countY'$ forty pe~cent proportionate share of the fee-paid vehicle
registration fee revenues according to the following t-=rn'lS and
conditions.

4. The Congestion Management agency will, at least once
avery tyO year-s, undertake an audit of each project or proqral!r:
funded according to the conditions set forth in state statutes.
