This report requests CQunci). approval of the attached ~ontract 'Wi th
california Land Manag!::!rnent (eLM} ~ to provide Park Ranger services
for the Palo Alt.o Ba)'lands, Byx.bee Park and the Refuse area. Funds
have been approp:-iated in the public Works Refuse Fund Fiscal Year
1992-93 op~r~ting budget.
Background
Since 1983, th~ city has contracted ~ith eLM tor Ranger services to
supplement Dp€'rJ"Space and Sciences' RangE!:r staff.
The City originally contracted with CLM to provide security patrols
to prevent dumping at the Refuse area. Cry. patrols reduced the
illegal dumping in the Refl]Se area; however; the dumping began to
occur in other ar2as of the Baylands; such as the parking Jots in
the Nature Preserve. CI..M1s services were: then utilized to help
protect these areas.

variety of services such as visible patrol, first aid, minor law

contractor also provides a four--",theel drive vehicle; first aid
equipment and maintenance tools. Patrol areas include the Ref'.lse
site, the Baylands' levees, the duck pond/ the ITT property, East
Bayshore }(oad and Eyxbee Fark.

The Baylands area attracts an estimated 750,000 people per year.
There are a \lIide v<!Iriety o! facilities available for public use ar.d
enj cyment such as the Inte!"pr€:t i ve center I hik.ing and bicl'cl ing
trails and the Refuse a~d recycling yard. Visible eLM patrols hel~
to pr",tect these areas and facil i ties from vandal is:m, poachil"lg,
dUl'r.ping, off-road vehicles, loose dogs and public safety hazards.
In add~tion. ,the ne ..... facilities scheduled to be in~talled in /l.ugust
1992, $uch as the boat ramp and picnic area, will need maintenance
and pretection.
Discussior.
The attached ccntract provides for 3 variety of ranger patrol and
maintenance services. eLM is well equipped to provide services in
the ar~a of visible patrol.. min0r la'\.\-· enforcement.. CPR and
emergency first aid and routine maintenance.
This contract was not put out to bid because it .. as determined that
this contract falls \.mder the provisions of Palo Alto's Municipal
Code t section 2~JO.140 (a) (2), \oIhich states that contract:; may be
exempted from the corr:petitive bidding prc>cess "where calling for
bids on a competitive basis in the opinion of the City Manager is
impracticable, unavailing or impossible." Tbis is based on the
unique mix of services and Equip~ent provijed by eLM.
The attached contract is for a term of 36 months, in the amount of
$60~OOO per year~ and provides for an increase at the beginning of
each fiscal year, tied to the rate of inflation, but not to exceed
5 percent per year, subject to cant inlled funding b~' Council under
the Refuse Fu~d Operating budget. The maximum cost of the contract,
for the entire term, with ir:flation , shall net; exceed $189,000.

contract with California Land Management in the amount of

Background
The City has contractE'd for Park Ranger services since 1983. These
services supplement the ""or-k of the City's professional Hanger
staff.
The contract Rangers are required hereunder to handle a ",'ide
variety of situations in a ti~ely and professional manner. F:xamples
of the duties include: :minor 1a .... enforcement, visible uniformed
patrol, mainter.ance, first aid and natural histN-Y interpretation.
Maintenance activities include: irrigation repair, installation and
repair of signs, fences, gates and other facilities, vegetation
control and other park relateo, repairs.

Byxbee P8rk ar'1d the FaIR Alt 0 B~ylands Area and other areas as

Contract Rangers shall use an e-1ucational approach in
every possible instance a~d will, at all times, be polite
to violators.
c) First Aid: Provide emergency first'aid to visitors ypon
request ar.d promptly notify the appropriate emergency

all of the above informacion.
d} Fire Suppression: Fire response -Contract Ranger shall
report .2llY fire to the appropriate emergency" response
agenCJr. 'I'he ranger E>hall respond to the drea safely and
witpin the posted speed limit, follo""ing all traffic
laws. The ranger shall a't-te!!lpt to secure t!le scene to

The ranger may use a fire extinguisher, on small fir~s,
only when such use 'Will not place the ranger or any other
person in potential jeopardy_ The rangers will coo?erate

e} Public contact: Contract Rangers shall maintain a current
knowlsdge of Baylands Area featl.l::--e~, activities
{including programs provided by t"he City) and applicable
City and State ordi~ances and rules.
Rancrer-s shall provide i"fcrrnaticn assistance to visitors

shall relate to the publ ic in a courte.ous and
professional manner at all ~imes.
f) Roads and Trails Maintenance: Contract P.anger shall help
keep all roadways, parking lots and trails open and c"lear
of l'tlajor debris (i.e., logs, rocks, etc.) and perform
~uch minor repairs to these facilities as can be
reasonably accornpl isned w~ thi., the constraints of the
hours provided as describ€d in Paragraph 1 (a -c)_

g) Signs Maintenanc~: Ccntract R3~gers shall install and
replace signs as requested.
h) Litter collection: Contractcr shall provide
general litter pick L!p '"ii thi i1 aay:..ands Area. on a
daily b~si~. All collected litter shall be
depcsi ted by Contractor at t.h2 city of Palo Al t,o
Sanitary La,ldfill except any it€". deened
hazardous, in ~hic~ case shall be disposed of in a
rnanrer consistent ~ith city policy and all laws
and regulations. Contr~ctor ~ill provide garbage
bags and litter sticks for litter collection.
i} Maintenance and Repair of Miscellaneous Fixtures:
Contractors shall perform routine minor repairs to
various fixtu~es including, but not limited to
fencing, gates, and benches. The work .... ·ill be
completed within the constraints ot the hours as
described in Paragraphs 1 (5 -c) .
j) Reporting c.f Mainten-3ncc Problems~ Contractor
shall report promptly to CITY any needed
maintenance repairs th~t either excee.d
Contractor's capabilitie.s or are beyond the scope
of tasks described in this contract. Reports shall
be in the manner directed by the ci ty I 5 Project
Manage::--.
3. Equipment 'Mater ial.$ and .other ServicEs Frov id€:9 .. p-y.
Contractor.
Equipment -Contractor shall provide, maintair" and
operate the following:
a) Truck: Contractor shall provide one (1) compact
four wheel drive pi ck up truck for use by its mw'n
personnel. The truck ~ill be equipped with a
yello~ light bar, a 50 gallon punper unit,
permanently muur,ted spotlight, AB:::' cher.:ical fire
extinguisher and first aid kit. The city will
provide the Contractc::-",,'i th a 1 ist of the required
contents of the first aid kit.
The truck shall be a maximum of five years old with a
maximum of 150,000 miles on the odometer and kept clean
and in good operating condition. All required equipment
",'ill be kept if"! operating condi"cion. The Contrac:tor
shall provide itts employees with daily checklists and
supervise the employees to ensure trlat the truck and
required equipment is checked befr::re 5_~.C:...h Baylands J\,rea
shift.
The City rese!."ves the right to ins:t="·ect the vehicle at
reasonable intervals to ensure co~pliance and to
requir~ approprIate repairs be made to defective
equipment within five (5) working days. The truck will
be markec in a manner consistent "ooIith City pel icy CiS
identified by the City's p~oject Manager.
b) Uniforms and Personal Eq'..Jipment: Contractor shall
provide all I.lnifcr!I'ls and personal equipment required by
j,ts staff.
Such unifcr~s shall be in acc~~dance with City
:standards as identified by Cit:r,ls Project Manager.
Contract0r t s employees shall pre-sent a neat and clean
appearance at all times.
c) Tools~ Contractor shall provide a basic compJement of
non-specialized tools for use by its staff in the
performance of their duties~ Such tools shall include
such itel':".s suc.h as haromers, scre, ... drivers, ,"'renches,
shovels, garbage bags, litter sticks, rakes and si~ilar
equipment~
d) Radios: City shall provide a 2-way radio system to the
Contractor. The Ranger ~ill have a portable or m~bile
radio for routine anc] emergency cO!'nIDunication purposes.
The radios will remain the property of the City ai1d
lITill be immediatel'y' returned upon dtssolution of this
contract~ The City is responsible fer routine
ma~ntenance of ~he radio(s). The Contractor is
responsible for any repair or replacement of the radios
or aS50ciat~d parts and devices. due to negligence,
abuse or unwarranted ~ear and tear. Such a decision. as
to nature of the cause of the problem, will be the sole
prerogative of the City's project Manage~.

The Contractor is responsible fer monitoring its staff
use of the City radio. Contractor must follow all of
the radio procedures specified by tht: City.
e) Training: Contractor shall provide all necessary

for ensuring that its staff maintains current

operation of Baylands Area. CITY may, at the discretion
of the City's Project Manager, train Contractor's

and vi thin the general scope of the tasks to be perforned,
CITY shall reserve the sole ZI!"ld exclusive right to adjust
Contractor's routine ',.;ork performance.
7. StandaJ';d~: All tasKs per-formed by Contractor under this
contract shalJ be in conf·:rrmance .. lith normal City
standards.

a. The hourly rate and season bdse fees for each rr,onthly
Eervice period shall be adjusted each July 1 st in
acc-;:.rdanc€ with the provisions contained in Paragraph 9
hereof.
b. Contractor shall present ::1or,thl:t invoic€5 to th~ City
'».'lthin five (5} working d<::ys after the end of each mcnth
during the term hereof.
c. City shall pay all invoices or: or before the twenty-fifth
